REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1975.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1975, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations 

Creation and constitution of Joint Council.

1. Regulation 72b of the Public Service Regulations is amended by omitting sub-regulations (1) and (1a) and substituting the following sub-regulations:—

“ (1) There shall be a Joint Council, which shall be constituted by—

(a) a Chairman nominated by the Public Service Board;

(b) a representative of the Public Service Board nominated by that Board;

(c) 8 departmental representatives nominated by Permanent Heads, as requested by the Board; and

(d) 9 representatives of organizations of officers and employees nominated as follows:—

(i) 5 by the Council of Australian Government Employee Organizations, of whom 2 shall be representative of Second and Third Division officers and 3 of Fourth Division officers;

(ii) 2 by the Australian Council of Trade Unions;

(iii) one by the Australian Council of Salaried and Professional Associations; and

(iv) one by the Council of Professional Associations.

“ (1a) For the purposes of paragraph 1 (c), ‘Permanent Head’ includes a person who has the powers of, or exercisable by, a Permanent Head.”.

2. After regulation 72c of the Public Service Regulations, the following regulation is inserted:—

Powers of Deputy Chairman.

“ 72ca. (1) Where the Chairman is unable to attend, or is absent for a period from, a meeting of the Joint Council, the Deputy Chairman shall preside at that meeting, or shall preside at that meeting during that period of absence, as the case may be.

“ (2) In the event of the Chairman being unable to attend a meeting of the Joint Council, the organization of which the Deputy Chairman is a representative may nominate another person to be a representative of the organization at that meeting.”.

Meetings.

3. Regulation 72d of the Public Service Regulations is amended by omitting sub-regulation (2) and substituting the following sub-regulation:—

“ (2) At a meeting of the Council, 13 members of the Council—

(a) one of whom shall be the Chairman or Deputy Chairman of the Joint Council;

(b) one of whom shall be the representative of the Board;

(c) 5 of whom shall be representatives referred to in paragraph 72b (1) (c); and

(d) 6 of whom shall be representatives of organizations, shall form a quorum.”.

Functions of the Council.

4. Regulation 72e of the Public Service Regulations is amended by omitting sub-regulation (2) and substituting the following sub-regulation:—

“ (2) The Permanent Head of a Department, a person who has the powers of, or exercisable by, a Permanent Head, and an organization of officers or employees or officers and employees, may submit to the. Board any matter considered to be a matter of general interest in relation to the Public Service, and the Board shall refer any such matter to the Council.”.
