Public Service Superannuation Acts Amendment Act of 1962
266 ANNO UNDECIMO ELIZABETHAE SECUNDAE REGINAE •••••••••••••••••••••••••••••••••••••••••••••••••••• No. 31 of 1962 An Act to A.mend "The Public Service Superannuation Acts, 1958 to 1960," in certain particulars [ASSENTED TO 18TH DECEMBER, 1962] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title. This Act may be cited as "The Public Service Superannuation Acts Amendment Act of 1962." (2) Principal Act. "The Public Service Superannuation Acts, 1958 to 1960," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as "The Public Service Superannuation Acts, 1958 to 1962."
Public Service Superannuation Acts Amendment Act of 1962, No. 31 267 2. Operation of this Act. (I) Sections three, four and five of this Act shall come into operation- (a) on the date of the passing hereof, if that date is the first day of a calendar month; or (b) if the date of the passing hereof is not the first day of a calendar month, on the first day of the calendar month next following the date of the passing hereof. (2) Incapacity benefit payable under the Principal Act immediately prior to the passing of this Act in respect of any person theretofore retired by reason of incapacity shall, on the coming into operation of section three of this Act and thereafter while it continues to be payable, be paid under the Principal Act as amended by this Act. (3) Assurance benefit or additional assurance benefit payable under the Principal Act in respect of any widow or child immediately prior to the coming into operation of sections four and five of this Act, shall, on the coming into operation of the said sections and thereafter while it continues to be payable, be paid under the Principal Act as amended by this Act. 3. Amendments of s. 32 (2). Subsection (2) of section thirty-two of the Principal Act is amended by- (a) omitting the words "or who, before he or she has been a contributor for incapacity benefit for five years, is retired by reason of incapacity" where those words appear in the first paragraph; and (b) omitting the second paragraph. 4. Amendment of s. 34 (1). Subsection (1) of section thirty-four of the Principal Act is amended by omitting the words "twenty-one pounds" and inserting in their stead, the words "twenty-six pounds and five shillings". 5. Amendments of s. 36 (1). Subsection (1) of section thirty-six of the Principal Act is amended by- (a) in paragraph (a), omitting the words "twenty-six pounds" and inserting in their stead the words "fifty-two pounds"; and (b) in paragraph (b), omitting the words "fifty-two pounds" and inserting in their stead, the words "one hundred and four pounds". 6. New s. 73D inserted. The Principal Act is amended by inserting after section 73c thereof, the following section:- "[73D.] When limited contributor may become full contributor. Upon application in that behalf by an officer who is contributing under this Part for annuity benefit or further annuity benefit and upon production by such officer to the Board of evidence of good health satisfactory to the Board, the Board shall accept such person as a contributor to the Fund as if his employment by or under the Crown
268 Public Service Superannuation Acts Amendment Act of 1962, No. 31 or, as the case may be, the University of Queensland in a permanent capacity had begun on the date when he produced such evidence to the Board: Provided that, in respect of all benefits for which he is contributing to the Fund on the date when he produces such evidence such an officer (instead of contributing in accordance with the appropriate Table contained in Schedule II to this Act) shall continue to make to the Fund the contribution therefor then being made by him." 7. Amendment of Schedule I. Schedule I to the Principal Act is amended by omitting Part I and inserting in its stead the following Part 1:- "PART 1.-MALE OFFICERS. Scale of Units of Benefits. Column 1.
