Public Service Regulations2 (Amendment)

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922,hereby makes, subject to the approval of the Governor-General, the following Regulations.

Grant of recreation leave to use accrued recreation leave credit

1. Regulation 50 of the Public Service Regulations is amended by omitting paragraphs (1) (a) and (b) and substituting the following paragraphs:

“(a) in the case of an officer—

(i) to whom sub-regulation 49 (1) or (2) applies;

(ii) serving in a prescribed isolated district within the meaning of regulation 49 to whom there accrues in that year a recreation leave credit equal to the sum of the period of his ordinary hours of duty during a period of 4 weeks and a period of 10 days; or

(iii) serving in a prescribed place overseas within the meaning of regulation 49,

3 years before that date; or

(b) in the case of any other officer—2 years before that date,”.

Circumstances in which recreation leave is deemed to have been granted by operation of law on 1 April

2. Regulation 50a of the Public Service Regulations is amended by omitting paragraphs (a) and (b) and substituting the following paragraphs:

“(a) in the case of an officer—

(i) to whom sub-regulation 49 (1) or (2) applies;

(ii) serving in a prescribed isolated district within the meaning of regulation 49 to whom there accrues in that year a recreation leave credit equal to the sum of the period of his ordinary hours of duty during a period of 4 weeks and a period of 10 days; or

(iii) serving in a prescribed place overseas within the meaning of regulation 49,

3 years before 1 January in that year; or

(b) in the case of any other officer—2 years before 1 January in that year,”.

Circumstances in which recreation leave is deemed to have been granted by operation of law where officer is already on leave for less than 4 weeks

3. Regulation 50b of the Public Service Regulations is amended by omitting paragraphs (a) and (b) and substituting the following paragraphs:

“(a) in the case of an officer—

(i) to whom sub-regulation 49 (1) or (2) applies;

(ii) serving in a prescribed isolated district within the meaning of regulation 49 to whom there accrues in that year a recreation leave credit equal to the sum of the period of his ordinary hours of duty during a period of 4 weeks and a period of 10 days; or

(iii) serving in a prescribed place overseas within the meaning of regulation 49,

3 years before 1 January in that year; or

(b) in the case of any other officer—2 years before 1 January in that year,”.

4. Regulation 50c of the Public Service Regulations is amended by omitting paragraphs (1) (a) and (b) and substituting the following paragraphs:

“(a) in the case of an officer—

(i) to whom sub-regulation 49 (1) or (2) applies;

(ii) serving in a prescribed isolated district within the meaning of regulation 49 to whom there accrues in that year a recreation leave credit equal to the sum of the period of his ordinary hours of duty during a period of 4 weeks and a period of 10 days; or

(iii) serving in a prescribed place overseas within the meaning of regulation 49,

3 years before 1 January in that year; or

(b) in the case of any other officer—2 years before 1 January in that year,”.

Application

5. The Public Service Regulations, as amended by these Regulations, apply to and in relation to a recreation leave credit that accrues after 1 January 1983.
