PUBLIC TRUSTEE AMENDMENT

ACT

No. 23 of 1986

AN ACT to amend the Public Trustee Act 1941.

[Assented to 25 July 1986.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the

advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Public Trustee Amendment Act 1986.

Commencement

2. This Act shall come into operation on such day as is fixed by

proclamation.

Section 45 amended

3. Section 45 of the Public Trustee Act 1941* is amended

(a)	by inserting after the section designation "45." the subsection designation "(1)";
(b)	by deleting "the Public Trustee has caused an advertisement to be published at least twice at intervals of fourteen days in a newspaper circulating in Perth and"; and
(c)	by inserting the following subsection

(2) Notwithstanding subsection (1), a sum of money to the credit of a trust or estate under administration by the Pub- lic Trustee that is equal to or exceeds the prescribed amount shall not be paid to the Treasury under subsection (1) unless the Public Trustee has caused an advertisement in respect of the sum to be published at least twice at intervals of 14 days in a newspaper circulating in Perth. ".
