REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1951.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1951, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations. 

Rates of travelling allowance.

1.—(1.) Regulation 75a of the Public Service Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table :—

 (2.) Regulation 75a of the Public Service Regulations is amended by omitting from sub-regulation (2.) the words " Two pounds per day " and inserting in their stead the words " Two pounds seven shillings per day ".

(3.) This regulation shall be deemed to have come into operation on the eighteenth day of August, 1952.

Allowances to officers performing relieving duties or working within defined districts.

2.—(1.) Regulation 76 of the Public Service Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table:—

(2.) This regulation shall be deemed to have come into operation on the eighteenth day of August, 1952.

Allowances to veterinary officers and meat inspectors.

3.—(1.) Regulation 79b of the Public Service Regulations is amended by omitting the table from sub-regulation (1.) and inserting in its stead the following table:—

Fares.

4.—(1.) Regulation 84 of the Public Service Regulations is amended by omitting the figures " 656 " and inserting in their stead the figures " 650 ".

(2.) This regulation shall be deemed to have come into operation on the seventeenth day of March, 1952.

5. Regulation 87b of the Public Service Regulations is repealed and the following regulation inserted in its stead:—

Allowance to married minors.

" 87b.—(1.) Where a married male officer who has not attained the age of twenty-one years is in receipt of an actual salary at a rate less than the minimum rate of actual salary payable to an adult officer occupying the office of Labourer, Grade 1, or, if a higher minimum rate of actual salary is payable under a Determination of the Public Service Arbitrator to an adult officer occupying that office, the salary of such a married male officer is less than that higher minimum rate, that officer shall be paid an allowance, of an amount equal to the difference between the rate of actual salary payable to him and that minimum rate of actual salary or that higher minimum rate of salary, as the case requires.

" (2.) Where the salary of an officer in receipt of an allowance under this regulation is increased, the allowance payable to him shall be reduced by the amount of the increase, and upon the officer attaining the age of twenty-one years, the allowance shall cease to be payable.".

Car or cycle allowances.

6.—(1.) Regulation 90 of the Public Service Regulations is amended by omitting the table contained in sub-regulation (1.) and inserting in its stead the following table:—

1s. per mile for each mile up to 5,000 miles in any period of twelve months, and 9d. per mile for each mile over 5,000 miles in that period of twelve months

Motor truck of less than 1 ton capacity

The rate specified in this table for a motor car of the same horse-power plus 3/4 d. per mile

Motor car of over 12 horse-power

10d. per mile for each mile up to 5,000 miles in any period of twelve months, and 7d. per mile for each mile over 5,000 miles in that period of twelve months

Motor car of over 8 horse-power, but not over 12 horse-power

81/2 d. per mile for each miles up to 5,000 miles in any period of twelve months, and 51/2 d. per mile for each mile over 5,000 miles in that period of twelve months

Motor car of 8 horse-power or under

71/2 d. per mile for each mile up to 5,000 miles in any period of twelve months, and 41/2 d. per mile for each mile over 5,000 miles in that period of twelve months

Motor cycle with side car......................

41/2 d. per mile for each mile up to 5,000 miles in any period of twelve months, and 3d. per mile for each mile over 5,000 miles in that period of twelve months

Motor cycle..........................................

31/2 d. per mile for each mile up to 5,000 miles in any period of twelve months, and 21/2 d. per mile for each mile ever 5,000 miles in that period of twelve months

Bicycle.................................................

3d. per mile for each mile up to 20 miles on any journey, and 11/2 d. per mile for each mile over 20 miles on any journey

(2.) This regulation shall be deemed to have come into operation on the sixth day of August, 1952.

7.—(1.) After regulation 95d of the Public Service Regulations the following regulation is inserted :—

Bonus for telegraphy instructions.

" 95da. The Chief Officer or an Officer authorized in writing for the purposes of this regulation by the Chief Officer may, subject to such

conditions as the Board determines, grant to an officer of the Postmaster-General's Department who has successfully trained another officer of that Department in morse telegraphy a bonus of an amount not exceeding Fifteen pounds.".

Returning office.

8. Regulation 139 of the Public Service Regulations is amended by omitting the words " Territory for the Seat of Government " and inserting in their stead the words " Australian Capital Territory ".

9. Regulations 141a and 141b of the Public Service Regulations are repealed and the following regulations inserted in their stead :—

Qualifications of voters.

" 141a.—(1.) An officer of the Third Division who was an officer of that Division on the fourteenth day prior to nomination day shall be entitled to vote at the election of a Representative of that Division for the State in which he was then permanently stationed.

" (2.) An officer of the Fourth Division who was an officer of that Division on the fourteenth day prior to nomination day shall be entitled to vote at the election of a Representative of that Division in the State in which he was then permanently stationed.

List of voters.

" 141b. The Chief Officer of each Department shall cause to be prepared and shall certify and transmit, in duplicate, to the Returning Officer, so as to reach him not later than thirty days after nomination day, separate lists, in respect of the Third Division and the Fourth Division, containing the name of each officer who was, on the fourteenth day prior to nomination day, permanently stationed in the State, the branch in which each officer was employed and the official address of each officer.".

Nominations.

10. Regulation 141c of the Public Service Regulations is amended—

(a) by omitting from sub-regulation (3.) all the words from and including the words " shall be in accordance with the following form " to the end of that sub-regulation and inserting in their stead the words " may be in accordance with Form A in the Sixth Schedule to these Regulations."; and

(b) by inserting at the end thereof the following sub-regulations :—

" (4.) The person nominated shall, in the presence of a witness, sign his consent to the nomination and shall declare that he is eligible for nomination under these Regulations.

" (5.) The consent and declaration of the person nominated may be in accordance with Form B in the Sixth Schedule to those Regulations and may be endorsed on the form of nomination.".

Proceedings after nomination.

11. Regulation 141b of the Public Service Regulations is amended by omitting sub-regulations (2.), (3.) and (4.) and inserting in their stead the following sub-regulations :—

" (2.) Where more than one candidate is nominated, the Returning Officer shall, not later than thirty days prior to the date fixed for the close of the Poll, send to the Chief Officer or, if there be no Chief Officer in the State, to an officer in the Department nominated by the Chief Officer—

(a) one ballot-paper and one ballot-paper envelope for each officer whose name appears on the list furnished by the Chief Officer in accordance with regulation 141b of these Regulations ; and

(b) the duplicate of that list.

" (3.) The Returning Officer or an Assistant Returning Officer shall initial each ballot-paper before sending it in accordance with the last preceding sub-regulation.

" (4.) Each ballot-paper and ballot-paper envelope shall be enclosed by the Returning Officer in a covering envelope which shall be fastened and addressed to the officer for whom it is intended.

" (4A.) The Chief Officer or an officer appointed by him shall, as soon as practicable after the receipt by him of the covering envelopes, cause them to be delivered, or sent by post, to the officers to whom they are addressed.".

12. Regulation 141F of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Ballot-papers and manner of voting.

" 141F.—(1.) The ballot-paper may be in accordance with Form C in the Sixth Schedule to these Regulations.

" (2.) The ballot-paper envelope shall be addressed to the Returning Officer and shall have printed on it a declaration which may be in accordance with Form D in the Sixth Schedule to these Regulations.

" (3.) A voter shall mark his vote on the ballot-paper by placing the number 1 in the square opposite the name of the candidate for whom he votes as his first preference and the numbers 2, 3, 4 (and so on, as the case requires) in the squares opposite the names of all the remaining candidates so as to indicate the order of his preference for them.

" (4.) After marking his vote the voter shall fold the ballot-paper, place it in the ballot-paper envelope, complete and sign the declaration printed on the ballot-paper envelope and send the ballot-paper envelope containing the ballot-paper by post or otherwise so as to reach the Returning Officer not later than noon on the date fixed for the close of the poll.".

Custody of ballot-papers and scrutiny.

13. Regulation 141g of the Public Service Regulations is amended by omitting paragraph (b) of sub-regulation (2.) and inserting in its stead the following paragraph :—

" (b) if satisfied that the declaration on the envelope has been effectively completed and signed and that the person who signed the declaration is entitled to vote at the election, accept the ballot-paper for further scrutiny, but, if not so satisfied, disallow the ballot-paper without opening the envelope ; and ".

Powers of Disputes Committees.

14. Regulation 141o of the Public Service Regulations is amended by omitting from paragraph (c) of sub-regulation (1.) the words " and signatures ".

Term of office during war.

15. Regulation 141qa of the Public Service Regulations is repealed,

16. Regulation 141v of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Federal Territories.

" 141v. For the purpose of this Part, the Territories of Papua and New Guinea shall ho deemed to be part of the State of Queensland and the Northern Territory of Australia shall be deemed to be part of the State of South Australia.".

17. Regulation 141w of the Public Service Regulations is repealed.

Examinations accepted in the case of returned soldiers.

18.—(1.) Regulation 159 of the Public Service Regulations is amended—

(a) by omitting the words—

" Examinations hold by the Adelaide University, viz,:—

Higher, Senior Public, Senior Commercial, Junior Public, and Junior Commercial."

and inserting in their stead the words—

" Examinations held by the Adelaide University, namely :—

Higher, Senior Public, Senior Commercial, Junior Public, Junior Commercial, Leaving Honours, Leaving, Leaving Commercial, Intermediate and Intermediate Commercial.";

(b) by omitting the words " For appointment to the Administrative and Instructional Staff." from the words under the heading " Examinations held by the Department of Defence,"; and

(c) by omitting the words—

" Examination held by the Sydney Technical College, viz.:—

" The Diploma Preparatory Course, Stage I." and inserting in their stead the words—

" Examinations held at the Sydney Technical College by the Department of Education, New South Wales, namely:—

Diploma Preparatory Stage I., Special Entrance, Diploma Preparatory Stage II., Diploma Preparatory Stage III. and Diploma Entrance.

" Examinations hold by the Department of Technical Education, New South Wales, namely:—

Certificate Entrance, Certificate Entrance (Deferred), Qualifying and Matriculation Stage I., Qualifying and Matriculation Stage II., Qualifying and Qualifying (Deferred).".

(2.) This regulation shall be deemed to have come into operation on the thirtieth day of June, 1951.

The schedules.

19. After the Fifth Schedule to the Public Service Regulations the following Schedule is inserted:—

Directions.—Mark your vote on this ballot-paper by placing the number 1 in the square opposite the name of the candidate for whom you vote as first preference and the numbers 2, 3, 4 (and so on, as the case requires) in the squares opposite the names of the candidates so as to indicate the order of your preference for them, fold the ballot-paper and place it in the ballot-paper envelope which should then be sealed. Then complete and sign the declaration printed on the ballot-paper envelope and send that envelope containing the ballot-paper by post or otherwise to the Returning Officer so as to reach him not later than 12 o'clock noon on the day of , 195 .
