Public Service Regulations2 (Amendment)

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Commencement

1. These Regulations shall come into operation on 11 December 1981.

Where certain allowances are payable under determinations under section 82d of the Act, certain allowances are not payable under these Regulations

2. Regulation 79 of the Public Service Regulations is amended by adding at the end thereof the following sub-regulations:

“(3) Where a determination made by the Board under section 82d of the Act provides for the payment to a person of an allowance in respect of accommodation in which he or his family resides, an allowance is not payable under regulation 97 to the person in respect of that accommodation.

“(4) Where a determination made by the Board under section 82d of the Act provides for the payment to a person of an allowance in respect of the sale or purchase of a dwelling house, an allowance is not payable under regulation 97d to the person in respect of that sale or purchase of that dwelling house.”.

Interpretation

3. Regulation 139 of the Public Service Regulations is amended by omitting from sub-regulation (3) all words and figures from and including “that would have been payable” and substituting “that, but for the Act, could not lawfully have been paid other than—

(a) an allowance payable under regulation 97b, 97c, 97e, 98aaa, 98a or 98ab;

(b) an allowance payable under Public Service Board Determination 1981/5 in respect of accommodation in which the officer or his family resides; or

(c) an allowance payable under Public Service Board Determination 1981/5 in respect of the sale or purchase of a dwelling house.”.

Payment of allowances to persons promoted or transferred

4. Regulation 176 of the Public Service Regulation is amended

(a) by omitting “97, 97d,”; and

(b) by omitting “and Public Service Board Determination 1981/3” and substituting”, Public Service Board Determination 1981/3 and Public Service Board Determination 1981/5”.
