SERVICE AN S N U U P A E T R IO - N [ASSENTED TO 5TH NOVEMBER, 1927.] BE ACT tMENDf::.t it enacted by the King's Most Excellent Majesty, eT OF. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short titl? 1. This Act may be cited as "The Public Service : ~s= r! ~ lon, Superannuation Act Amendment Act of 1927," and shall * mencement be read as one with "The Public Service Superannuation ~ ~ Act of 1912," herein referred to as the Principa 1 Act. The Principal Act and this Act may be cited together as "The Public Service Superannuation Acts, 1912 to 1927." Save where otherwise provided, this Act shall com- mence and take effect on and from the first day of November, one thousand nine hundred and twenty-seven. Amendment 2. The following amendments are made in section of 8. 2_ two of the Principal Act:- Officer. The definitions of "Officer," "Unit of assurance," "Unit of annuity," and" Unit of incapacity allowance" are repealed and the following definitions are respectively insertp,d in lieu th~ reof: - r .. "Officer" or " Officer of the .Public Service"- Any person in the employment of the Crown whose employment is, in the opinion of the Board, of a permanent character: the term includes officers or persons employed by any :Minister of the Crown, public officer, person, board, or corporate body acting for and on behalf of, or as the agent of, or as representing, the Crown or His Majesty the King: the term does not, however, include members of the Police Force or officers or employees of the Department of Railways or (save as here~ n provided) any person or class of persons specially excepted by the Governor in Council from the operation of this Act; v. 3 Geo. " Unit of assurance"-An amount of two hundred Unit of pounds (with such additional amounts, if assurance. any, by way of bonuses as may from ,time to time be declared) payable either at the death of a contributor, or on the attainment of the age of sixty-five years or at death if death occurs prior to that age, according to whether such contributor has contributed for assurance payable- (i.) At death; or (ii.) At age sixty-five or death prior to age sixty-five; " Unit of annuity" -An amount of fifty pound1'l Unit of per annum (with such additional amounts, annuity. if any, by way of bonuses as may from time to time be declared) payable monthly or at shorter intervals if so prescribed in the case of males at the age of sixty-five years or seventy years, as the case may be, or in the case of females at the age of sixty-five years; "Unit of incapacity allowance"-An amount of Unit of fifty pound . s per annum (with such additional ianllcoawpaanccitey. amounts, If any, by way of bonuses as may from time to time be declared) payable monthly or at shorter intervals if so pre- scribed during the continuance of incapacity under the conditions prescribed." Subject to this Act, the operation of this section shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty- .seven. 3. Section three of the Principal Act is repealed Amendment and the following sections are inserted in lieu thereof :_ of s. 3. " [3.] The Governor in Council may from time to Limiting time by Order in Council specially except any officer or Act. class of officers from the operation of this Act, either for a specified time or without limit of time; and from and after the date of such Order and while the same subsists this Act shall not apply to any such officer or class of ·officers; Provided, nevertheless, that upon the application ()f any officer specially excepted a& a.foresaid to become

No. 5, a voluntary contributor, the Board may accept such application, and thereupon this Act shall apply to such officer notwithstanding that he has been so excepted or is one of a class of officers which has been so excepted. University staff. [3A.] (1.) The Governor in Council, upon the recom- mendation of the Board made with the concurrence of the Senate of the University of Queensland, may from time to time by Order in Council declare that the provisions of this Act, either wholly or with all such modifications thereof or additions thereto as are by him deemed necessary to meet the particular circumstances~ shall apply to officers and servants of the said University. Thereupon the provisions of this Act, either wholly or with such modifications or additions as aforesaid, shall apply and extend to such persons: Provided as follows:- (a) By any such Order in Council the persons or classes of persons who shall for the purposes of this section be considered to be officers and servants of the said University may be defined and declared; (b) Any such Order in Council may comprise, in favour of such otIicers and servants, the whole of the respective benefits conferred by this Act on officers of the Public Service, or if deemed expedient may be limited to assurance benefit and annuity benefit or annuity benefit or annuity benefit and incapacity allowance benefit, or more than one but not all of these benefits; (c) Such Order in Council shall provide that such' officers and servants shall not be compulsorily required to become contributors but may become voluntary contributors upon the terms and conditions prescribed in section thirteen of this Act in respect of officers who were thirty years of age or over on the first day of January, one thousapd nine hundred and thirteen, and who did not elect to become contributors within the time then allowed by the said section thirteen; (d) By any such Order in Council such officers and servants may be permitted to contribute to the Fund as from the first day of January, one thousand nine hundred and twenty-seven;

(e) Any such Order in Council may be rescinded or amended by a subsequent Order in Council, but the rescission or amendment of any such Order shall not be construed so as to affect or prejudice the rights of any person who became a contributor prior to such roscission or amendment. (2.) Any Order in Council made under this section shall, upon publication in the Gazette, have the same effect as if it were enact3d in this Act, and shall be judicially noticed." 4. In the first paragraph of subsection one of Amendment section four of the Principal Act, after the words "by of s. 4. the contributors" the words "in accordance with the regulations" are inserted. The fourth paragraph of the said subsection is repealed. 5. After section four of the Principal Act the following sections are inserted:- " [4A.] Any of the following acts or events shall Casual. cause a casual vacancy in the office of member of the vacancIes. Board, namely- (i.) Death or insanity, or dismissal from the Public Service; (ii.) Failure without the leave of the Board to attend four or more consecutive ordinary meetings of the Board extending over a period of two months; (iii.) Resignation by notice in writing signed by the member and posted or delivered to the Chairman of the Board, or, if there is no such Chairman, then to the Manager. [4B.] Any casual vacancy in the Board shall be Filling up filled as it occurs by the appointment or election of vacancies. another member as follows :- (a) In the case of a Government representative, by the appointment of another member by the Governor in Council; (b) In the case of a contributors' representative, by the election of another member in the prescribed manner.

No. 5, The member so appointed or elected to fill a casual vacancy shall hold office for the balance of the period for which his predecessor would have held office had no vacancy arisen. Subject to the regulations for the time being in force relating to a quorum, the powers of the Board shall not be affected by any diminution in the number of its members or by any vacancy in the office of member. Amendment 6. The following amendments are made in section of So 9. nine of the Principal Act;- In the second paragraph of subsection t:Q.ree, the word "voluntary" is repealed, and after the words "under this Act" the words "and also in the case· of certain officers who are contributors on the first day of January, one thousand nine hundred and twenty-seven (or who after that date become contributors under section thirteen of this Act), and who OJ;l the thirtieth day of June, one thousand nine hundred and thirteen, had completed one year or upwards of continuous service but who had not completed fifteen years of continuous service and had not therefore any accrued right of gratuity for meritorious services, such sums of money as the Public Service Commissioner shall determine to have accrued on the last-mentioned date as and by way of a proportion of gratuity for meritor- ious services to such officers, taking into consideration the length of continuous service on that date of each such officer and the rate of salary payable to him on that date" are inserted; also the words "all such gratuities shall be paid to them respectively by the Board when such gratuities become due" are repealed and the words "all such gratuities or proportions thereof as aforesaid shall be paid to them respectively by the Board when the same become due" are inserted in lieu thereof; also in the first proviso, after the words "the amount of such gratuities" the words "and of any sums as and by way of proportion of gratuity as aforesaid" are inserted.

In the second proviso of subsection three, after the words "such gratuity," where those words twice occur, the words" or proportion of gratuity as afore- said" are inserted. The operation of the amendments made in this subsection shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. 7. After the first paragraph of section ten of the Amendment Principal Act the following pluagraph is inserted : - of s. 10. "During a period of ten years, commencing on the first day of July, one thous~ md nine hundred and twenty-seven, the moneys to the credit of the Fund shall be credited with interest at the rate of five pounds per centum per annum in accordance with the monthly balance; and during that period the Consolidated Revenue is hereby charged with the payment of the said interest at the rate aforesaid." At the beginning of the second paragraph of the said section the word "Thereafter" is inserted. 8. The following provision is added to subsection Amendment one of section eleven of the Principal Act :_ of s. 1l. " The surrender value of assurance shall b3 such an amount as may be determined by the Actuary and approved by the Board. Th~ surrender value of annuity shall consist of a refund of the amounts contributed for annuity, with interest at the rate of three pounds per centum per annum (calculated at simple interest) up to the date when the contribution for annuity ceased. There shall not be any surrender value of incapacity allowance unless or until prescribed." The operation of this provision shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. 9. The following amendments are made in section Amendment twelve of the Principal Act:- of g. 12. (1.) (i.) In subsection one, after the words" Subject to this Act" the words" and save as herein provided" are inserted; also after the words "unit of assurance" the words "(payable either (i.) at death or (ii.) at age sixty-five or death prior to age sixty-five)" are inserted. No. 5, The operation of the amendments in this paragra.ph shall, subject to this Act, be deemed to have taken effect as from the first day of January, one thousand nine huncired and twenty-seven. (ii.) In paragraph (c) and paragraph (d) of the said subsection, after the words" this Act" the words" and before the first day of November, one thousand nine hundred and twenty-seven" are respectively inserted. (iii.) After the said paragraph (d) the proviso is repealed and the following provisions are inserted in lieu thereof:- " and (e) Every person who on the first day of Novem- ber, one thousand nine hundred and twenty- s€'ven, is an officer of the Public Service on probation or on or after the first day of November, one thousand nine hundred and twenty-seven, becomes an officer of the Public Service, whether on probation or otherwise, and who in any case is of the age of fifteen years or over; and (f) Every person who on the first day of Novem- ber, one thousand nine hundred and twenty- seven, is an officer of the Public Service on probation or on or after the first day of November, one thousand nine hundred and twenty-seven, becomes an officer of the Public Service, whether on probation or otherwise, and who in any case is not of the age of fifteen years, but subsequently while an officer attains that age, on attaining that age: Provided, however, that a female officer shall not be compelled to contribute for assurance." (2.) In subMction two, the words" exempted from contributing for assurance" are repealed; the words "a salary of two hundred pounds per annum" are repealed and the words "being a male a salary of two hundred pounds per annum, or being a female a salary of one hundred and sixty pounds per annum" are inserted. in lieu thereof; also the words "exempted as aforesaid" are repealed. The proviso to the said subsection is repealed.
PUBLIC SERVICE. ]927. Public Service Superanmtation, Etc., .Act. (3.) The following subsection is inserted after sub- section two ;- I "(2A.) Notwithstanding the provisions of sub- sections one and two hereof, the Board may in any case, where in their opinion the circumstances warrant such action, grant exemption either wholly or in part from or postpone the liability to so contribute, fmd such exemption or postponement may be either for a specified time or without limit of time." (4.) Subsection three is repealed and the following' subsfctions are inserted in lieu thereof:- " (3.) A compulsory contributor under this section may at any time voluntarily contribute for further- units as follows :-Of assurance and annuity, six further units of each; of annuity only, six further units; of incapacity allowance (if a male contributor), in conjunc- tion with a unit of annuity already held or then taken up, one further unit: Provided that the total number of units of assur- ance held by such contributor shall not exceed eight, and the total number of units of annuity shall not exceed eight; and that the total number of units of incapacity allowance shall not exceed three in the case of males or two in the case of females." The operation of the provisions of this subsection shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty- seven. " (3A.) Any compulsory contributor who on the first· day of January, one thousand nine hundred and twenty- seven, contributes for one or more units of assurance payable at death, may within two years thereafter or such further time as the Board may deem fit, either generally or in any specific case, apply to the Board to convert such units of assurance into units of assur- ance payable at age sixty-five or death prior to age sixty-five. The Board may allow such conversion upon such terms and conditions as may be determined by the Actuary and approved by the Board." (5.) The following provision is added to subsection four :- "This subsection shall be deemed to have applied and to apply to any officer who after the first day of January, one thousand nine hundred and thirteen~ 12033

No. 5, tecame or becomes a contributor: Provided that any contributor who has assured his life in a sum of not less than two hundred pounds and who has assigned his. policy of assurance to the Treasurer or other Minister of the Crown charged for the time being with the adminis- tration of *" The Workers' Homes Acts, 1919 to 1925," may in the discretion of the Board be exempted from contribution for assurance to the extent of one unit of assurance for each complete two hundred pounds of assurance provided for under such policy." The operation of this provision shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. Amendment 10. The following amendments are made in section of s. 13. thirteen of the Principal Act:- (1.) After the second paragraph of subsection one the following paragraph is inserted :- Schedule, Table I. or Table Ill. "Notwithstanding that any such officer did not, within the time allowed by this subsection, become a contributor, the Board may upon the application of such officer at any time permit such officer to become a contributor for at least one unit or at any future time for any number of units or half units in excess of the interest originally taken, but not exceeding a total of eight units of assurance and annuity, or of annuity only, but not of assurance only, and being a male for not more than three units of incapacity allowance., or being a female for not more than two units of incapacity allowance, or, if only one unit of incapacity 8Jlowance is originally taken, at any time for additional units or an additional unit of incapacity allowance not exceeding two in the case of males or one in the case of females. Contributions for such units of assurance annuity and incapacity allowance shall be at the rates prescribed in Table 1. or Table Ill. of the Schedule to this Act, as the case may require. The provisions of subsection two of section nine of this Act shall not apply to such contributors, but the provisions of subsection three of the said section shall apply." (2.) In the last paragraph of subSEction two, the words "an amount as annuity equivalent to the in- capacity allowance" are repealed and the words " rE'ceive ... 10 Geo. V. No. 7 and 13 GeD. V. The operation of the amendments to section thirteen of the Principal Act contained in subsections one and two of this section shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. (3.) After the said subsection two the following subsection is inserted :- "(2A.) (i.) Any officer who became H, contributor under subsection one or subsection two hereof may, upon application to the Board and with the approval of the Board, 8Jt :::my time contribute for additional units of assurance and annuity or annuity only, but not assurance only, in excess of the units then held by him, but so that the total number of units ot a,ssurance shall not exceed eight and the total number of units of annuity shall not exceed eight. Such contributor may also contribute for additional units or an additional unit of incapacity allowance but so that the total number of units of incapacity allowance shall not exceed three in the case of males or two in the case of females. Contributions for such additional units of assurance, annuity, and incapacity allowance shall be at the rates prescribed in Table 1. or Table Ill. of the Schedule to this Act, as the Schedule. case may require." in~ le 1.01' The operation of this paragraph of this subsection shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. " (ii.) Any such contributor who on the first day of January, one thousand nine hundred and twenty-seven, contributes for one or more units of assuranC3 payable at death may, within two ye~ trs thereafter or such further time as the Board may deem fit, either generally or in any specific case, apply to the Board to convert sucb units of assurance into units of assurance payable at age sixty-five or death prior to age sixty-five. The Boa,rd may allow such conversion upon such terms and conditions as may be determined by the Actuary and approved by the Board."

The following provision is added to subsection <of s. 16. one of section sixteen of the Principal Act :-" Any contributor who obtains such consent shall be entit1ed to the surrender value of his whole interest in the Fund, if he has contributed for at lea.st one full year, or to the surrender value of his annuity only if he has not contributed for one full year, but any gratuity or pro- portion thereof which would otherwise have been payable to such contributor under subsection three of section nine of this Act shall cease to be a charge against the annual appropriation of five thousand pounds referred to in that subsection, and such contributor shall cease to have any right or title to such gratuity or proportion thereof in so far as it h9 pa.yable from the Fund." The operation of this provision shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. o A f m s. en1d7m. ent seven 1 t 2 e . enTohfe thfoellPowriinncgipparloAvicsit. o:D-s are added to section ~ 'Provided that if for any reason the amount payable by a contributor under this Act in respect of any month was not deducted from his salary as and when it was payable, such amount may, in such manner as the manager may direct, be deducted (by way of additional deduction) from his salary in any succeeding month or months: Provided also that the manEl,ger may recover amounts payable under this Act in any~ court of competent jurisdiction. In any case where the contributions of a con- tributor are in arrear to the extent limited by the regulations, whether in amount so limited or for any time so limited, the Board mq.y in its discretion with- draw from such contributor the right to contribute to the Fund, and thereupon sh3,1l pay to him the surrender value (if any) to which he may be entitled after deducting therefrom the amount owing as arrears of contribution, together with such interest as the contributions would have borne under section ten of this Act had they been duly paid." Amendment 13. In the first paragraph of section eighteen of of s. IS. the PrincipaJ Act, the words "such amount, by way of surrender value of such officer's whole interest in the

Fund, as is determined by the Actu3.ry and approved by the Board," !lre repealed, and the words "the surrender value of his whole interest in the Fund and to no further or other benefit under this Act" are inserted in lieu thereof. The following proviso is inserted after the said first paragraph of the said section :- "Provided that a contributor who has not con- tributed for one full year shall be entitled to the surrender value of his annuity only." In the second paragraph of section eighteen (being originally the first proviso in the said section), the word " further" is inserted after the word " provided"; and the words "such contributor" are repealed and the words "any contributor (whether he has contributed for one full year or not)" are inserted in lieu thereof. The operation of the amendments in this section shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty- seven. 14. Section nineteen of the Principal Act is repealed. Repeal of s. 19. 15. Section twenty of the Principal Act is repealed and the following section is inserted in lieu thereof :- "[20.] On the death of a contributor (whether such Payment at contributor became a contributor on or before or after death. the first day of J~muary, ono thousand nine hundred and twenty-seven) the legal representative of such contributor shall, save as is hereinafter provided, be entitled to receive- (a) The sum of two hundred pounds for each unit of assurance for which such contributor has contributed (with such additional amounts, if any, by way of bonuses as may from tiVle to time be declared); and (b) The amount of annuity (if any) then due and owing in respect of annuity contributed for by such contributor; and (c) Whether such contributor, hlwing contributed for an annuity, has become an annuitant or not, the amount representing the sum, if any, by which the surrender value of the annuity under this Act exceeds the total amount of

No. 5, annuity actually received by such contributor (including in such total amount any sum payable under paragraph (b) hereof); and . (d) The amount of incapacity allowance (if any) then due and owing in respect of incapacity allo-\-yance contributed for by such contributor ; and (e) Any amount payable in respect of gratuity: Provided that at the death of a male contributor leaving a widow, or a widow and child or children, or a child or children, the Board may, if deemed to be necessary or to be in the interests of such persons or any of them, in lieu of making payment to the legal representative of the contributor, make payment to such persons or any of them of the total sum mentioned under the last preceding paragraphs (a) to (e) inclusive, or sub- stitute for such total sum an annuity to the value of the same (as determined by the Actuary) to be payable to or amongst or on behalf of such person or persons as the Board may fix and direct, and if more than one, then in such proportions as the Board may fix and direct; or the Board may substitute such other method of payment to such person or persons as may be deemed to be necessary or to be in the interests of such person or persons or any of them." Amendment 16. The following amendments are made in section of s. 21. twenty-one of the Principal Act : - (1.) In paragraph (ii.), after the word "annum" the words" (with such additional amounts, if any, by way of bonuses as may from time to time be declared)" are inserted; also after the word" monthly" the wordf' " or at shorter intervals, if so prescribed," are inserted. In the proviso to the said paragraph (ii.) the word " retired" is inserted before the word "contributor," where it first occurs. (2.) In paragraph (iiL), the words "upon retire- ment" are repealed; also after the word "annum" the words" (with such additional amounts, if any, by way of bonuses as may from time to time be declared)" are inserted; also after the word" monthly" the words " or at shorter intervals, if so prescribed," are inserted.

In paragraph (iv.), the words "upon retire- ment" are repealed; and after the word " annum" the words" (with such additional amounts, if any, by way of bonuses as may from time to time be declared)" are inserted; also, after the word "monthly" the words "or at shorter intervals, if so prescribed," are inserted. (4.) After paragraph (iv.) the following provision is inserted:- ," The provisions of *"The Pensions Act oJ 1891" shall not apply in respect of any contributor referred to in paragraphs (iii.) and (iv.) of this section." The operation of these amendments to section twenty-one of the Principal Act shall be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty-seven. 17. In section twenty-two of the Principal Act, Amendment before the words " of an annuity" the words " of assur- of B. 22. ance or " are inserted; also after the word " assurance," where it twice occurs, the words "or for any variation of benefits" are respectively inserted; also after the words "or annuity" the words "or variation of benefits" are inserted. 18. After the third paragraph of section twenty- Amendment four of the Principal Act the following paragraph is ofs. 24. inserted :- " Notwithstanding anything in this section, it shall be lawful under such conditions as the Board may deter- mine for a contributor who is the purchaser of a home under t" The Workers' Homes Acts, 1919 to 1925," to assign to the Treasurer or other Minister of the Crown charged for the time being with the administration of the said Acts an amount sufficient to pay to such Minister in the event of the death of such contributor the full amount of the unpaid purchase money and other moneys secured by the contract of sale and the said Acts, and on the death of such contributor the Board shall, notwithstanding anything contained 'in the provisions of section twenty of this Act, pay to such Minister the amount so assigned." .. 55 Vie. After section twenty-four of the Principal Act the following section is inserted:- "[24A.] (1.) Any moneys payable under this Act which have not been claimed within six months from the date (whether before or after the first day of November, one thousand nine hundred and twenty-seven) on which such moneys have or may become payable, shall be placed to the credit of an account to be called the " Unclaimed Moneys Account." (2.) At any time within six years after any such moneys have been placed to the credit of such account the Board may, on proof to their satisfaction that any contributor or other person is entitled to any such moneys, direct payment thereof to him. (3.) All such moneys in respect of which a claim is not established within six years after having been placed to the credit of such account shall form part of the Fund, and the contributor or other person concerned shall cease to have any right or title to such moneys: Provided that the Board may allow and pay any claim after such' period of six years has expired upon being satisfied that special reasons exist for the allowance of the claim. (4.) If any of such moneys paid to a claimant under this section are afterwards claimed by any other person, the Board shall not be responsible for the payment of the same, but such person may have recourse against the claimant to whom the Board has paid such moneys." Annual report. 20. After section twenty-five of the Principal Act the following section is inserted :- "[25A.] The Board sh9,1l, t'JS soon as practicable after the thirtieth day of June in each year, submit to the Minister for presentation to Parliament a report dealing Virith the general administration and working of this Act for the twelve months ending on the said thirtieth day of ,June. Such report shall contain a true account of the income and expenditure of the Fund during such period, together with a bala,nce-sheet duly certified to by the Auditor-General. A copy of such report shall be laid before Parliament forthVirith, if Parliament is then sitting, or, if Parliament is not sitting, then within fourteen days after the commencement of the next session of Parliament."

In section twenty-eight of the Principal Act, Amendment .after the words "Governor in Counoil" the words "upon of s. 28. the recommendation of the Board" are inserted. Paragraph (vi.) of the said section is repealed and the following paragraph is inserted in lieu thereof :-. "(v-i.) Upon the advice of the Actuary, or in accordance with tables provided by him from time to time prescribing (and, if at any time deemed to be necessary, altering) the rates of contributi.ons and the amounts of assurances, annuities, and incapacity allowances, and of the surrender values of the same or any of t.hem payable or that may become payable under this Act by and to contributors respectively, and whether any such persons have been or are presently or may thereafter become contributors." 22. (1.) In the Sohedule to the Principal Act, under Amendment the heading" Ta.ble lI.-Males," the words- of Schedule. " An Assurance of £200 at Death." " An Annuity of £50 per Annum, commencing at Age 70." " An Incapacity Allowance, up to Age 70, of £50 per annum." are repealed and the words :- "An assurance of £200, with such bonuses, if any, as may from time to time be declared, payable at death." "An annuity of £50 per annum, with such bonuses, if any, as may from time to time be declared, commencing at age 70." " An incapacity allowa,nce, up to f'"ge 70, of £50 per annum, with such bonuses, if any, as may from time to time bo declared." are inserted in lieu thereof. Mter the word" Incapacity" in the heading of the fourth column of the said table the word " Allowance" is inserted.

The operation of the amendments made in the Schedule to the Principal Act by this section. shall, subject to this Act, be deemed to have taken effect as from the first day of January, one thousand nine hundred and twenty.seven. All contracts or variations of contracts of assurance, annuity, or incapacity, made and entered"into between the Board and any contributor, and all pay- ments made by the Board (whether such payments were made on the death of a contributor or otherwise) prior to the passing of "The Public 8ervice Superannuation Act Amendment Act of 1927," and all things and matters done and effected by the Board prior to such date, are hereby a.pproved, ratified, and confirmed.
