Public Service Regulations2 (Amendment)

THE PUBLIC SERVICE BOARD, acting pursuant to and in the exercise of the authority conferred upon it by the Public Service Act 1922,hereby makes, subject to the approval of the Governor-General, the following Regulations.

1. Regulation 37 of the Public Service Regulations is repealed and the following regulation substituted:

Benefits to officers

“37. (1) An officer shall not take, or seek to take, advantage of that officer’s functions in order to obtain a benefit for that officer or a body or person other than that officer.

“(2) Subject to sub-regulations (2), (3), (4), (5), (6) and (7), an officer employed in a Department shall not accept a benefit from any person or body concerned directly or indirectly with any matter connected with that officer’s functions without the approval in writing of the Secretary of that Department.

“(3) In approving under sub-regulation (2) the acceptance of a benefit, a Secretary may specify conditions subject to which the benefit may be accepted.

“(4) A Secretary may issue directions in accordance with which officers generally, or certain classes of officers, may accept benefits without the approval referred to in sub-regulation (2).

“(5) Directions issued under sub-regulation (4) may include conditions subject to which benefits may be accepted.

“(6) Conditions included under sub-regulation (5) may be conditions relating to the retention or disposal of gifts.

“(7) Directions issued under sub-regulation (4) shall be consistent with any guidelines issued by the Board concerning the acceptance of benefits without the approval referred to in sub-regulation (2).”.

2. Regulation 39 of the Public Service Regulations is repealed and the following regulation substituted:

Undue influence by officers

“39. (1) An officer shall not take, or seek to take, advantage of that officer’s functions in order to influence any person or body to enter into a financial or other arrangement with that officer or any other person or body.

“(2) An officer shall not confer an undue benefit, or enter, or seek to enter, into a financial or other arrangement, in order to influence another officer in the exercise of that other officer’s functions.”.

Repeal

3. Regulation 40 of the Public Service Regulations is repealed.
