REGULATION UNDER THE PUBLIC SERVICE ACT 1922*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922, hereby makes, subject to the approval of the Governor-General, the following Regulation.

AMENDMENT OF THE PUBLIC SERVICE REGULATIONS*

After Part VIIa of the Public Service Regulations the following Part is inserted:

“ PART VIIb—TRANSFER OR PROMOTION OF CERTAIN PERSONS EMPLOYED BY LEGAL AID COMMISSIONS OF STATES OR TERRITORIES TO OFFICES IN AUSTRALIAN PUBLIC SERVICE

Modification of Act

“ 120j. In the application of section 50 of the Act by virtue of section 23 of the Commonwealth Legal Aid Commission Act 1977, the first-mentioned section is modified as follows:

(a) omit sub-section (2) and substitute the following subsection:

‘ (2) Where it is proposed to transfer a person who is an eligible person for the purposes of Part IV of the Commonwealth Legal Aid Commission Act 1977 to an office in the Australian Public Service under the provisions that are the applied provisions of the Public Service Act 1922 within the meaning of that Part, the transfer shall be subject to the approval of the Board.’; and

(b) omit from sub-section (2a)’ the Permanent Head of the Department from which the officer is to be transferred and, upon being so notified, the last-mentioned Permanent Head shall forthwith release the officer ’ and substitute ‘ the person whose transfer has been approved ’.

Application of Regulations to eligible persons

“ 120k. These Regulations have effect in relation to a person who is an eligible person for the purposes of Part IV of the Commonwealth Legal Aid Commission Act 1977 as if each reference in regulations 97 and 97d and Part VII to an officer included, so far as is applicable, a reference to such a person.”.
