Public Service Superannuation Acts Amendment Act of 1966
241 ueen-gl nt r ANNO QUINTO DECIMO EEIZABETHAE SECUNDAE REGINAE No. 32 of 1966 An Act to Amend "The Public Service Superannuation Acts, 1958 to 1965," in certain particulars [ASSENTED TO 21ST DECEMBER, 1966] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Public Service Superannuation Acts Amendment Act of 1966." (2) Principal Act. " The Public Service Superannuation Acts, 1958 to 1965," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Public Service Superannuation Acts, 1958 to 1966."
242 Public Service Superannuation Acts Amendment Act of 1966, No. 32 2. Operation of Act. (1) This Act shall come into operation on the third day of January, one thousand nine hundred and sixty-seven, which day is in this section called the " said date ". (2) Annuity benefit, or incapacity benefit, or assurance benefit payable under the Principal Act immediately prior to the said date in respect of any contributor who attained the age of sixty-five years or retired by reason of incapacity before the said date or in respect of any widow, shall on the said date and thereafter while it continues to be payable be paid under the Principal Act as amended by this Act. (3) Salaries exceeding $369.60 per fortnight. For the purpose of contributions in accordance with the scale contained in Schedule I to the Principal Act as inserted by this Act, the salary of every officer who is a contributor on the said date, and whose fortnightly salary then exceeds three hundred and sixty-nine dollars sixty cents, shall be deemed increased from three hundred and sixty-nine dollars sixty cents on and from the said date. 3. Amendment of s. 4 . Section four of the Principal Act is amended by- (a) in the definition " Minister," omitting the words " Chief Secretary " and inserting in their stead the words " Minister for State Development "; and (b) in the definition " Surrender value " omitting the word " pounds " where it appears in paragraph (b). 4. Amendment of s. 18 ( 5). Subsection (5) of section eighteen of the Principal Act is amended by omitting the words " four pounds ten shillings per centum " and inserting in their stead the words " four and one-half per centum ". 5. Amendments of s. 20. Section twenty of the Principal Act is amended by- (a) in subsection (2) omitting paragraph (b) and inserting in its stead the following paragraph:- " (b) In the case of an officer to whom paragraph (a) of this subsection does not apply, the prescribed date shall be the first day of the periodical interval at which contributions to the Fund are prescribed to be made next after the date when the Board accepts him as a contributor." ; and (b) in subsection (3), omitting the second subparagraph of paragraph (a) and inserting in its stead the following subparagraph:-- " Until some other periodical interval is prescribed such contribution shall be payable by and be deducted from the salary of the contributor fortnightly." 6. Repeal of and new s. 21. The Principal Act is amended by repealing section twenty-one and inserting in its stead the following section:- " [21.1 Salary for the purposes of this Division . (1) In this Division salary " in relation to an officer means the fortnightly salary of that officer. (2) The fortnightly salary of an officer who is paid salary at it rate other than a fortnightly rate of salary shall be ascertained as prescribed. Different such prescriptions may be made in respect of officers included in different classes of officers."

Section twenty-two of the Principal Act is amended by omitting subsections (6) and (7) and inserting in their stead the following subsections:- " (6) Any increased contribution payable in pursuance of paragraphs (a), (b) or (d) of subsection (4) of this section is payable as frpm the first day of the periodical interval at which contributions to the Fund are prescribed to be made next after the date- (a) upon which the contributor's salary is increased; or (b) from which the contributor's salary is increased, whichever is the later. (7) Any increased contribution payable in pursuance of paragraph (c) of subsection (4) of this section is payable as from the first day of the periodical interval at which contributions to the Fund are prescribed to be made next after the date of the election." 8. Amendment of s. 22A. Section 22A of the Principal Act is amended by omitting subsection (5) and inserting in its stead the following subsection " (5) Any increased contribution under this section shall, subject to subsection (4) of this section, be payable as from the first day of the periodical interval at which contributions to the fund are prescribed to be made next after the date when the Board accepts as a contributor under this section the officer making the election." 9. Amendments of s. 24. Section twenty-four of the Principal Act is amended by- (a) in the last paragraph omitting all words from and including the words " three-eighths of the rates " to the end of that paragraph and inserting in their stead the words " thirty-five per centum of the rates thereof which, save for this paragraph, apply under this Act but so that, in the case of annuity benefit or incapacity benefit, such benefits shall not be reduced below the rate of thirty-three dollars sixty cents per unit per annum "; and (b) adding the following proviso:- "Provided that the value of any such excess unit shalt not be reduced to less than the rate of thirty-three dollars seventy-five cents per annum- (a) in the case of annuity benefit, where the officer concerned attained the age of sixty-five years before the third day of January, one thousand nine hundred and sixty-seven; or (b) in the case of incapacity benefit, during the continuance of unpaid sick leave in respect whereof incapacity benefit became payable to the officer concerned before the third day of January, one thousand nine hundred and sixty-seven." 10. Amendments of s. 27. Section twenty-seven of the Principal Act is amended by- (a) omitting the numeral and brackets " (1) "; and (b) omitting subsection (2). 11. Amendment of s. 28. Section twenty-eight of the Principal Act is amended by omitting the words " five-eighths of the payment so made " and inserting in their stead the words " sixty-five per centum of the payment so made."

Section thirty of the Principal Act is amended by- (a) in subsection (1) omitting the words " forty-five pounds " and inserting in their stead the words " ninety-six dollars "; (b) in subsection (2)- (i) omitting the words " sixteen pounds seventeen shillings and six pence per annum " and inserting in their stead the words " thirty-three dollars sixty cents per annum "; (ii) adding the following proviso:- " Provided that in the case of an officer who attained the age of sixty-five years before the third day of January, one thousand nine hundred and sixty-seven, the unit of annuity benefit shall be at the rate of thirty- three dollars seventy-five cents per annum during his or her continuance in employment as an officer."; (c) in subsection (3)- (i) omitting the words " sixteen pounds seventeen shillings and sixpence per annum " and inserting in their stead the words " thirty-three dollars sixty cents per annum "; (ii) omitting the words, numerals and quotation marks " the Industrial Court under " The Industrial Conciliation and Arbitration Acts, 1932 to 1958 " " and inserting in their stead the words, numerals and quotation marks " the Full Bench of the Industrial Commission under " The Industrial Conciliation and Arbitration Acts, 1961 to 1964 " "; (iii) adding the following proviso:- " Provided that in the case of an officer re-employed before the third day of January, one thousand nine hundred and sixty-seven, the unit of annuity benefit shall be at the rate of thirty-three dollars seventy-five cents per annum during the continuance of such re-employment.". 13. Amendments of s. 32 . Section thirty - two of the Principal Act is amended by- (a) in subsection ( 1) omitting the words " forty - five pounds per annum " and inserting in their stead the words " ninety - six dollars per annum "; and (b) in subsection (2)- (i) omitting the words " sixteen pounds seventeen shillings and sixpence per annum " and inserting in their stead the words " thirty-three dollars sixty cents per annum "; (ii) adding the following proviso :- " Provided that in case of sick leave without salary in respect whereof the officer concerned became entitled to incapacity benefit prior to the third day of January, one thousand nine hundred and sixty-seven , the unit of incapacity benefit shall be at the rate of thirty - three dollars seventy-five cents per annum during the continuance of that sick leave."

Subsection (1) of section thirty-four of the Principal Act is amended by omitting the words " twenty-eight pounds per annum " and inserting in their stead the words " sixty dollars per annum ". 15. Amendments of s. 36 (1). Subsection (1) of section thirty-six - of the Principal Act is amended by- (a) in paragraph (a) omitting the words " fifty-two pounds " and inserting in their stead the words " one hundred and four dollars "; and (b) in paragraph (b) omitting the words " one hundred and four pounds " and inserting in their stead the words " two hundred and eight dollars ". 16. Amendment of s. 37. Section thirty- seven of the Principal Act is amended by omitting the words thirty- three pounds ", where they appear in paragraph ( b), and inserting in their stead the words " sixty-six dollars ". 17. Amendment of s. 41 . Section forty-one of the Principal Act is amended by omitting subsection (3) and inserting in its stead the following subsection:- " (3) Benefits shall as far as practicable be paid fortnightly or, if so determined by the Board, periodically at other intervals." 18. Amendments of s. 55 . Section fifty-five of the Principal Act is' amended by- (a) omitting the words "sixteen pounds seventeen shillings and sixpence per annum " and inserting in their stead the words " thirty-three dollars sixty cents per annum "; and (b) adding the following proviso:- " Provided that in the case of an officer who attained the age of sixty-five years before the third day of January, one thousand nine hundred and sixty-seven, every such excess unit shall be at the rate of thirty-three dollars seventy-five cents per annum." 19. Amendments of s. 56. Section fifty-six of the Principal Act is amended by- (a) omitting the words " at the rate per unit of sixteen pounds seventeen shillings and sixpence per annum " and inserting in their stead the words " at the rate per unit of thirty-three dollars sixty cents per annum "; (b) adding the following proviso:- " Provided that, in respect of any such excess unit, the entitlement under this section shall be to receive incapacity benefit at the rate of thirty-three dollars seventy-five cents per annum- (a) where the officer concerned was retired before the third day of January, one thousand nine hundred and sixty-seven; or
246 Public Service Superarnruation Acts Amendment Act of 1966, No. 32 (b) during the continuance of unpaid sick leave in respect whereof incapacity benefit became payable to the officer concerned before the third day of January, one thousand nine hundred and sixty-seven." 20. Amendment of' s. 60 . Section sixty of the Principal Act is amended by omitting subsection (2) and inserting in its stead the following subsection:- " (2) Save the persons specified in subsection (3) of this section, every person to whom this subsection applies shall be paid from the Fund an additional amount at the rate of four hundred dollars per annum on and from the third day of January, one thousand nine hundred and sixty- seven, and thereafter so long as annuity. benefit under the repealed Acts continues to be payable to him." 21. Amendments of s. 61. Section sixty-one of the Principal Act is amended by- (a) omitting, subsection (2) and inserting in its stead the following subsection:- " (2) Save the persons specified in subsection (3) of this section, every person to whorn this section applies shall on and from the third. day of January, one thousand nine hundred and sixty-seven, and thereafter so long as incapacity allowance under the repealed Acts continues to be payable to him or her be paid from the Fund an additional amount at the rate of- (a) in the case of a female person having such right and interest in respect of incapacity allowance at the rate of eighty dollars per annum per unit, three hundred and twenty dollars per annum ; and (b) in any other case, four hundred dollars per annum."; and (b) in subsection (4) omitting paragraph (b) and inserting in its stead the following paragraph- " (b) Section sixty of this Act shall apply to such person on and from the date when he attains the age of sixty-five years. For the purpose of so applying that section to the case of a person who attains the age of sixty-five years on or after the third day of January, one thousand nine hundred and sixty-seven, any reference in that section to the said third day of January shall be read as referring to the date on which he attains the age of sixty-five years." 22. Amendment of s. 64 (2). Subsection (2) of section sixty-four of the Principal Act is amended by omitting the second paragraph and inserting in its stead the following paragraph :- " For the purpose of so applying that section to the case of such an officer or person who is so retired on or after the third day of January, one thousand nine hundred and sixty-seven, any reference in that section to the said third day of January shall be read as referring to the date of his retirement." 23. Amendment of s. 65 (2). Subsection (2) of section sixty-five of the Principal Act is amended by omitting the second paragraph and inserting in its stead the following paragraph:--- For the purpose of so applying that section to the case of an office- or other person who attains the age of sixty-five years on or after the third day of January, one thousand nine hundred and sixty-seven, any reference

Amendment of s. 68 (1). Subsection (1) of section sixty-eight of the Principal Act is amended by omitting the words " one hundred pounds " and inserting in their stead the words " four hundred dollars ". 25. Amendment of s. 69 (4). Subsection (4) of section sixty-nine of the Principal Act is amended by omitting the words " one hundred pounds " and inserting in their stead the words " four hundred dollars ". 26. Amendments of s. 71 (5). Subsection (5) of section seventy-one of the Principal Act is amended by- (a) in paragraph (a) omitting the words " fifty pounds "and inserting in their stead the words " one hundred dollars "; (b) in paragraph (b) omitting the words " two hundred pounds " and inserting in their stead the words " four hundred dollars "; and (c) in paragraph (c) omitting the words " sixteen pounds seventeen shillings and sixpence" and inserting in their stead the words " thirty-three dollars sixty cents." 27. Amendments of s. 76 (2). Subsection (2) of section seventy-six of the Principal Act is amended by- (a) in the first paragraph omitting the words " three-eighths " and inserting in their stead the words " thirty-five per centum ": and (b) omitting the proviso and inserting in its stead the following proviso:- PPrroovvidiedded. that the amount of the unit of annuity benefit or of incapacity benefit under this Act shall not by reason of this section be reduced to less than- (a) (in the case of annuity benefit the entitlement whereto accrued prior to the third day of January, one thousand nine hundred and sixty-seven) the rate of thirty-three dollars seventy-five cents per annum; (b) (in the case of incapacity benefit the entitlement whereto accrued prior to the third day of January, one thousand nine hundred and sixty-seven), the rate of thirty-three dollars seventy-five cents per annum during the continuance of that entitlement; or (c) (in any case to which the provisions of paragraphs (a) or (b) of this proviso do not apply) the rate of thirty-three dollars sixty cents per annum". 28. Amendments of s. 85 (1). Subsection (1) of section eighty-five of the Principal Act is amended by, in the second paragraph,- (a) omitting the words " forty pounds " and inserting in their stead the words " eighty dollars "; (b) omitting the words " eighty pounds " and inserting in their stead the words " three hundred and twenty dollars "; and (c) omitting the words " one hundred pounds " and inserting in their stead the words " four hundred dollars". 29. Amendment of s. 86 (1). Subsection (1) of section eighty-six of the Principal Act is amended by omitting the words " fifty pounds ", where they appear in paragraph (ix), and inserting in their stead the words " one hundred dollars ".
