This Act may be cited as "The Public Service : : ~ ~ fA~ t. Superannuation Act of 1912," and shall commence and take effect on and from the first day of January, one thousand nine hundred and thirteen. Interpreta. tion. Board. 2. The Governor in Council may from time to time, by Order in Council, speci&lly except any officer or class of officers from the operation of this Act; and from and after the date of such Order this Act shall not apply to any such officer or clas~ of officers. Public Service 4. (1.) Fo}' the purposes of this Aet there shall be tSiounpeBraonanruda. - constituted a Board, to be called the Public Service Superan- nuation Board, which shall consist of five persons, three of whom shall be elected by the contributors, and two of whom shall be appointed hy the Governor in Council. The Governol' in Council shall appoint one of such last-mentioned persons to be the manager and executive officer of the Fund. All such persons shall hold office for a term of three y':'ars and be eligible for re-election and re-appointment. Until such time as the roll of contdbutors is com- pleted and their representatives are elected, which shall be within six months after the commencement of this Act, the two persons appointed by the Governor in Council shall have power to act. The Chairman shall from time to time be elected by the members of the Board. 'l'hn fees, salaries, or emoluments to be paid to the manager and other members of the Board shall be decided hy the Governor in Council. Deputy. ( ~ . ) In case' of the illness, inability, or absence of any member of the Board, the Governor in Council may appoint some otlH'r officer to act as the deputy of such member during such illness, inability, or absence; and evel'Y such person shall, while he acts ns such deputy, have all the powers and perform all the duties of such member. Any officer of the Public Service appointed under this section, or elected or appointed a member of the Board or manager, shall be deemed to be still an officer of the Public Service, and. may hold such office, in conjunct.ion with any other office held by him. 5699 * 53 Vie. No. 28, Any gratuities for meritorious services provided by the regulations under ,; The Publio Service Acts, 1896 to 1901," tII which have accrued as on the thirtieth day of June, one thousand nine hundred and thirteen, to Qfficers who are voluntary contributors under this Act, shall (but without any' further addition or accumulation) be a first charge against the annual appropriation of five thousand pounds provided by this subsection to the extent in . the aggregate of the sum of five thousand pounds in anyone year, and no further; and, subject to the continued good service of such officers, all such gratuities shall be paid to them respectively by the Board when such gratuities become due: Provided that if in any year the amount of sm·h gratuities exceeds the said sum of five thollsand pounds the amount of such excess shall be paid out of Consolidated H.evenue, which is hereby appr,opriated for the purpose: Provided that the present annual value of any such gratuity accrued on account of a contributor on the thirtieth day of June, one thousand nine hundred and thirteen, may, on the application of s.uch contributor, be applied b~ T the Board out of the said annual appropriation in reduction of the amount of contribu- tion payabJe by him; and thereupon such contributor shall ceaHe to have any right or title to such gratuity. The amount so paid from time to time by the Hoard in reduction of any contribution shall n0t be takt'n into consideration in assessing the surrender value under the Act of such officer's interest in the :Fund. (4.) All contributions and moneys paid to the Fund under this Act, and all payments out of the ·Fund on account of assurance, annuity, incapacity allowance, or surrender value of contributions, shall be exempt from any charge or duty whatsoever for or in respect of income tax, stamp duty, or probate or succession duty. PUBLIC SERVIOEl Public Service Superannuation Act. 5701 The Fund shall be deemed to be a "Government Trust :Fund " 1vithin the Ineaning of section one of" The Savings Bank Amendillg Act of 1882"* as amended by section six of "The Government Savings Bank Acts Amendment Act of 1896."t 11. (1.) Subject to this Act, the Fund shall be applied Application to the following purposes ~ _ of Fund. (a) Payment of assurances, annuities, and inca- pacity allowances under this Act; . (b) Payment of the surrender value of et contribu- tor's interest in the Fund in cases where such payment is provided for by this Act; (e) Payment ~ f gratuities for meritorious services a~ provided by sllbsection three of section nIne. (2.) When claims to henefit under this Act have been made and allowed hy the Board, the manager shall be authorised to make to the claimants the necessary pay- ments out of the Fund; and the receipts signed from time to time by such claimants re~ pectively for such payments shall effectually discharge the manager and the Fund from any further liability or obligation whatsoever in respect of such benefit. 12. (1.) Subject to this Act, the following persons Compulsory shall respectively be contributors for at least one unit of contributors. assurance, one unit of annuity, and one unit of incapacity allowance under this Act, namely :- (a) Every officer who at the commencement of this Act is of the age of sixteen years, but is under the age of thirty years; and (b) Every officer who at the commencement of this Act is not of the age of sixteen years, but subsequently attains that age, on attaining that age; and (e) Every person who after the commencement of this Act is admitted into the Pu blic Service, whether after probation or otherwise, and who is of the age of sixteen years or over; and (d) Every person who after th~ commencement of this Act is admitted into the Public Service, whether after probation or otherwise, and who 11< 46 Vie. No. 28, is not of the age of sixteen years, but subse- quently, while an officer, attains that age, on attaining that age: Provided that any female officer may, on application, be wholly exempted by the Board from contributing for assurance, but not from contribating for at least one unit of annuity and one unit of incapacity allowance. (2.) Subject to this Act, any compulsory contributor under the last preceding subsection who only contributes for one unit of assurance, one unit of annuity, and one unit of incapacity allowance, or who, being a female exempted from contributing for assurance, contributes only for one unit of annuity and Qne unit of incapacity allowance, shall, upon attaining the age of thirty years or a salary of two hundred pounds per annum, whichever first occurs, unless at that time incapacitated or in ill health, and in such case thereafter upon recovery, con- tribute for one additional unit of assurance, one additional unit of annuity, and one aclditional unit of incapacity allowance, or, being a female exempted as aforesaid, for one additional unit of annuity and one additional unit of incapacity allowance: Provided that any such compulsory contributor, whether male or female, and if a female whether exempted as aforesaid or not, may apply to the Board for exemption from this requirement, and the Board may grant exemption either wholly, or in part, or permanently, or for a term only. (3.) Any compulsory contributor under this section may at any time further voluntarily contribute for any number of units of assurance and annuity, or annuity only but not assurance only, in excess of the compulsory units not exceeding two such further units; but having become a contributor for two units of incapacity allowance shall not contribute for any further unit of incapacity allowance. (4.) Any officer over the age of sixteen years at the commencement of this Act, who becomes a compulsory contributor under this section, and who has assured his life in a sum of not less than two hundred pounds, and who deposits his policy of assurance with the Board, may be Exempted from contributi(Jn for assurance to the extent of one unit of assurance for each ·complete two hundred pounds of assurance provided for under such policy. There shall, in addition to the monthly deduction on account of annuity and incapacity allowance contributed

Public Service Superannuation Act. for by him, be deducted from his salary and plid to the company or association with. which he is assureCl-, such sum or sums as an' necessary to keep such policy in force. Upon retirement from the PulJlic Service from any cause, the contributor shall be entitled to receive from the Board such policy of assmance. 13. (1.) Subject to tbis Ad, any officer who at thevolu?tary commencement of this Act is thirty years of age or overcoC1trlbutors. may, within on8 year after the commencement of this Act or such further time not excel'ding one year as the Governor in Council may prescribe, become a contributor upon making application to the Board ancl producing a. declaration 01' certificate of g'ood health satisractory to the Board, or such other evidence thereof as they may require. Subject to the approval of the Board, such contrihutor may at once contribute for at least one unit or at any future time for any number of units or half-units in excess of the interest originally taken not exceeding a total of four units of assurance and annuity, or of annuity only lmt not of assurance only. and at once for one unit or two units, and, if only one \ ~ nit is originally taken, at any future time for one additional unit not exceeding a total of two units of incapacity allowance. (2.) Subject to this .Act, any male officer who at the commencement of this Act is forty years of age or over, and who has not taken advantage of the provisions of the last preceding subsection, may, within one year after the commencement of this Act or such further time not exceeding one year as the Governor in Council ,may prescribe, become a contributor upon making application to the Board and produci:!lg a declaration or certificate of good health satisfactory to the Board, or such other evidence thereof as they may require. Subject to the approval of the Board, such contributor may contribute at once for at least one unit or at any future time for anv number of units or h:llf-units in excess of the interest originally taken not exceeding a total of four units of assurance and annuity, such annuity being payable at the age of seventy year:-; in p1ace of at the age of sixty-five years, 01' of such annuity only but not of assurance only; and at once for one unit or two units, and, if only one unit is originally taken, at any future time for one additional unit not pxceeding a total of two

No. 28, units of incapacity allowance payable in accordance with this Act up to the age of seventy years in place 'of up to the age of sixty-five years. Any such officer, if the exigencies of the Public Service permit or unless he is incapacitated, shall be continued in employment until he attains the age of seventy years, anything in " The Pl.tblie Se,'vice A et 0/ 1896,"* or any regulations thereunder, to the contrary notwithstanding: Provided that,)f any such c~ntributor is required to retire after attaining the age of sixt.y-five years and before attaining the age of seventy years from any cause other than in consequence of misconduct or mental or bodily infirmity, he shall, lip to the age of seventy years, be entitled to an amount as annuity equivalent to the inca- pacityallowance contributed for by him, and any payment out of the Fund on this account shall be repaid to the Fund out of the Consolidated Revenue, which is hereby appropriatrd for that purpose; and aftf~ r attaining the age of seventy years he shall be entitled to the annuity for which he has contributed, payable out of the Fund. (3.) ?\ otwithstanding anything in this ~ ection, the Board may, if in any case they think it desirable so to do, reject any application made under this section. .A p p l i c a t i o n 14. After an officer has become or been admitted to ifnotrefruesrlt. her he a contributor, every applIcation by such officer to ta~ e up a further interest in the Fund, whether made as required by this Act or voluntarily, shall be Illade to the Boarp, and shall, if required by the Board, be accompanied by a certificate of good health satisfactory to the Board in the prescribed form, signed by a medical practitioner. Notwithstanding anything herein contained, the Board may, if in any case they thiIik it desirablo so to do, reject or postpone acceptance of any such application. Rate of . 15. Schedule. Excepting only with respect to cont ributors under subsection two of section thirteen who contribute for annuities payable at the age of seventy years in place Qf the age of sixty-five year:<, and whose contributions extend and continue up to the age of seventy years, all contributions shall cease at the age of sixty-five years: Provided that during the paymed of incapacity allow- ance to a contributor or, if a contributor has not contri- buted for incapacity allowance, during incapacity under such conditions as would if he bad so contributed have entitled him to incapacity allowance, such contributor shall still, for the purposes of thi~ Act, be deemed to be a con- tributor; but all contributions shall be suspended, and on the recovery of such contributor 8[ul11 be resumed at the original rat~ s paid by such contributor without any further pa~ - ment on account of contrihutions not paid by him during such period of incapacity. 16. If a contributor (including a contributor under Surrender subsection two of section thirteen), having contributed for value, when one f u It year at any tu ° ne t 1 lerea f ter, voluntan ·1 y 1 eaves t h e payable. Public Service, or before attaining the agc of sixty-five years from any cause other than mental or bodily infirmity is required to retire from the Public Service, such officer shall be entitled to receive such amount, by way of surrender value of such officer's vyhole interest in· the Fund, as is determined by the Actuary and approved by the Board:

No. 28, Provided that, upon such terms and conditions as the Board may direct, such contributor may be permitted by the Board to flontinue to pay his or her contributions and preserve his or her right to benefit under this Act, subject, however, to a reduction of benefit to be detet'mined bv .the Actuary and approved by the Board in consideratioit of any contribution to the Fund made out of Consolidated Hevenue under this Act: Provided also that, if any contributor is dismissed from the Public Service in consequence of any misappro- priation of funds, the amount of any such misappropriation shall be a first charge against. any such surrender value, and may be deducted therefrom. The repayment of such amount aforesaid shall he in lieu of any surrend~ r value of contribution for annuity under the last preceding section to which such contributor might otherwise be entitled. Payment at death. 20. On the death of a male contributor who has con- tributed for assurance, his widow or children, or, if there he none, his legal representative. shall. be entitled to receive the sum of two hundred pounds for each unit of assurance for which he has contributed: Provided that, at the death of a contributor leaving a widow and children or either, the Board may, if deemed to be necessary or to be in the interests of such "vidow or children, substitute for a lump sum payment an annuity to the value of the same, as determined by the Actuary. On the death of' a female contributor, her legal representative sbaH he entitled to receive the sum of two hundred pounds for each unit of assurance for which she has contributed. Annuity and incapacity allowance. 21. Every contributor who- (i.) Has attainpd the age of :lixty years, and who voluntarily leaves the Public Service, shall on retirement be entitled either to the surrender value of his or her whole interest in the Fund as

Public Service Superannuation Act. hereinbefore provided, or, subject to approval by the Board, and subject to such conditions as they ll1ay impose, to such annuity as may be certified to by the Actuary as equivalent to the value of his or her whole interest in the Fund: (ii.) Is before att: ~ ining the age of sixt~ ' - five years, or in the case of a contributor under sub- section two of section thirteen before attaining the age of seventy years, required to retire ,from the Public ~ el' vice in accordance with ~ section fOIty-eight ot "Tile Public Service .Act of 1890,"* and in consequence of mental or bodily infirmity, and is unable or unfit to accept employment, or who in conse- quence of such infirmity is not retired but is granted leave without pay, and is not entitled 1.0 any further leave or extended or sick kave under the regulations in force under the said Act, shall be entitled to receive an incapacity allowance of fifty pounds per annum, lJayable monthly, on account of each unit of incapacity allowance for which he or she has contributed; such allowance to continue only until recovery and to be subject to reconsideration' and such proof ot continued incapacity from time to time as the Board may require: Provided that any such contributor, upon recovery and cessation of such incapacity allowance, shall- (a)· Ure-employed in the Public Service, continue to contribute at the rat es contributed by him or her prior to such incapacity, and shah be entitled to the same benefits originally contributed for; or (b) If not re-employed in the Public Service,be entitled to such rights as are under section eighteen or subsection (i.) hereof conferred on a contributor voluntarily leaving the Public Service; (iii.) No. 28', retirement be entitled to receive an annuity of fifty pounds per annum, payable monthly, on account of each unit of annuity for which he or she has contributed. ; (iv.) Beir.g a male, has contributed for annuity at the age of' seventy years under subsection two nf section thirteen and has att.ained the age of seventy years, shall, upon retirement, be entitled to receive an ann'lity of fifty puunds per annum, payable monthly, on account of each unit of annuity for which he h1S contri- buted. . Variation of 22. Any contributor, on retirement, may apply for a benefit. commutation by way of a lump sum in place of an annuity, or for an additional annuity in place of assurance, or the widow or children of a deceased male contrihutor may apply for an annuity in place of assurance; such commu- tation or annuity shall be of the amount determined bv the .\ ctuary and -approved. by the Board.. • Disputes. 23. Every dispute respecting any claim for any,ray- ment out of the Funu under this Act shall be referred to the manager, who, after due inquiry, shall report thereon to the Board. The Board shall thereupon determine the matter of such dispute and the person or persons entitled to the amount in dispute, and the determination of the Board shall be binding and conclusive on all persons without right of recourse to any court or judicial tribunal what- soever: Provided, however, that any person m~ y appeal from any such determination of the Bom:d by a memorial to the Governor in CounciL Assignment, .&c., prohibited. 24. It ~ hall not be lawful for any contributor or any persoll who may be or become entitled. to any of the benefits of this Act to assign, transfer, make over, or otherwise part with, either. absolutely or conditionally, any sum of money to which he or she m!ly be or become entitled under this A.ct. And any deed, instrument, or document purporting to assign, transfer, make over, or part with any such sum of money as aforemid shall he void. Save as herein otherwise provided, no sum of money to which any contributor or any such person may be

Public Service Superannuation Act. entitled as aforesaid shall pass to the creditors of, or be in any wny liable to or chargeable with the payment of any of the debts, liabilities, or engagements of, such contri- butor or person, or be levied or attached or taken in execution by virtue of any process. 25. The Auditor-General or such officllI' of his staff as Audit. he may from time to time appoint shall, once at least in every year, examine the books and accounts ofthc manager in connection with the Fund, and shall report thereon to Parliament. 26. Once at least in every five years after the Quinquennial commencement (I f t1 lI · S Act, t1le Board Is llal cause tlle. iancvteusatirgiaatliOlllJ. assets and liabilities of the Fund to be valued and reported on by an Actuary. rrhe Actuary shall report on- Ca) The sufficiency of' the contributions to and actuarial soundness of the Fund; and (b) Whether the condition of the Fund requires any adjustment to be made in the prescribed amounts of assurances or annuities or incapacity allowances, or in the rates of contributions for the same; and (c) If a surplus is shown, the manner in which such !'mrplus may be dealt with; and (d) The rates of surrender values which may be allowed to persons eeasing to contribute;· and ( e) Any other actuarial matter affecting the Fund as may be required by the Board. Upon completion of such valuation, the Board may take such steps as they deem advisable to comply with the recommendations of the Actuary. 27. The Governor in Council ma,y from time to time Regulations. make regulations with respect to all or any of the following matters :- (i.) Regulating the method of election of the elective members of the Board, the conduct of

Nb. 28, the busines!'I of the Board. the quorum at meetings, the procedure at meetings, and the powers and duties of the Chairman; (ii.) Prescribing the duties of the manager and other officers appointed for the purposes of this Act, and 'the mode of keeping the accounts; (iiL) Prescl'ibing forms to be used for the purposes of this Act; (iv.) Prescribing any c()nditions on which incapacity allowances are payable; (v.) Uegulating payments by contributors absent on leave without pay; (vi.) Upon the advice of tbe Actuary, or in accord- ance with tables provided by him, prescribing the rates of contributions and the amounts of assurances, annuities, and incapacity allowances payable under this Act in respeetof interests in the Fund, and for that purpose altering all or any of the pl'escribed rates and amounts; and of surrender values of contributors' interests; (vii.) Prescribing or regulating any matter or thing proper for giving full effect to this Act, and which is not by this Act provided for, or is by this Act insufficiently provided for. All such regulations shall, upon being published in the Gazette, have the sanie effect as if they were enacted in this Act, and shall not be questioned in any proceedings whatsoever. All such regulations shall be laid before - both Houses {)f Parliarnent within forty days after the publication thereof if Parliament is then sitting, or, if not, then within forty days after the commencement of the next ensuing session thereof. If either House of Parliament, within forty days after sllch regulations are so laid before such H'luse, resolves • that the same or any part thereof ought to be annulled, then such regulations or such part in such resolution refen'eel to shall, from the date of such resolution, be annulled, without prejudjce, however, to anything done ,or suffereel thereunder in the meantime prior to such date.
