REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1950.*

T HE PUBLIC SERVICE BOARD appointed under the Public Service Act 1922-1950, in pursuance and exercise of the authority conferred upon it by the said Act, and subject to the approval of the Governor-General, hereby makes the following Regulations.

Amendments of the Public Service Regulations. 

Interpretation.

1. Regulation 3 of the Public Service Regulations is amended—

(a) by inserting before the definition of " the Act " the following definitions:—

" ' actual salary ' means salary inclusive of variations made under regulation 106a of these Regulations;

' standard salary ' means salary exclusive of variations made under regulation 106a of these Regulations ; " ; and

(b) by adding at the end thereof the following sub-regulation :—

" (2.) For the purposes of ascertaining the current equivalent of a rate of standard salary, there shall be added to, or subtracted from, the amount so specified the amount of the increase or reduction, as the case may be, under regulation 106a of these Regulations.".

Salary for purposes of furlough.

2. Regulation 62 of the Public Service Regulations is amended by omitting paragraphs (k) and (l) and inserting in their stead the following paragraphs:—

" (k) allowances payable under regulation 105b ;

(l) allowances payable under regulation 106aa other than the allowance payable to Fruit Inspector (Supervising) in lieu of overtime : and ".

Calculation of pay for duty on a holiday.

3. Regulations 63 and 63a of the Public Service Regulations are repealed and the following regulation is inserted in their stead :—

" 63.—(1.) For the purposes of sub-section (5.) of section 76 of the Act, a day's salary payable to an officer for the performance of a full day's duty on a holiday shall, subject to this regulation, be calculated by multiplying the hourly rate of salary ascertained in accordance with the next succeeding sub-regulation by the number of hours of duty that the officer would have been required to perform if the day had not been a holiday.

" (2.) The hourly rate of salary shall be ascertained in accordance with the following formula:—

" (3.) Where an officer performs, on a holiday—

(a) the duties of an officer having a higher classification than his own ; or

(b) the duties of postal officer in charge,

the annual actual salary of that officer shall, for the purposes of this regulation, include any allowance payable for the performance of those duties.

" (4.) Notwithstanding anything contained in this regulation—

(a) a day's salary payable to a Mail Officer employed in a Travelling Post Office shall be not less than an amount calculated by dividing his annual actual salary by three hundred and thirteen ; and

(b) the hourly rate of salary for the purposes of this regulation shall not exceed—

(i) in the case of a male officer, the rate ascertained in accordance with sub-regulation (2.) of this regulation for an officer who is receiving an actual salary that is the current equivalent of a standard salary of £812 per annum ; and

(ii) in the case of a female officer, the rate ascertained in accordance with that sub-regulation for an officer who is receiving an actual salary that is the current equivalent of a standard salary of £707 per annum.

" (5.) Where the annual standard salary payable to a male officer exceeds £1,244 per annum or the annual standard salary payable to a female officer exceeds £1,139 per annum, the payment of any amount, or the granting of any period off duty, to such an officer in consequence of his or her attendance and services during a holiday or half-holiday observed under section 76 of the Act shall be subject to the approval of the Board.".

Recording and payment of overtime.

4. Regulation 67 of the Public Service Regulations is amended—

(a) by omitting sub-regulations (5.) and (6.) and inserting in their stead the following sub-regulations :—

" (5.) For the purpose of payment, overtime shall be calculated to the nearest quarter of an hour of the total period of overtime worked in each fortnight.

" (6.) Subject to sub-regulations (6a.), (6b.) and (6c.) of this regulation, the hourly rate of overtime payment shall be calculated in accordance with the following formula :—

" (6a.) The hourly rate of overtime payment shall be calculated to two decimal points of a penny.

" (6b.) The minimum rate of overtime payment shall be Two shillings per hour and the maximum rate of overtime payment shall be ascertained by calculating the rate payable to an officer in receipt of an actual salary that is the current equivalent of a standard salary at the rate of—

(a) £812 in the case of a male officer ; or

(b) £707 in the case of a female officer.

" (6c.) The maximum amount payable in respect of overtime performed by an officer in a fortnight shall not exceed the amount by which the actual salary of the officer for the whole of a fortnight during which no overtime is performed is less than an amount calculated in accordance with the following formula :—

" (6d.) For the purpose of the last preceding subregulation, 'S' is the actual salary that is the current equivalent of a standard salary at the rate of—

(a) £1,244 per annum in the case of a male officer ; or

(b) £1,139 per annum in the case of a female officer.

" (6e.) For the purposes of calculating the hourly rate of overtime payment payable to an officer of the Third Division whose normal hours of duty are forty hours per week, the prescribed weekly hours before overtime is payable shall be deemed to be thirty-eight per week, but overtime payment shall be payable only for duty performed by such an officer in excess of forty hours per week." ; and

(b) by omitting sub-regulation (13.) and inserting in its stead the following sub-regulation :—

" (13.) Officers—

(a) in receipt of a standard salary at a rate exceeding—

(i) £1,244 per annum in the case of a male officer ; or

(ii) £1,139 per annum in the case of a female officer ;

(b) stationed at lighthouses ;

(c) not working under close supervision ; or

(d) whose hours of duty can not be definitely determined,

shall not be eligible to receive overtime payment except for the performance of duty specified in sub-regulation (9.) of this regulation or in such other cases as the Board approves.".

5. Regulation 68 of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Calculation of Meal allowances.

" 68.—(1.) Subject to this regulation, an officer or employee who—

(a) is required to perform extra duties which involve his attendance up to the completion of, or after, a second meal hour in any one day ;

(b) is required to work a full shift and perform duty after a second meal break and is not entitled to payment for that meal break ;

(c) is required to perform extra duty after two o'clock in the afternoon on a Saturday (or the day normally allowed to him as the weekly half-holiday) after a meal break and is not entitled to payment for that meal break ; or

(d) is required to perform duty on a Sunday or public holiday (in addition to his normal weekly hours of duty) extending beyond a meal break and is not entitled to payment for that meal break,

shall be paid a meal allowance in accordance with the following scale :—

" (2.) Where a three-course meal is obtainable by the officer or employee at a canteen, cafeteria or dining-room conducted, controlled or assisted by the Commonwealth, the amount of meal allowance shall, in lieu of the amount payable under the last preceding sub-regulation, be the maximum amount for which a three-course meal is obtainable at the canteen, cafeteria or dining-room.

" (3.) An officer or employee who is required to perform any of the duties specified in paragraphs (b), (c) or (d) of sub-regulation (1.) of this regulation shall not be paid a meal allowance unless he satisfies the officer authorizing the duty that he can not reasonably be expected to return to his home or lodgings for a meal between the time at which he ceases duty before the meal and the time at which he is required to commence duty after the meal.

" (4.) For the purposes of paragraph (a) of sub-regulation (1.) of this regulation, a meal hour means—

(a) a period of one hour between the hours of 7 a.m. and 9 a.m. ;

(b) a period of one hour between the hours of 12 noon and 2 p.m. ; or

(c) the period between 6 p.m. and 7 p.m.".

Travelling time,

6. Regulation 69 of the Public Service Regulations is amended by omitting the words and figures " an officer who is in receipt of salary at a rate not exceeding £462 per annum " and inserting in their stead the words and figures " a male officer who is in receipt of standard salary at a rate not exceeding £812 per annum or a female officer who is in receipt of a standard salary not exceeding £707 per annum,".

Sunday duty.

7. Regulation 70 of the Public Service Regulations is amended by omitting sub-regulation (5.) and inserting in its stead the following sub-regulations :—

" (5.) This regulation shall not apply—

(a) to an officer stationed at a lighthouse ;

(b) to an officer of the Canberra Fire Brigade ;

(c) except in such cases as are approved by the Board, to an officer employed on a lighthouse vessel ; and

(d) except with the approval of the Board, to an officer in receipt of a standard salary in excess of £1,244 per annum in the case of a male officer and £1,139 per annum in the case of a female officer.

" (5a.) For the purposes of this regulation, the maximum hourly rate shall be that calculated on a standard salary of £812 per annum in the case of a male officer and £707 per annum in the case of a female officer.".

Basis of calculation of allowances.

8. Regulation 75 of the Public Service Regulations is amended by omitting sub-regulation (1.).

Rates of travelling allowances.

9.—(1.) Regulation 75a of the Public Service Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table:—

(2.) Regulation 75a of the Public Service Regulations is amended by omitting from sub-regulation (2.) the words " One pound twelve shillings and sixpence per day " and inserting in their stead the words " Two pounds per day ".

10. Regulation 76 of the Public Service Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table :—

Allowances to Veterinary Officers and Meat Inspectors.

11. Regulation 79b of the Public Service Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table :—

12. Regulation 84 of the Public Service Regulations is amended by omitting the words and figures " maximum salary of whose positions does not exceed £348 " and inserting in their stead the words and figures " maximum standard salary of whose positions does not exceed £656 ".

Maximum salary of position.

13. Regulation 85 of the Public Service Regulations is repealed.

14. Regulation 87 of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Higher duties

" 87.—(1.) An officer may be called upon to perform temporarily the duties of an office having a higher classification than his own.

" (2.) Subject to this regulation, an officer who performs all the duties of a higher office shall be paid in respect of the performance of those duties an allowance equal to the amount of the difference between his actual salary and the actual salary that is the current equivalent of the minimum standard salary of the higher office.

" (3.) Unless the Board in special circumstancess otherwise determines, an officer who performs the duties of a higher office the maximum standard salary of which exceeds £764 per annum in the case of a male officer or £659 per annum in the case of a female officer, for a period of less than a week, shall not be paid an allowance, and that period shall not be included in any period of service for the purposes of this regulation.

" (4.) Where an officer who has not attained the age of twenty-two years performs the duties of a higher office for which rates of salary payable to such an officer are specifically prescribed, he shall be paid an allowance of an amount equal to the difference between the salary rate for his age in his own office, and the salary rate for his age in the higher office.

" (5.) An officer who performs the duties of a higher office for a period of less than one day shall not be entitled to payment for that period and that period shall not be service in the higher office for the purposes of this regulation.

" (6.) Where an officer temporarily performs the duties of a higher office for a continuous period of more than twelve months after the date on which he first commenced to perform those duties, he may, after the completion of each period of twelve months' performance of those duties, be granted increments of allowance of the same amounts as are payable as increments of salary to an officer occupying the higher office.

" (7.) Where an officer temporarily performs the duties of a higher office in periods that are not continuous but aggregate in the total a period of more than twelve months, he may, at the completion of each such total period of twelve months, be granted an increment of allowance of the same amount as is payable as an increment of salary to an officer occupying the higher office if—

(a) in the case of the first increment, the total period of twelve months' performance of higher duties is completed within the period of twenty-four months that immediately precedes that completion; and

(b) in the case of any subsequent increment, the total requisite period of performance of higher duties is completed within the period of time equal to twice the total period of performance of duties of the higher office that immediately precedes that completion.

" (8.) For the purposes of the last two preceding sub-regulations, performance of the duties of another office having the same classification as, or a higher classification, than the higher office shall be deemed to be performance of the duties of the higher office.

" (9.) Paragraph (b) of sub-regulation (7.) of this regulation does not operate so as to authorize the grant of an increment to an officer unless he has received the first or a subsequent increment in the allowance payable under this regulation for a period of twelve months.

'' (10.) For the purpose of determining the date from which an increment in an allowance is payable under this regulation, or whether service is continuous, absence on—

(a) public holidays ;

(b) recreating leave ;

(c) leave granted, under the provisions of section 69 of the Act or regulation 52 of these Regulations ;

(d) leave not exceeding in all six days in any twelve months granted under regulation 53 of these Regulations ;

(e) leave granted under regulation 45 or 51 of these Regulations ;

(f) accident leave granted under an order or determination made by the Public Service Arbitrator ;

(g) sick leave not exceeding the periods specified in the next succeeding sub-regulation ; and

(h) other authorized leave not exceeding in all six days in any twelve months,

shall be deemed to be performance of duty in a higher office, if the officer resumes duty in the same office or another office of higher classification than his own at the expiration of the absence.

" (11.) For the purpose of the last preceding sub-regulation, sick leave means only such sick leave as is granted for the following periods :—

(a) leave not exceeding two weeks granted during the first period of twelve months' service, either continuous or in broken periods, in the higher office ;

(b) leave not exceeding four weeks granted during the second period of twelve months' service, either continuous or in broken periods, in the higher office, less any period of leave not exceeding two weeks granted during the first period of twelve months' service in the higher office ; and

(c) sick leave granted in any subsequent period of twelve months' service in the higher office not exceeding a period calculated on the basis of two weeks' leave for each completed period of twelve months' service in the higher office, less any period of leave granted during previous service in the higher office.

" (12.) Where an officer who is performing the duties of a higher office is permanently promoted to that office, he shall not suffer any reduction in his remuneration, and he may receive the same increments as if he had, during the period of his temporary service in the higher office, been the permanent occupant of that office.

" (13.) Where an officer is permanently promoted to an office and, prior to his promotion, has performed the duties of a higher office of the same classification as the office to which he is promoted but is not performing those duties when he is promoted, the period for which he performed those duties shall be taken into account for the purposes of his incremental advancement in the same manner as it would have been taken into account under sub-regulation (6.) of this regulation if he had not been promoted.

" (14.) Where an officer who is or has been performing the duties of a higher office is promoted to an office which is of lower classification than the office the duties of which he is or has been temporarily performing, his remuneration upon promotion shall be the same as the remuneration which he would have received had his period of service in the higher office been service in the office of lower classification.

" (15.) Where an officer performs the duties of a higher office and is in receipt of a salary above the minimum salary payable to the occupant of the higher office, he shall, upon commencing to perform the duties of the higher office, be paid such allowance as will cause his total remuneration to be the same as that which would have been payable under regulation 109b of these Regulations if he had been promoted to the higher office.

" (16.) Where an officer temporarily performs the duties of an office the conditions of service in which differ from those in the office normally occupied by the officer, he shall be subject to the first mentioned conditions as though he wore the permanent occupant of the office.

" (17.) Where an officer temporarily performs the duties of a higher office the maximum standard salary of which, including allowances in the nature of salary, is not less than £1,184 per annum in the case of a male officer or £1,079 per annum in the case of a female officer, the preceding provisions of this regulation do not apply, but the officer may be paid in respect of the performance of those duties an allowance of such amount, and subject to such conditions, as the Board determines.

" (18.) Where an officer temporarily performing the duties of a higher office does not perform all the duties of that office, he may be paid in respect of the performance of those duties an allowance of such amount, and subject to such conditions, as the Board determines.

" (19.) An allowance granted under this regulation shall be regarded as salary for the purposes of calculating travelling and meal allowances and payment for extra duty services and excess travelling time.".

15. Regulation 96 of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Officers appointed to stations away from home.

" 96. Where an officer is appointed or transferred to an office the duties of which necessitate his residing away from home, he may be granted such allowances as the Board determines.".

16. Regulation 99 of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Allowance— Sunday or holiday duty.

" 99. Where an officer who is in receipt of standard salary exceeding £1,244 per annum in the case of a male officer and £1,139 per annum in the case of a female officer is required to attend regularly for duty

on Sundays or holidays and is not entitled to payment or time off duty under section 76 of the Act or regulation 70 of these Regulations, the officer may be paid an allowance, in addition to salary, of such an amount as is determined by the Board.".

17.—(1.) Parts IV., V., VI. and VIa. of the Public Service Regulations are repealed and the following Parts inserted in their stead:—

" PART IV.—Officers of the Second Division.

Salaries of officers of Second Division.

" 104.—(1.) The limits of annual salary payable to an officer occupying an office in the Second Division shall be such of the amounts specified in Table A, Table B or Table C in this sub-regulation as are applicable to that office by virtue of the Public Service Act 1951, or as are allotted, after the date of commencement of that Act, by the Governor-General on the recommendation of the Board in respect of that office.

" (2.) Subject to the provisions of section 31 of the Act, increments may be paid to an officer within the limits of salary fixed in respect of his or her office of such amount as will, in the case of a male officer, raise his salary to the next higher amount shown in Table A or Table C, as the case requires, of the last preceding sub-regulation or, in the case of a female officer, raise her salary to the next higher amount shown in Table B of that sub-regulation.

" (3.) Where a female officer is employed in an office in respect of which the limits of salary fixed are amounts specified in Table A or Table C of sub-regulation (1.) of this regulation, the limits of salary payable to the officer shall be £105 less than those fixed in respect of that office.

" (4.) The Board may alter the designation of an office in the Second Division.

" Part V.—Officers of the Third Division.

Salaries or officers of Third Division.

" 105.—(1.) The limits of annual salary payable to an officer occupying any office in the Third Division shall be such of the amounts specified in Table A, Table B, Table C or Table D in this sub-regulation as are applicable to that office by virtue of the Public Service Act 1951, or as are allotted, after the commencement of that Act, by the Governor-General on the recommendation of the Board in respect of that office.

(c) the maximum of the limits of annual salary payable to an officer shall not be less than £620 in the case of a male officer or less than £515 in the case of a female officer ;

(d) where a female officer is employed in any office in respect of which the limits of salary fixed are amounts specified in Table A or Table 0 of sub-regulation (1.) of this regulation the limits of salary payable to the officer shall, subject to paragraph (b) of this sub-regulation, be £105 less than those fixed in respect of that office ;

(e) the minimum annual salary payable to an officer, appointed under section 36a of the Act or appointed to, or occupying, an office in the Third Division, who is a graduate of an Australian University or a University approved by the Board shall be as follows :—

" (4.) The Board may alter the designation of an office in the Third Division.

Conditions of advancement in certain positions.

" 105a.—(1.) Notwithstanding anything contained in regulation 105, the advancement in salary of an officer occupying an office specified in the first column of the Second Schedule to these Regulations shall be subject to the conditions specified in the second column of that Schedule opposite to the designation of that office.

" (2.) A reference in that Schedule to an amount is a reference to a standard salary of that amount.

Allowances In addition to salary.

" 105b.—(1.) An officer who is engaged, at such post offices as the Board determines, on the regular exchange of duties with the Supervisor in charge of the evening staff for one day in three, or one week in three, shall, with the approval of the Chief Officer, be paid an allowance to increase his standard salary—

(a) if relieving a Supervisor (Telegraphs), Grade 1—to the minimum standard salary of a Supervisor (Telegraphs), Grade 1 ; or

(b) if relieving a Supervisor (Telegraphs), Grade 2—to the standard salary of a Supervisor (Telegraphs), Grade 1, who has been granted one increment over the minimum standard salary of a Supervisor (Telegraphs), Grade 1.

" (2.) Where the officer next in seniority to the Postmaster or the Supervisor, as the ease may be, at the following stations, is in receipt of salary, including any allowance payable under sub-regulation (4.) of this regulation, less than the equivalent of the maximum salary of the

office of Telegraphist in the Fourth Division plus an amount equal to the amount of an increment payable within the limits of standard salary of a Fourth Division Telegraphist, the Chief Officer may, upon satisfactory evidence of competency to attend to repeaters in the absence of the Postmaster or the Supervisor in charge, grant an allowance to that officer at the rate of £18 per annum :—

Mount Surprise, Queensland; Alice Springs and Maree, South Australia; and Mullewa and Marble Bar, Western Australia.

" (3.) A Telegraphist who has passed the proscribed examination for promotion to an office of Senior Telegraphist may, on the approval of the Chief Officer, be paid an allowance at the rate of £12 per annum until he is promoted to a higher office.

" (4.) A Telegraphist in the Third Division upon passing an examination approved by the Board for that purpose shall be paid an allowance at the rate of £18 per annum in addition to the rate of salary payable to him under these Regulations.

 Part VI.—Officers of the Fourth Division.

Salaries of officers of Fourth Division.

" 106.—(1.) The annual salary or the limits of annual salary payable to an officer occupying an office in the Fourth Division shall be such of the amounts specified in Table A or Table B in this subregulation as are applicable to that office by virtue of the Public Service Act 1951, or as are allotted after the date of commencement of that Act, by the Governor-General, on the recommendation of the Board in respect of that office.

" (2.) Subject to section 31 of the Act and regulation 106aa of these Regulations, the amounts of annual increments of salary (if any) payable within the limits of salary (if any) fixed in respect of an office in the Fourth Division shall be the amount or amounts specified in the sixth column of the Fourth Schedule opposite to the designation of the office.

" (3.) An officer who has not attained the age of twenty-one years and who occupies an office specified in the Fourth Schedule to these Regulations in respect of which a salary according to age is specified, shall be paid the annual salary so specified for his ago.

" (4.) Where a female officer is employed in an office specified in Part I. of the Fourth Schedule, the salary payable to that officer shall be in accordance with a scale or amount which is £105 less than the scale or amount shown opposite that office, except where the amount is prescribed as payable to an officer who has not attained the age of twenty-one years.

" (5.) The Board may alter the designation of an office in the Fourth Division.

Conditions of advancement of certain officers in the Fourth Division.

" 106aa.—(1.) Notwithstanding anything contained in the last preceding regulation—

(a) an officer who occupies an office specified in the second column of the Fifth Schedule to these Regulations and has the qualifications or complies with the conditions relating to an allowance specified in the third column of that Schedule opposite to the designation of his office, shall be granted an allowance at the rate so specified ; and

(b) the advancement in salary of any officer who occupies an office specified in the second column of the Fifth Schedule shall be subject to the conditions specified in the third column of that Schedule opposite to the designation of his office.

" (2.) A reference in the Fifth Schedule to an amount of annual salary shall be read as a reference to an annual standard salary of that amount.

Part VIa.—Variation of Salary—Officers of Second, Third and Fourth Divisions.

Variations of salary on account of variations in cost of living.

" 106a.—(1.) For the purposes of this regulation—

(a) ' index number ' means the weighted average retail price index number for the six State capital cities of the Commonwealth as shown in the ' Court ' index (Third Series) of retail price index numbers published from time to time by, or at the direction of, the Commonwealth Court of Conciliation and Arbitration; and

(b) ' officer ' means an officer of the Second, Third or Fourth Division.

" (2.) Where the index number for the three months ended on the thirty-first day of March, the thirtieth day of June, the thirtieth day of September or the thirty-first day of December, in any year is less than 150.9, the salary payable to an officer shall, as from the commencement of the first fortnightly pay period beginning in the next succeeding month of May, August, November or February (as the case may be), be decreased by—

(a) an amount of Six pounds per annum in the case of a male officer who has attained the age of twenty-one years ;

(b) alternate amounts of Four pounds per annum and Five pounds per annum in the case of a female officer who has attained the age of twenty-one years ;

(c) an amount of Four pounds per annum in the case of an officer who has attained the age of nineteen years but has not attained the age of twenty-one years ; or

(d) an amount of Three pounds per annum in the case of an officer who has not attained the age of nineteen years,

for each 2.3 points by which that index number is less than 162.1.

" (3.) Where the index number for the three months ending on the thirty-first day of March, the thirtieth day of June, the thirtieth day of September or the thirty-first day of December in any year exceeds 162.1, the salary payable to an officer shall, as from the commencement of the first fortnightly pay period beginning in the next succeeding month of May, August, November or February (as the case may be), be increased by—

(a) an amount of Six pounds per annum in the case of a male officer who has attained the age of twenty-one years ;

(b) alternate amounts of Five pounds per annum and Four pounds per annum in the case of a female officer who has attained the age of twenty-one years ;

(c) an amount of Four pounds per annum in the case of an officer who has attained the age of nineteen years but has not attained the age of twenty-one years ; or

(d) an amount of Three pounds per annum in the case of an officer who has not attained the age of nineteen years,

for each 2.3 points by which that index number exceeds 159.9.

" (4.) Notwithstanding anything contained in this regulation, the salary of an officer who has not attained the age of twenty-one years shall be varied as if that officer had attained that age if—

(a) he occupies an office for which the rate of salary payable to an officer under the age of twenty-one years is prescribed, but, having complied with a condition of advancement specified in relation to that office in the Fifth Schedule to those Regulations, he is paid the rate payable to an officer who has attained the age of twenty-one years prescribed for that office ; or

(b) he occupies an office for which the rate of salary payable to an officer under the age of twenty-one years is not prescribed.".

(2.) The salary payable to an officer of the Second, Third and Fourth Division shall, from the date of commencement of these Regulations to the date upon which the first variation in salary is, after the date of commencement of these Regulations, made under regulation 106a of the Public Service Regulations as inserted by the last preceding sub-regulation, be increased by adding—

(a) in the case of a male officer who has attained the age of twenty-one years—an amount of Forty-two pounds per annum ;

(b) in the case of a female officer who has attained the age of twenty-one years—an amount of Thirty-two pounds per annum ;

(c) in the case of an officer who has attained the age of nineteen years but has not attained the age of twenty-one years— an amount of Twenty-eight pounds per annum ; or

(d) in the case of an officer who has not attained the age of nineteen years—an amount of Twenty-one pounds per annum.

(3.) Regulation 105a of the Public Service Regulations, as inserted by the last preceding sub-regulation, does not apply to an officer occupying, at the date of commencement of these Regulations, an office the designation of which was not specified in the first column of the Second Schedule to the Public Service Regulations as in force immediately prior to the date of commencement of these Regulations.

(4.) For the purpose of the last preceding sub-regulation, the designation of an office does not include a reference to the limits of salary of that office.

18. Regulation 109h of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Maximum salary for purposes of certain appeals.

" 109h. The maximum rate of salary for the purposes of sub-section (8b.) of section 50 of the Act is a standard salary at the rate of £812 per annum in the case of a male officer and a standard salary at the rate of £707 per annum in the case of a female officer.".

19. Regulation 112a of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Test of qualification for certain offices.

" 112a.—(1.) The transfer or promotion of an officer to any office specified in column one of. Part I. of the Third Schedule to these Regulations shall be subject to the conditions set out in the second column of that Part opposite to the designation of that office.

" (2.) The transfer or promotion of an officer to any office specified in Part II. of the Third Schedule to these Regulations shall be dependent upon his passing such test or examination as is determined from time to time by the Board, and upon his being within the age limits notified as a condition of that test or examination.

" (3.) Except where otherwise determined by the Board, an officer shall not be transferred to an office of Clerk unless he has passed an examination held for appointment to such an office.".

The Schedules.

20. The First, Second, Third, Fourth and Fifth Schedules to the Public Service Regulations are repealed and the following Schedules inserted in their stead :—

"THE SECOND SCHEDULE.

Regulation 105a.

Conditions of Advancement in Certain Offices in the Third Division.

Analyst, Grade 1, £620–£908

(1) He shall be paid not less than £764 per annum if—

(a) he has served for two years as Analyst, Grade 1 ; and

(b) the Board is satisfied that the class of work upon which he is wholly or mainly engaged is of such quality and importance, and his efficiency is of such standard, as to warrant payment of that salary

(2) He shall not be advanced beyond £764 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £764 per annum, he shall not be advanced beyond the salary payable to him at that date unless the Board is satisfied that he is capable of performing efficiently the whole of the duties of his office

Architect, Grade 1, £620–£008

(1) He shall be paid not less than £764 per annum if—

(a) he has served for two years as Architect, Grade 1 ; and

(b) the Board is satisfied that the class of work upon which he is wholly or mainly engaged is of such quality and importance, and his efficiency is of such standard, as to warrant payment of that salary

(2) He shall not be advanced beyond £764 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £764 per annum, he shall not be advanced beyond the salary payable to him at that date unless the Board is satisfied that he is capable of performing efficiently the whole of the duties of his office

Assessor, Grade 1 (Income Tax), £620–£764

(1) He shall not be advanced beyond £692 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £692 per annum, he shall not be advanced beyond the salary payable to him at that date unless—

(a) he has passed an intermediate examination of an Institute of Accountants, or Public Accountants Registration Board, approved by the Board;

(b) he has passed Technical College examinations in Accountancy which, in the opinion of the Board, are of at least equivalent standard to the intermediate examination of an Institute of Accountants, or a Public Accountants Registration Board, approved by the Board;

(b) he has successfully completed, at a University, or Technical College, approved by the Board, a course in Accountancy which, in the opinion of the Board, is of at least equivalent standard to the final examination of an Institute of Accountants, or a Public Accountants Registration Board, approved by the Board ;

(c) he has successfully completed, at a University approved by the Board, a course in Commerce or Economics, including all auditing and accountancy subjects in the course, except specialized cost accounting ;

(d) he is a ' State employee ' as defined in section 81l of the Act, who, at the date on which this Schedule is inserted in the Public Service Regulations, permanently occupies an office of Assessor, Grade 2 (Income Tax), or is an unattached officer but permanently occupied an office of Assessor, Grade 2 (Income Tax), immediately prior to his becoming an unattached officer

(b) he has passed such examination in subjects related to radio telegraphy as is required by the Board

(2) He shall not be advance 1 beyond £764 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £764 per annum, he shall not be advanced beyond the salary payable to him at that date unless he has passed the examination approved by the Board to qualify for appointment, transfer or promotion to an office of Radio Inspector, Grade 1

Assistant Research Officer, £572–£764

(1) He shall be paid not loss than £692 per annum if—

(a) he has completed a degree course at a University approved by the Board in subjects considered suitable by the Board ; and

(b) the Board is satisfied, upon a report by the Permanent Head, that he has demonstrated that he has special aptitude and ability for research work

(2) He shall not be advanced beyond £692 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £692 per annum, he shall not be advanced beyond the salary payable to him at that date unless—

(a) he has completed a degree course at a University approved by the Board in subjects considered suitable by the Board ; and

(b) the Board is satisfied, upon a report by the Permanent Head, that he has aptitude and ability for research work

(i) completed a course for a degree at a University approved by the Board and has passed in his course in the subject of Psychology at third year standard ; or

(ii) successfully completed a course of training, at a University or other institution approved by the Board, in subjects which, in the opinion of the Board, are at least equivalent to a pass in the subject of Psychology at third year standard ; and

(b) the Board is satisfied that he has special aptitude and ability for work in Psychology

(2) He shall not be advanced beyond £692 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £692 per annum, he shall not be advanced beyond the salary payable to him at that date unless he satisfies the requirements specified in paragraph (1) of those conditions

Biochemist, Grade 1, £620-£908

(1) He shall be paid not loss than £764 per annum if—

(a) he has served for two years as Biochemist, Grade 1 ; and

(b) the Permanent Head is satisfied that the class of work upon which he is wholly or mainly engaged is of such quality and importance, and his efficiency is of such standard, as to warrant payment of that salary

(2) He shall not be advanced beyond £764 per annum or, if his salary at the date of his appointment, transfer, or promotion exceeds £764 per annum, he shall not be advanced beyond the salary payable to him at that date unless—

(a) he has passed an examination, from time to time, approved by the Board for advancement beyond that salary or he possesses qualifications which, in the opinion of the Board, are of at least equivalent standard ; and

(b) the Board is satisfied that he is capable of performing efficiently the whole of the duties of his office

(a) he has trained to the satisfaction of the Board as a Cadet for a period of three years ; and

(b) the Board is satisfied that his diligence, conduct and progress during the period of training warrant payment of that salary

Cadet Architect, £232–£620

(1) He shall be designated Architect, Grade 1, and paid not loss that £620 per annum if he has—

(a) trained to the satisfaction of the Board as a Cadet Architect for a period of five years or such lesser period as the Board determines ; and

(b) qualified for—

(i) a degree or diploma of Architecture of an Australian University or such other degree as the Board approves ; or

(ii) a diploma of Architecture or such other appropriate certificate of a Technical College or other institution as the Board approves

Cadet Biochemist, £232–£620

(1) He shall be designated Biochemist, Grade 1, and paid not loss than £620 per annum if he has—

(a) trained to the satisfaction of the Board as Cadet Biochemist for a period of five years or such lesser period as the Board determines ;

(b) passed—

(i) all examinations in an approved course for the degree of Bachelor of Science of an Australian University together with such additional Science subjects as the Board approves ; or

(ii) examinations in such subjects of a Technical College diploma course in Chemistry as the Board approves ; and

(c) passed departmental examinations, written and practical, approved by the Board

(b) he has qualified for a degree appropriate to the work of the position at a University approved by the Board, and the Board is satisfied as to his efficiency and aptitude for that work

Cadet Draftsman, £232–£620 (Postmaster-General's Department)

(1) He shall be designated Draftsman and paid not less than £620 per annum if—

(a) he has—

(i) trained to the satisfaction of the Board as Cadet Draftsman for a period of five years or such lesser period as the Board determines ; or

(ii) if, immediately prior to transfer as Cadet Draftsman he occupied the position of Technician (Telecommunications), he has trained to the satisfaction of the Board as Cadet Draftsman for a period of three years ; and

(b) he has completed a course of study, approved by the Board, in departmental and Technical College subjects

Cadet Draftsman (Photo-grammetric), £232–£620

(1) He shall be designated Draftsman (Photogrammetric), Grade 1, and paid not loss than £620 per annum if he has—

(a) trained to the satisfaction of the Board as Cadet Draftsman (Photogrammetric) for a period of five years or such lesser period as the Board determines ; and

(b) passed such examinations as are determined by the Board

Cadet Education Officer £232–£620

(1) He shall be designated Education Officer, Grade 1, and paid not less than £620 per annum if—

(a) he has—

(i) trained to the satisfaction of the Board as Cadet Education Officer for a period of five years or such lesser period as the Board determines ; and

(ii) qualified for the degree of Bachelor of Education of an Australian University ; or

(ii) passed such examinations as the Board determines ; or

(b) he has—

(i) trained to the satisfaction of the Board as Cadet Engineer for a period of five years or such lesser period as the Board determines ; and

(ii) qualified for the degree of Bachelor of Engineering of an Australian University in subjects approved by the Board

Cadet Engineer, £232–£620 (Department of Supply)

(1) He shall be designed Engineer, Grade 1, and paid not less than £820 per annum if he has—

2. An officer (not being a State employee as defined in Section 81l of the Act, who, at the date on which regulation 106aaa of these Regulations is deemed to have come into operation, is the permanent occupant of an office of Accounting Machinist (Female), Grade 1, or is an unattached officer and was, immediately prior to becoming an unattached officer, the occupant of an office having that designation) shall not be advanced in salary beyond the rate of £431 per annum unless she passes a test conducted by or on behalf of the Board.

1. She shall, if she has not attained the age of 21 years, be advanced to the minimum rate of actual salary payable to an officer who has attained the age of 21 years, occupying office of Phonogram Operator (Female), if—

1. She shall, if she has not attained the age of 21 years, be advanced to the minimum rate of actual salary payable to an officer who has attained the age of 21 years occupying office of Telephonist (Female), if—

(a) she has completed two years satisfactory service in an office of Telephonist (Female) ; and

(b) the Chief Officer has furnished evidence to the satisfaction of the Board that she is capable of performing efficiently the whole of the duties of her office.

Typist (Female), Grade 1 ........................

1. An officer who has not attained the age of 21 years and who satisfies the Board as to her efficiency at writing and transcribing shorthand at the rate of 100 words per minute shall be granted an allowance at the rate of £24 per annum.

2. An officer who has not attained the age of 21 years and who satisfies the Board as to her efficiency at writing and transcribing shorthand at the rate of 120 words per minute and her ability at transcribing or typing letters and documents with due regard to form and punctuation shall be granted—

(a) an allowance at the rate of £36 per annum if she is not in receipt of the allowance referred to in the last preceding paragraph ; or

(b) an allowance at the rate of £12 per annum if she is in receipt of the allowance referred to in the last preceding paragraph.

3. An officer (not being a State employee as defined in Section 81l of the Act who, at the date on which regulation 106aaa of these Regulations is deemed to have come into operation, is the permanent occupant of an office of Typist (Female), Grade 1, or is an unattached officer and was, immediately prior to becoming an unattached officer, the occupant of an office having that designation) shall not be advanced in salary beyond the rate of £431 per annum unless she satisfies the Board as to her efficiency at writing and transcribing shorthand at the rate of 100 words per minute.

4. An officer who has attained the age of 21 years and who satisfies the Board as to her efficiency at writing and transcribing shorthand at the rate of 100 words per minute and who, at the date of so satisfying the Board, is in receipt of salary at the rate of £383 per annum shall be advanced to a salary at the rate of £407 per annum from that date and shall be granted, subject to the prescribed conditions—

(a) an increment at the rate of £24 per annum payable at the expiration of twelve months after the date from which she first received salary at the rate of £383 per annum ; and

(b) three subsequent annual increments at the rate of £12 per annum.

5. An officer who satisfies the Board as to her efficiency at the matters specified in the last preceding paragraph and who, at the date of so satisfying the Board, is in receipt of salary at a rate exceeding £383 per annum, shall, subject to the next succeeding paragraph, be advanced from that date to a salary at a rate of £24 per annum more than the rate of salary payable to her immediately prior to that date and shall be granted, subject to the prescribed conditions, subsequent annual increments at the rate of £12 per annum, the first of which shall be payable at the expiration of twelve months after the date from which she received her last increment prior to the date on which she so satisfied the Board.

6. An officer who at the date of satisfying the Board as to her efficiency at the matters specified in paragraph 4 of these provisions has completed more than twelve months' service on a salary at the rate of £431 per annum and whose conduct, diligence and efficiency are satisfactory shall be advanced from that date to a salary at the rate of £467 per annum.

7. An officer who has attained the age of 21 years and who satisfies the Board as to her efficiency at writing and transcribing shorthand at the rate of 120 words per minute and at typing letters and documents with due regard for punctuation and form and who, at the date of so satisfying the Board, is in receipt of salary at the rate of £383 per annum shall be advanced, from that date, to a salary at the rate of £419 per annum and shall, subject to the prescribed conditions, be granted two annual increments at the rate of £24 per annum, the first of which shall be payable at the expiration of twelve months after the date on which she first received salary at the rate of £383 per annum.

8. Where an officer satisfies the Board as to the matters specified in the last preceding paragraph and is, at that date, in receipt of a salary at a rate exceeding £383 per annum—

(a) the officer shall, if she has not previously satisfied the Board as to her efficiency at the matters specified in paragraph 4 of these provisions, be advanced from that date to a salary at a rate of £36 per annum more than the rate of salary payable to her immediately prior to so satisfying the Board and if her salary, after being so advanced, is less than £467 per annum, she shall be advanced to a salary at the rate of £467 per annum at the expiration of twelve months after the date on which she so satisfied the Board ; and

9. She shall be paid an allowance at such rate as is determined from time to time by the Board, if regularly employed in taking notes of evidence in courts of law or on duties which in the opinion of the Board are of like character.
