Public Service Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Public Service Act 1922.

Regulation 112 of the Public Service Regulations is amended by omitting paragraphs (b), (c) and(d) and substituting the following paragraphs:

“(b) where:

(i) a vacancy in an office in a Department is notified in the Gazette;

(ii) a promotion to the office would be appellable under section 50 of the Act;

(iii) the office is filled but again becomes vacant;

(iv) the classification, duties and location of the office and of the vacant office are the same;

the decision by the relevant Secretary to fill the office within 6 months after that notification is a prescribed circumstance;

(c) where:

(i) a vacancy in an office in a Department is notified in the Gazette;

(ii) a promotion to the office would be appellable under section 50 of the Act;

(iii) after that notification a vacancy occurs in another office in the Department;

(iv) the classification, duties and location of the offices mentioned in subparagraphs (i) and (iii) are the same;

the decision by the relevant Secretary to fill the office mentioned in subparagraph (iii) within 6months after that notification is a prescribed circumstance;

(d) where a vacant office in a Department has the classification of:

(i) Research Officer Grade 1;

(ii) Research Officer Grade 2;

(iii) Senior Research Officer Grade 1; or

(iv) Senior Research Officer Grade 2;

the decision by the relevant Secretary that the office be filled by an officer, unattached or otherwise, in the Department who has the classification of Graduate Administrative Assistant is a prescribed circumstance;

(e) where a vacant office in a Department has the classification of:

(i) Research Officer Grade 2;

(ii) Senior Research Officer Grade 1; or

(iii) Senior Research Officer Grade 2;

the decision by the relevant Secretary that the office be filled by an officer, unattached or otherwise, in the Department who has the classification of Research Officer Grade 1:

(iv) who held that classification as a result of an invitation to the public for applications for appointment as a Graduate Administrative Assistant (Graduate Economist); or

(v) who, immediately before promotion to the office of Research Officer Grade 1, had been an officer, unattached or otherwise, in that Department who had the classification of Cadet Economist, Cadet Agricultural Economist, Aboriginal Cadet Economist or Aboriginal Cadet Agricultural Economist;

is a prescribed circumstance;

(f) where a vacant office in the Australian Audit Office the duties of which are those of Auditor Grade 1 has the classification of Administrative Service Officer Class 4, the decision by the relevant Secretary that the office be filled by an officer in the Australian Audit Office who performs the duties of a Graduate Accountant and has the classification of Graduate Administrative Assistant is a prescribed circumstance;

(g) where a vacant office in the Defence Signals Directorate in the Department of Defence the duties of which are those of Defence Officer has the classification of:

(i) Administrative Service Officer Class 4;

(ii) Administrative Service Officer Class 5; or

(iii) Administrative Service Officer Class 6;

the decision by the relevant Secretary to fill the office is a prescribed circumstance.”,
