Act No. 10, 1908.

A n Act to provide that certain deduct ions from superannuation a l lowances under the A c t No . 55 of 1899 shall, under certain circum­ stances , cease to be made ; and for purposes consequent thereon and incidental thereto .

BE t h e advice and consent of t h e Legis la t ive Counci l and Legis la t ive
it enac ted by the K i n g ' s Mos t Exce l len t Majesty , by a n d wi th
Assembly of N e w South Wales in Pa r l i amen t assembled, and by t h e
au thor i ty of t he same, as follows :—

1. This Ac t m a y be cited as the " Pub l i c Service (Superannua­

tion) Act , 1908 . "

2.     W h e r e —

(a) any person who has been employed as an officer in the public
service is at t h e c o m m e n c e m e n t of this A c t in t h e receipt of
a supe rannua t ion a l lowance unde r and by v i r tue of section
two of the A c t No . 55 of 1 8 9 9 ; and

(b)

in pu r suance of t h e said section t he supe rannua t ion al lowance to which he would have been ent i t led if he had ret i red from the service u n d e r t h e provisions of section for ty- three of t h e Civil Service Ac t of 1884 has been diminished by an a m o u n t certified by the ac tuar ies appoin ted unde r t h a t A c t to be equivalent to t h e a n n u i t y t e rminab le on his dea th in to which

t h e a m o u n t of a n y p a y m e n t s , gra tu i t ies , and refunds received
by h i m on his r e t i r e m e n t f rom t h e service is conver t ib le ; and
(c) t he s u m of the a m o u n t s by which such a l lowance has from
the supe rannua t ion al lowance payable to t h e said person shall there­
upon be deemed to have ceased to he d iminished as aforesaid.
