Public Service Regulations2 (Amendment)

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922 and pursuant to section 4 of the Acts Interpretation Act 1910,hereby makes, subject to the approval of the Governor-General, the following Regulations.

Commencement

1. These Regulations shall come into operation on 1 July 1986.

2. Regulations 121 to 124 (inclusive) of the Public Service Regulations are repealed and the following regulations substituted:

Principal relevant staff association in respect of employees

“121. For the purposes of paragraph 82 (2) (b) of the Act, in relation to employment in a particular capacity, the relevant staff organization that has, as members of the organization, the greatest number of persons who are—

(a) employed in that capacity in the Service; or

(b) officers holding offices in the Service, being offices of a classification that corresponds to that capacity.

is declared to be the principal relevant staff organization in relation to employment in that capacity.

Prescribed schemes

“122. Each of the following schemes, being a scheme for enabling persons to gain ability for the purpose of participating in the Australian work-force, is a prescribed scheme for the purposes of section 82ag of the Act, namely:

(a) each project for the creation of employment approved under section 4 of the Community Employment Act 1983;

(b) the program known as the National Employment Strategy for Aboriginals;

(c) the Commonwealth Work Experience Program, being a component of the program known as Jobstart;

(d) the program known as the Australian Traineeship System.”.

Employees to whom this Part applies

3. Regulation 165 of the Public Service Regulations is amended—

(a) by omitting from paragraph (b) “or” (last occurring); and

(b) by omitting paragraph (c) and substituting the following paragraphs:

“(c) an employee employed under sub-section 30 (8) of the Public Service and Statutory Authorities Amendment Act 1985, or under section 82ag of the Act, in or under the program known as the Australian Traineeship System; or

(d) an employee, employed under a scheme referred to in paragraph 122 (a), (b) or (c), who has been employed in a Department to perform duties under that scheme and who has been so employed for a period of less than one year.”.
