613 Quunsfaubr ANNO SEPTIMO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 59 of 1968 An Act to Amend The Public Service Superannuation Acts, 1958 to 1966 in certain particulars [ASSENTED TO 24TH DECEMBER, 1968] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- l. Short title and citation . (I) This Act may be cited as the Public Service Superannuation Act Amendment Act 1968. (2) The Public Service Superannuation Act of 1958 as subsequently amended from time to time is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Public Service Superannuation Act1958-1968. 2. Operation of Act. (I) Except as in this Act otherwise provided, this Act shall come into operation on the thirty-first day of December, one thousand nine hundred and sixty-eight, which day is in this section called the " said date ".
614 Public Service Superannuation Act Amendment Act 1968, No. 59 (2) Annuity benefit, incapacity benefit, assurance benefit or additional assurance benefit payable under the Principal Act immediately before the said date in respect of any contributor who attained the age of sixty-five years or retired by reason of incapacity before the said date or in respect of any widow or child, shall on the said date and thereafter while it continues to be payable be paid under the Principal Act as amended by this Act. 3. Amendment of s. 2 . Section 2 of the Principal Act is amended by inserting after the words " Division I//-Scale of Contributions by Officers; " the words " Division /IIA-Reserve Units of Benefits; ". 4. Amendment of s. 4 . Section 4 of the Principal Act is amended- (a) by, in paragraph (a) of the definition " officer ", inserting after the words " any temporary employee ", the words " (other than a married woman who is such an employee) "; and (b) by in the definition " Surrender Value (i) in paragraph (b), inserting after the words " A unit " the words " (including a reserve unit) "; and (ii) in paragraph (c), inserting after the words " A unit " the words " (including a reserve unit) ". 5. Amendment of s. 18 . (I) Section 18 of the Principal Act is amended by in subsection (5) omitting the words " four and one-half " and inserting in their stead the word " five ". (2) This section shall come into operation on the first day of January, one thousand nine hundred and sixty-nine. 6. Amendment of s. 24 . Section 24 of the Principal Act is amended- (a) by omitting the words " thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars "; and (b) by omitting the proviso. 7. Amendment of s. 25. Section 25 of the Principal Act is amended- (a) by inserting after the words "At all times units " the words (including units to which Division 111A applies) "; and (b) by omitting the words " and Part V " and inserting in their stead the words ", subsection (3) of section 27A, Part V and Part VA ". 8. New Division IIIA . The Principal Act is amended by inserting after section 27 the following heading and sections- " Division I/IA-Reserve Units of Benefits 27A. Contribution for Reserve Units. (I) A contributor who is contributing to the Fund for units of benefits to the number thereof specified in the scale contained in Schedule I to this Act opposite to the salary group within which his or her salary falls, may, from time to time, elect to contribute to the Fund for one or more reserve units of benefits in accordance with this Division.
Public Service Superannuation Act Amendment Act 1968, No. 59 615 (2) The number of reserve units respectively of annuity benefit, incapacity benefit and, in the case of a male contributor, assurance benefit for which a contributor may elect to contribute at any time pursuant to subsection (1) of this section together with the number of reserve units in respect of which he or she has already made an election under that subsection shall not exceed twelve. (3) An officer- (a) who has attained the age of forty years on the first day of April, one thousand nine hundred and fifty-nine to whom Part V applies; or (b) who is a contributor to the Fund under Part VA, may elect to contribute pursuant to this Division for reserve units of annuity benefit only. (4) Contributions for a reserve unit of benefit- (a) shall be in accordance with, in the case of a male officer, the table of contributions contained in Part I of Schedule II of this Act and, in the case of a female officer, the table of contributions contained in Part II of that Schedule; and (b) shall be payable as from the first day of the periodical interval at which contributions to the Fund are prescribed to be made next after the date when the Board accepts the contributor's election to contribute for that reserve unit of benefit. (5) Unless exempted by the Board therefrom an officer shall, before at any time contributing or increasing the amount of his or her contribution for reserve units of benefits under this Division, be medically examined by a medical practitioner. (6) An officer shall not at any time increase under this Division the amount of his or her contributions to the Fund if after considering the report of the medical practitioner, the Board is not satisfied that the health and physical condition of such officer are such as would justify his or her being then accepted as a contributor. 27B. When reserve units become ordinary units of benefits. Where a contributor- (a) who is contributing for one or more reserve units of benefits pursuant to this Division; and (b) who becomes required or entitled to contribute for additional units of benefits under the provisions of this Act (other than this Division), does not increase the amount of his or her contributions to the Fund by such sum as is sufficient to provide, in accordance with the appropriate table of contributions contained in Schedule II of this Act applicable to the particular case, the additional units of benefits, such number of reserve units of benefits up to but
616 Public Service Superannuation Act Amendment Act 1968, No. 59 not exceeding the number of such units for which he or she is contributing pursuant to this Division as is equal to the difference between- (c) the number of units of benefits specified in the scale contained in. Schedule f to this Act opposite to the salary group within which the contributor's salary falls: and (d) the number thereof (other than reserve units of benefits) for which such officer is contributing. shall cease to be reserve units of benefits to which this Division applies and shall become units of benefits for which the contributor is contributing under the provisions of this Act (other than this Division) the contribution for which shall continue to be the contribution the contributo,r was making to the Fund therefor immediately before the units of benefits so ceased to he reserve units.". 9. New ss . 27C and 27D. The Principal Act is amended by inserting after section 27n as inserted by this Act the following sections- " 27C. Contributor may discontinue contribution for reserve units. (1) Subject to subsection (2) of this section a contributor who is contributing for one or more reserve units of benefit may, subject to section 25 of this Act, elect to discontinue his or her contributions in respect of any or all of those units, in which case he or she shall be paid from the Fund the surrender value, if any. of the reserve units of annuity benefit and, in the case of a male contributor, assurance benefit in respect of which he or she has so elected to discontinue his or her contributions. (2) A contributor shall not make an election pursuant to subsection (I) of this section if the effect of that election is that the contributor thereafter contributes for a number of units (including reserve units) of annuity benefit that is less than the number of units (including reserve units) respectively of incapacity benefit or assurance benefit for which he or she then contributes. 27D. Payment of lump sum on ceasing to contribute . (1) Where a contributor who is contributing for one or more reserve units of benefits pursuant to this Division ceases to be it contributor there shall be paid to him or her, or, if he or she has died. his or her personal representative or other person approved by the Board from the Fund the sum prescribed by this section in respect of such number of the reserve units of benefits for which he or she was contributing to the Fund pursuant to this Division at the time when he or she ceased to he a contributor as is equal to the difference between- (a) the number of units of benefits (including reserve units of benefits) for which the contributor was contributing at that time, and
Public Service Superannuation Act Amendment Act 1968, No. 59 617 (b) the number thereof specified in the scale contained..in Schedule I to this Act opposite to the salary group within which the contributor's salary fell at that time. (2) The sum to be paid in respect of the number of reserve units of benefits ascertained in accordance with subsection (1) of this section shall be equal to- (a) in the case of a contributor who ceased to be a contributor on account of death or retirement by reason of incapacity or voluntary resignation pursuant to section 77A of this Act or attainment of the age of sixty-five years, such amount as is determined by the actuary . appointed pursuant to this Act and approved by the Board: (b) in any case to which paragraph' (a) of this subsection does not apply, the surrender value, if any, of such number of the reserve units of annuity benefit and, in the case of a male contributor, assurance benefit in respect of which he or she was contributing immediately before he or she ceased to be a contributor. I (3) Upon payment of the sum, specified in subsection (2) of this section all reserve units of benefits ascertained in accordance with subsection (1) of this section shall be deemed to have been commuted by the contributor. 10. Amendment of s. 30. Section 30 of the Principal Act is amended- (a) by in subsection (I) omitting the word " ninety-six " and inserting in its stead the words " one hundred (b) by in subsection (2)- (i) omitting the words " thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars ": and (ii) omitting the proviso: and (c) by in subsection (3)- (i) omitting the words " thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars ": and (ii) omitting the proviso. 11. Amendment of s. 32. Section 32 of the Principal Act is amended- (a) by in subsection (I) omitting the word " ninety-six °' and inserting in its stead the words " one hundred (b) by in subsection (2)- (i) inserting after the words " an officer the unit ", the words (including a reserve unit) ": (ii) omitting the words " thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars ": and (iii) omitting the proviso. 12. Amendment of s. 34. Section 34 of the Principal Act is amended by in subsection (I) omitting the words " sixty dollars " and inserting in their stead the words " sixty-two dollars fifty cents ".

Section 36 of the Principal Act is amended- (a) by in paragraph (a) of subsection (1) omitting the words " one hundred and four " and inserting in their stead the words " one hundred and fifty-six ": and (b) by in paragraph (b) of that subsection omitting the words " two hundred and eight " and inserting in their stead the words " three hundred and twelve ". 14. Repea l of s. 48. Section 48 of the Principal Act is repealed. 15. Amendment of s. 55. Section 55 of the Principal Act is amended- (a) by omitting the words " thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars "; and (b) by omitting the proviso. 16. Amendment of s. 56. Section 56 of the Principal Act is amended- (a) by omitting the words thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars "; and (b) by omitting the proviso. 17. Amendment of s. 60. Section 60 of the Principal Act is amended by omitting subsection (2) and inserting in its stead the following subsection:- " (2) Save the persons specified in subsection (3) of this section, every person to whom this subsection applies shall be paid from the Fund an additional amount at the rate of four hundred and seventy-five dollars per annum on and from the thirty-first day of December, one thousand nine hundred and sixty-eight, and thereafter so long as annuity benefit under the repealed Acts continues to be payable to him or her.". 18. Amendment of s. 61. Section 61 of the Principal Act is amended- (a) by omitting subsection (2) and inserting in its stead the following subsection:- " (2) Save the persons specified in subsection (3) of this section. every person to whom this subsection applies shall on and from the thirty-first day of December, one thousand nine hundred and sixty-eight, and thereafter so long as incapacity allowance under the repealed Acts continues to be payable to him or her be paid from the Fund an additional amount at the rate of- (a) in the case of a female person having such right and interest in respect of incapacity allowance at the rate of eighty dollars per annum per unit, three hundred and eighty dollars per annum; and (b) in any other case four hundred and seventy-five dollars per annum."; (b) by omitting the second and last subparagraph of paragraph (b) of subsection (4) and inserting in its stead the following subparagraph:- " For the purpose of so applying that section to the case of a person who attains the age of sixty-five years on or after the thirty-first day of December, one thousand nine hundred and
Public Service Superannuation Act Amendment Act 1968, No. 59 619 sixty-eight, any reference in that section to the said thirty-first day of December shall be read as referring to the date on, which he attains the age of sixty-five years.". 19. Amendment of s. 64 .' Section 64 of the Principal Act is amended by in subsection (2) omitting the second and last paragraph and inserting in its stead the following paragraph:- " For the purpose of so applying that section to the case of such an officer or person who is so retired on or after the thirty-first day of December, one thousand nine hundred and sixty-eight any reference in that section to the said thirty-first day of December shall be read as referring to the date of his retiremene.". 20. Amendment of s. 65. Section 65 of the Principal Act is amended by in subsection (2) omitting the second and last paragraph thereof and inserting in its stead the following paragraph:- " For the purpose of so applying that section to the case of an officer or other person who attains the age of sixty-five years on or after the thirty-first day of December, one thousand nine hundred and sixty-eight, any reference in that section to the said thirty-first day of December shall be read as referring to the date on which that officer or other person attained the age of sixty-five years.". 21. Amendment of s. 68. Section 68 of the Principal Act is amended by in subsection (1) omitting the words " four hundred " and inserting in their stead the words " four hundred and seventy-five ". 22. Amendment of s. 69 . Section 69 of the Principal Act is amended by omitting in subsection (4) the words " four hundred " and inserting in their stead the words " four hundred and seventy-five ". 23. Amendment of s. 71 . Section 71 of the Principal Act is amended by in paragraph (c) of subsection (5) omitting the words " thirty-three dollars sixty cents " and inserting in their stead the words " thirty-five dollars ". 24. Amendment of s. 76. Section 76 of the Principal Act is amended by in subsection (2) omitting the proviso and inserting in its stead the following proviso:- " Provided that the amount of the unit of annuity benefit or of incapacity benefit under this Act shall not by reason of this section be reduced to less than the rate of thirty-five dollars per annum.". 25. Amendment of s. 85. Section 85 of the Principal Act is amended by in subsection (I )- (a) omitting the words " three hundred and twenty " and inserting in their stead the words " three hundred and eighty "; and (b) omitting the words " four hundred " and inserting in their stead the words " four hundred and seventy-five ".
