REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1951.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1951, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations. 

Short leave and leave for examinations.

1. Regulation 50 of the Public Service Regulations is amended by omitting from sub-regulation (3.) the words "the Commonwealth Reconstruction Training Scheme" and inserting in their stead the words "a Commonwealth scheme of vocational training".

Calculation of pay for duty on a holiday.

2. Regulation 63 of the Public Service Regulations is amended by omitting from sub-regulation (1.) the word and figure "sub-section (5.) " and inserting in their stead the word and figure " sub-section (6.)".

3. Regulation 64 of the Public Service Regulations is repealed and the following regulation inserted in its stead:—

Performance of duty on a holiday.

"64.—(1.) Where the hours of duty of an officer are arranged by schedule and his hours of duty for the day immediately before or immediately after a holiday commence or cease, as the case may be, on that holiday, the officer shall, in respect of the period of his attendance and duty on that holiday, be paid at an hourly rate calculated in accordance with regulation 63 of these Regulations.

" (2.) Where the hours of duty of an officer are arranged by schedule and the officer commences duty on the evening of a holiday and ceases duty on the morning of the next day which is also a holiday, the officer shall, in respect of the period of his attendance and service for that duty, be paid as if that duty had been performed on the one holiday.".

Repeal of regulations 71 and 72.

4. Regulations 71 and 72 of the Public Service Regulations are repealed.

5. Part IV. of the Public Service Regulations is repealed and the following Part inserted in its stead:—

" Part IV.—Officers of the Second Division.

Salaries of officers of the Second Division.

"104.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates of annual salary payable to an officer of the Second Division is that scale of the rates specified in Table A, Table B or Table C in this sub-regulation which is applicable to the office occupied by the officer by virtue of its classification.

" (2.) Where a female officer occupies an office in respect of which the scale of rates of annual salary applicable to that office by virtue of its classification is a scale of rates specified in Table A or Table C of the last preceding sub-regulation, the rates payable to the female officer in respect of that office shall each be £105 less than the rates so specified.".

Salaries of officers of the Third Division.

6. Regulation 105 of the Public Service Regulations is amended—

(a) by omitting sub-regulations (1.) and (2.) and inserting in their stead the following sub-regulation:—

" (1.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates of annual salary payable to an officer of the Third Division is that scale of the rates specified in Table A, Table B, Table C, or Table D in this sub-regulation which is applicable to the office occupied by the officer by virtue of its classification.

(b) by omitting paragraph (d) of sub-regulation (3.) and inserting in its stead the following paragraph:—

" (d) where a female officer occupies an office in respect of which the scale of rates of annual salary applicable to that office by virtue of its classification is a scale of rates specified in Table A or Table C in sub-regulation (1.) of this regulation, the rates payable to the female officer in respect of that office shall each be £105 loss than the rates so specified;" and

(c) by omitting sub-regulation (4.).

Repeal of regulation 105A.

7. Regulation 105a of the Public Service Regulations is repealed.

8. Part VI. of the Public Service Regulations is repealed and the following Part inserted in its stead:—

"Part VI.—Officers of the Fourth Division.

Salaries of officers of the Fourth Division.

"106.— (1.) For the purposes of sub-section (2.) of section 30 of the Act—

(a) the annual rute of salary payable to an officer of the Fourth Division who occupies an office specified in the second column of the Fourth Schedule to these Regulations opposite to the designation of which an. annual rate of salary is specified in the fifth column of that Schedule is the rate specified in that last mentioned column; and

(b) the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office specified in the second column of the Fourth Schedule to those Regulations (not being an office referred to in the last preceding paragraph) is such scale of rates of annual salary as is ascertained by reference to the particulars specified in the fifth and sixth columns of that Schedule opposite to the designation of the first-mentioned office.

" (2.) Where an annual rate of salary according to age is specified in the fifth column of the Fourth Schedule to these Regulations opposite to the designation of an office specified in the second column of that Schedule, the annual salary payable to an officer who occupies such an office and is of an age specified in the fifth column of that Schedule shall be the rate specified in that column for that age.

" (3.) Where a female officer occupies an office specified in Part I. of the Fourth Schedule to these Regulations, being an office opposite to the designation of which an annual rate of salary (not being an annual rate of salary according to age) is specified in the fifth column of that Schedule, the annual rate of salary payable to the female officer in respect of that office shall be £105 less than the rate so specified.

" (4.) Where a female officer occupies an office specified in Part I. of the Fourth Schedule to those Regulations, being an office in respect of which a scale of rates of annual salary payable to a male officer is prescribed, the rates payable to the female officer in respect of that office shall each be £105 less than the rates prescribed in respect of that office when occupied by a male officer.

Allowance payable to certain officers in the Fourth Division.

" 106aa. An officer who occupies an office specified in. the first column of the Fifth Schedule to these Regulations and has the qualifications, or complies with the conditions, relating to an allowance specified in the second column of that Schedule opposite to the designation of his office shall be paid an allowance at the rate specified in that column in respect of those qualifications or conditions.".

Notification of provisional promotions.

9. Regulation 109 of the Public Service Regulations is amended—

(a) by omitting from paragraph (b) of sub-regulation (1.) the word "or"; and

(b) by adding at the end of that sub-regulation the following paragraphs:—

"(d) if the provisional promotion is made in the Territory of Papua and New Guinea, with the Public Service Inspector, Brisbane;

(e) if the provisional promotion is made in Norfolk Island, with the Public Service Inspector, Sydney; or

(f) if the provisional promotion is made in any other place outside Australia, with the Public Service Inspector, Canberra.".

Constitution of Promotion Appeals Committees.

10. Regulation 109d of the Public Service Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

"(1.) A Promotions Appeal Committee shall be constituted by—

(a) a Chairman appointed by the Board, who, while acting as Chairman, shall not be subject to direction by any person or authority under the Act;

(b) an officer nominated by the Permanent Head of the Department in which the provisional promotion has been made; and

(c) an officer nominated by the appropriate organization.

"(1a.) Subject to the next three succeeding sub-regulations, the appropriate organization for the purposes of the last preceding sub-regulation is an organization the. rules of which provide that an officer who occupies the office to which a provisional promotion has been made is eligible for membership of that organization.

" (1b.) Where the rules of more than one organization provide that an officer who occupies the office to which a provisional promotion has been made is eligible for membership, the appropriate organization for the purposes of sub-regulation (1.) of this regulation is the organization the membership of which includes the largest number of officers occupying offices of the class to which the provisional promotion has been made.

" (1c.) Where a provisional promotion is made to an office specified in the first column in the table in this sub-regulation, the appropriate organization for the purposes of sub-regulation (1.) of this regulation is the organization specified in the second column of that table opposite to the designation of that office.

" (1d) Where a provisional promotion is made to the office of Supervising Technician, Grade 2, Engineering "Branch, Postmaster-General's Department, the appropriate organization for the purposes of sub-regulation (1.) of this regulation is

(a) in the case of an office the duties of which are telecommunition duties, the Postal Telecommunications Technicians' Association (Australia) ; or

(b) in any other case, the Supervising Technicians' Association.".

11. Regulation 109e of the Public Service Regulations is repealed and the following regulation inserted in its stead:—

" 109e.—(1.) An. appeal by an officer performing his duties in the Northern Territory shall be inquired into and determined—

Appeals in relation to the Northern Territory and other Territories and places, outside Australia.

(a) in the case of an appeal against a provisional promotion to an office in the Department of Trade and Customs—in the same manner as an appeal would be inquired into and determined if the officer was performing his duties in the State of Queensland;

(b) in the case of an appeal against a provisional promotion to an office in the Postmaster-General's Department—in the same manner as an appeal would be inquired into and determined if the officer was performing his duties in the State of South Australia; and

(c) in any other case in the same manner as an appeal would be inquired into and determined if the officer was performing his duties in the Australian Capital Territory.

" (2.) An appeal in respect of an office in the Northern Territory shall be inquired into and determined—

(a) in the case of an appeal against a provisional promotion to an office in the Department of Trade and Customs—in the same manner as an appeal would be inquired into and determined if the office was an office in the State of Queensland;

(b) in the case of an appeal against a provisional promotion to an office in the Postmaster-General's Department—in the same manner as an appeal would be inquired into and determined if the office was an office in the State of South Australia; and

(c) in any other case—in the same manner as an appeal would be inquired into and. determined if the office was an office in the Australian Capital Territory.

"(3.) An appeal by an officer performing his duties in the Territory of Papua and New Guinea shall be inquired into and determined in the same manner us an appeal would be inquired into and determined if the officer was performing his duties in the State of Queensland.

" (4.) An appeal in respect of an office in the Territory of Papua and New Guinea shall be inquired into and determined in. the same manner as an appeal would be inquired into and determined if the office was an office in the State of Queensland.

" (5.) An appeal by an officer performing his duties in Norfolk Island shall he inquired into and determined in the same manner as an appeal would be inquired into and determined if the officer was performing his duties in the State of New South Wales.

" (6.) An appeal in respect of an office in Norfolk Island shall be inquired into and determined in the same manner as an appeal would be inquired into and determined if the office was an office in the State of New South. Wales.

" (7.) An appeal by an officer performing his duties in a place outside Australia (not being a place in a Territory specified in this regulation) shall be inquired into and determined in the same manner as an appeal would be inquired into and determined if the officer was performing his duties in the Australian Capital Territory.

" (8.) An appeal in respect of an office in a place outside the Commonwealth (not being a place in a Territory specified in this regulation) shall be inquired into and determined in the same manner as an appeal would be inquired into find determined if the office was an office in the Australian Capital Territory.".

Repeal of regulation 112a.

12. Regulation 112a of the Public Service Regulations is repealed.

Increments of salary.

13. Regulation 114 of the Public Service Regulations is amended by omitting from sub-regulation (3.) the word and figure "sub-section (3.)" and inserting in their stead the word and figure "sub-section (4.)".

Temporary transfers.

14. Regulation 116 of the Public Service Regulations is amended by omitting sub-regulation (1a.) and inserting in its stead the following sub-regulation:—

" (1a.) Where a temporary transfer is made for a period exceeding one month or where a temporary transfer exceeds that period—

(a) an officer who is senior to the officer temporarily transferred may appeal against the temporary transfer on the grounds that he is available for temporary transfer and—

(i) his efficiency is equal to the efficiency of the officer temporarily transferred; or

(ii) in the case of a temporary transfer to an office specified in regulation 109a of these regulations, he can efficiently discharge the duties of the office; and

(b) an officer who is junior to the officer temporarily transferred and occupies an office (not being an office specified in regulation 109a of these Regulations) having a higher classification than the office occupied by the officer temporarily transferred may appeal on the grounds that he is available for temporary transfer and that his efficiency is superior to that of the officer temporarily transferred.".

Repeal of Second and Third Schedules.

15. The Second and Third Schedules to the Public Service Regulations are repealed.

Fifth Schedule.

16. The Fifth. Schedule to the Public Service Regulations is repealed and the following Schedule inserted in its stead:

Regulation 106aa.

Allowances Payable to Certain Officers of the Fourth Division.

1. She shall be paid an allowance at the rate of £12 per annum if employed as a sewer

2. She shall be paid an allowance at the rate of 10s. per week while in charge of two or more Folders (Female)

3. She shall be paid an allowance to raise her salary to an annual standard salary at a rate of £365 per annum if, after completing five years' service, her salary is loss than that amount

1. She may be paid an allowance at the rate of £15 per annum while in charge of a country telephone exchange under such conditions as are, from time to time, determined by the Board

1. She may be paid an allowance at the rate of £15 per annum while in charge of a country telephone exchange under such conditions as are, from time to time, determined by the Board

Typist, (Female), Grade 1 ...........................................

1. An officer who has not attained the age of 21 years and who satisfies the Board as to her efficiency at writing and transcribing shorthand at the rate of 100 words per minute shall be granted an allowance at the rate of £24 per annum

2. An officer who has not attained the age of 21 years and who satisfies the Board as to her efficiency at writing and trans-scribing shorthand at the rate of 120 words per minute and her ability at transcribing or typing letters and documents with due regard to form and punctuation shall be granted—

(a) an allowance at the rate of £36 per annum if she is not in receipt of the allowance referred to the last preceding paragraph; or

(b) an allowance at the rate of £12 per annum if she is in receipt of the allowance referred to in the last preceding paragraph

3. She shall be paid an allowance at such rate as is determined from time to time by the Board, if regularly employed in taking notes of evidence in courts of law or on duties which in the opinion of the Board are of like character
