A c t , 1 9 0 2 ; a n d fo r p u r p o s e s c o n n e c t e d t h e r e ­

W a l e s in P a r l i a m e n t assembled, and by t h e au thor i ty of

t h e same, as follows :—

1 . This A c t m a y be cited as t h e " P u b l i c Service
(Tempora ry Officers) A c t , 1 9 2 3 , " a n d shall be read
wi th the P u b l i c Service Act , 1902, in th i s Ac t cal led
t h e Pr inc ipa l Act .
2 . The Governor , on t he r ecommenda t ion of t h e
Board , m a y , n o t w i t h s t a n d i n g a n y t h i n g in t he P r inc ipa l
Ac t , appoin t as a p e r m a n e n t officer any person who is
a r e tu rned soldier wi th in t he m e a n i n g of t he R e t u r n e d
Soldiers and Sailors E m p l o y m e n t Ac t , 1919, and who is

t empora r i ly employed a t the c o m m e n c e m e n t of th i s A c t or has been so temporar i ly employed wi th in twelve m o n t h s pr ior to t he said c o m m e n c e m e n t u n d e r t he

(a) The Board shall be satisfied that the work
to be performed by t h e person t empora r i ly
employed is p e r m a n e n t in charac te r .
(b) The Board shall be satisfied as to the compet­
ency of such person, and t h a t his a p p o i n t m e n t
as a p e r m a n e n t officer is desirable in the pub l i c
in te res t . (c)
provisions of t he P u b l i c Service Act , 1902, in t h e
P u b l i c Service of New South W a l e s , subject to t h e
fol lowing condi t ions :—

(c)

A person shall not be eligible for appointment under this Act until he has been employed in the Public Service of New South Wales for at least two years continuously, or for two or more terms asr^re^atin^ at least three years before such appointment.

3 . All conditions imposed on persons appointed under the Principal Act shall apply to and be binding on persons appointed under this Act, except those relating to age at the date of appointment and to the mode of appointment.

4 . The Board shall assign the position in seniority of persons appointed under this Act having regard to the claims of officers already in such Service.

5 . The Board may in its discretion exempt any person to whom this Act is applicable from the necessity of passing a medical examination or insuring his life.
