AN ACT to amend the Public Trustee Act 19414979.

[Assented to 27 May 1982.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Public Mr=Viet),

In this Act the Public Trustee Act 1941-1979

The principal Act as amended by this Act may

be cited as the Public Trustee Act 1941-1982.

The principal Act is amended by inserting

after section 40 the following section-

40A. (1) In this section

Purchased

land.

"purchased land" means the land described in the Sixth Schedule purchased by the Public Trustee pursuant to subsection (2a) of section 40 of this Act;

"unused portion" means so much of the purchased land as is, on the day that the Public Trustee Amendment Act 1982 comes into operation, not used for the purposes referred to in sub- section (2a) of section 40 of this Act.

(2) In addition to the powers conferred on the Public Trustee by subsection (2a) of section 40 of this Act with respect to the unused portion the Public Trustee may lease the unused portion to any person approved of by the Minister on such terms and condi- tions as the Minister approves. " .
