Public Service Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Public Service Act 1922.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Public Service Regulations.

Creation and constitution of Joint Council

2. Regulation 72b of the Principal Regulations is amended:

(a) by omitting subregulation (1) and substituting the following subregulation:

“(1) There shall be a Joint Council, which shall be constituted by:

(a) a Chairperson nominated by the Secretary to the Department of Industrial Relations;

(b) a representative of that Department nominated by the Secretary to that Department;

(c) a representative of the Public Service Commissioner nominated by the Public Service Commissioner;

(d) 7 departmental representatives nominated by Secretaries, as requested by the Secretary to the Department of Industrial Relations; and

(e) 9 representatives of organisations of officers and employees nominated as follows:

(i) 8 by the Australian Council of Trade Unions; and

(ii) one by the Australian Council of Professional Associations.”; and

(b) by omitting from subregulation (4) “Board” (wherever occurring) and substituting “Secretary to the Department of Industrial Relations”.

Deputy Chairperson

3. Regulation 72c of the Principal Regulations is amended by omitting “Chairman” and substituting “Chairperson”.

Powers of Deputy Chairperson

4. Regulation 72ca of the Principal Regulations is amended by omitting from subregulations (1) and (2) “Chairman” (wherever occurring) and substituting “Chairperson”.

Meetings

5. Regulation 72d of the Principal Regulations is amended:

(a) by omitting from subregulation (1) “Board” and substituting “Secretary to the Department of Industrial Relations”; and

(b) by omitting subregulation (2) and substituting the following subregulation:

“(2) At a meeting of the Council, 13 members of the Council:

(a) one of whom shall be the Chairperson or the Deputy Chairperson of the Joint Council;

(b) one of whom shall be the representative of the Department of Industrial Relations;

(c) one of whom shall be the representative of the Public Service Commissioner;

(d) 4 of whom shall be the representatives referred to in paragraph 72b (1) (d);

(e) 6 of whom shall be representatives of organisations;

shall constitute a quorum.”.

Functions of the Council

6. Regulation 72e of the Principal Regulations is amended by omitting from subregulations (1) and (2) “Board” (wherever occurring) and substituting “Secretary to the Department of Industrial Relations”.

Secretary to the Joint Council

7. Regulation 72f of the Principal Regulations is amended by omitting “Board which” and substituting “Secretary to the Department of Industrial Relations who”.

Agenda

8. Regulation 72g of the Principal Regulations is amended by omitting “Chairman” and substituting “Chairperson”.

Inquiries by the Council

9. Regulation 72h of the Principal Regulations is amended by omitting “Board” and substituting “Secretary to the Department of Industrial Relations”.

Joint Council: allowances payable to certain members

10. Regulation 72q of the Principal Regulations is amended by omitting from the definition of “representative” in subregulation (1) “72b (1) (d)” and substituting “72b (1) (e)”.
