REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1953.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1953, hereby makes, subject to the approval of the Governor-General, the following Regulations.

AMENDMENTS OF THE PUBLIC SERVICE REGULATIONS. 

1.Regulation 47 of the Public Service Regulations is repealed and the following regulation inserted in its stead:—

Deductions from recreation leave on account of other absences.

“47.—(1.) Where an officer has, during the period of twelve months immediately preceding the date as from which he is granted leave of absence for recreation, been absent from duty for more than fifty-one working days, the period of leave of absence for recreation which may be granted to the officer shall, subject to this regulation, be reduced by one-twelfth of the period of leave of absence to which the

officer is entitled under section 68 of the Act for each twenty-six working days (other than the first twenty-six working days) on which the officer has been absent from duty during that period.

“(2.) Where an officer has, during the period of twelve months immediately preceding the date as from which he is granted leave of absence for recreation, been absent with leave granted under—

(a) section 69, 70 or 72 of the Act;

(b) regulation 45, 50, 52 or 53 of these Regulations;

(c) the order for a common rule made by the Public Service Arbitrator on the twenty-fourth day of September, 1925, and known as Determination No. 24 of 1925, or that order as varied from time to time; or

(d) the order for a common rule made by the Public Service Arbitrator on the fifth day of September, 1951, and known as Determination No. 119 of 1951, or that order as varied from time to time,

the period for which the officer was so absent from duty shall not be taken into account for the purposes of the last preceding sub-regulation.

“(3.) Where, by reason of the operation of paragraph (b) of sub-section (4.) of section 73 of the Public Service Act 1922-1950, an officer was not granted leave of absence for recreation or a period of leave of absence for recreation was regarded as part of the period of leave of absence under that section and that officer is granted leave of absence under section 73 of the Public Service Act 1922-1953, the period for which the officer is absent on that last-mentioned leave of absence shall not be taken into account for the purposes of sub-regulation (1.) of this regulation.".

Short leave and leave for examinations.

2.—(1.) Regulation 50 of the Public Service Regulations is amended by inserting after sub-regulation (1.) the following sub-regulation:—

"(1A.) Where—

(a) an officer is required to attend for the purpose of an interview or a medical examination in connexion with his enlistment or proposed enlistment in the Citizen Naval Forces, the Citizen Military Forces, the Citizen Air Force or the Royal Australian Air Force Active Reserve; and

(b) the officer is not eligible for the grant of leave of absence under the last preceding sub-regulation,

the Chief Officer may grant to the officer leave of absence to attend for the purpose of the interview or medical examination.".

(2.) This regulation shall be deemed to have come into operation on the third day of September, 1952.

3. Regulations 51 and 51A of the Public Service Regulations are repealed and the following regulations inserted in their stead:—

Prescribed defence purposes

“51.—(1.) Each of the following is a prescribed service; for the purposes of paragraph (a) of sub-section (1.) of section 72 of the Act:–

(a) service in time of war as a member of the Defence Force or of another force referred to in that paragraph;

(b) service as a member of a part of the Defence Force or of another force referred to in that paragraph which has been allotted for duty in an area in which the forces of the United Nations are engaged in warlike operations.

(c) annual training as a member of the Citizen Naval Forces, the Citizen Military Forces, the; Citizen Air Force or the Royal Australian Air Force Active Reserve;

(d) attendance at a school, class or course of instruction conducted for the training of members of the Citizen Naval Forces, the Citizen Military Forces or the Citizen Air Force; and

(e) service on full-time duties as a member of the Citizen Naval Forces, the Citizen Military Forces, the Citizen Air Force or the Royal Australian Air Force Active Reserve for or in connexion with the training of persons liable to training under the National Service Act 1951-1953.

“(2.) In this regulation, 'time of war' has the same meaning as in the Defence Act 1903-1953.

Conditions on which leave of absence is granted in time of war or to engage in warlike operation.

"51A.—(1.) Leave of absence to enable an officer or employee to engage in a service specified in paragraph (a) or (b) of sub-regulation (1.) of the last preceding regulation shall be granted to the officer or employee on full salary for the first fourteen days on which the officer or employee is granted leave of absence and without pay for the remainder of the period for which the officer or employee is granted leave of absence.

“(2.) An employee shall not be granted leave of absence to engage in a service so specified beyond the date on which he would, if he had not been granted leave of absence, have ceased duty as an employee.

“(3.) In this regulation, 'salary' includes an allowance specified in regulation 62 of these Regulations.

Periods of Leave—Citizen forces.

"51B.—(1.) Subject to this regulation, leave of absence to enable an officer or employee to engage in the service specified in paragraph (c) of sub-regulation (1.) of regulation 51 of these Regulations shall not, in any one year, exceed—

(a) where the officer or employee is a member of the Citizen Naval Forces—thirteen days inclusive of Saturdays and Sundays;

(b) where the officer or employee is a member of the Citizen Military Forces—fourteen days inclusive of Saturdays and Sundays;

(c) where the officer or employee is a member of the Citizen Air Force—sixteen days inclusive of Saturdays and Sundays; and

(d) where the officer or employee is a member of the Royal Australian Air Force Active Reserve—twenty-eight days inclusive of Saturdays and Sundays.

“(2.) Leave of absence to enable an officer or employee to engage in a service specified in paragraph (d) of sub-regulation (1.) of regulation 51 of these Regulations shall not, in any one year, exceed—

(a) where the officer or employee is a member of the Citizen Naval Forces—thirteen days inclusive of Saturdays and Sundays;

(b) where the officer or employee is a member of the Citizen Military Forces—sixteen days inclusive of Saturdays and Sundays; and

(c) where the officer or employee is a member of the Citizen Air Force—sixteen days inclusive of Saturdays and Sundays.

“(3.) Leave of absence to enable an officer or employee to engage in a service specified in paragraph (a) of sub-regulation (1.) of regulation 51 of these Regulations shall not exceed nine months in any one continuous period of absence.

“(4.) Where the Chief Officer is satisfied that special circumstances exist which justify the grant of leave of absence to an officer or employee to engage in a service specified in paragraphs (c), (d) or (e) of sub-regulation (1.) of regulation 51 of these Regulations exceeding the period specified in sub-regulations (1.), (2.) or (3.) of this regulation, the period for which, that leave of absence may be granted shall be such as the Chief Officer determines.

“(5.) An employee shall not be granted leave of absence to engage in a service specified in paragraphs (c), (d) or (e) of sub-regulation (1.) of regulation 51 of these Regulations beyond the date on which ho would, if he had not been granted leave of absence, have ceased duty as an employee.

“(6.) Where, in the opinion of the Chief Officer, it would not, at any time, be in the public interest to grant to an officer or employee leave of absence to attend at an annual training or at a school, class or course of instruction, the Chief Officer shall not grant the leave of absence at that time, but shall grant leave of absence to the officer or employee to attend at an equivalent training or at an equivalent school, class or course of instruction.

“(7.) In this regulation, 'year' means a period commencing on the first day of July and ending on the next succeeding thirtieth day of June.

Applications for Defence Leave.

"51C. Leave of absence shall not be granted under section 72 of the Act unless the officer or employee makes written application for the grant of that leave and submits with the application evidence that he is required to engage in a service prescribed by regulation 51 of these Regulations.

Certificate of engaging in Defence Service.

"51D. An officer or employee who has been granted leave of absence to engage in a service specified in paragraphs (c), (d) or (e) of sub-regulation (1.) of regulation 51 of these Regulations shall, at the expiration of that leave submit to the Chief Officer a certificate by his Commanding Officer specifying the period for which he was engaged in that service.

“51E.—(1.) Except as provided by this regulation, leave of absence Pay granted to an officer or employee to engage in a service specified in paragraph (c), (d) or (e) of sub-regulation (1.) of regulation 51 of these Regulations shall be without salary.

“(2.) Where the remuneration payable to an officer or employee as a member of the Citizen Naval Forces, the Citizen Military Forces, the Citizen Air Force or the Royal Australian Air Force Active Reserve is, during the period for which he is granted leave of absence to engage in a service specified in paragraphs (c), (d) or (e) of sub-regulation (1.) of regulation 51 of these Regulations, less than the salary which the officer or employee would have received during that period as an officer or employee, the officer or employee shall be paid an amount equal to the difference.

“(3.) Where an officer or employee

(a) who was, on the third day of January, 1951, a member of the Citizen Naval Forces, the Citizen Military Forces or the Citizen Air Force; and

(b) who is, after the date of commencement of this regulation, liable to serve as such a member under the same appointment, engagement or re-engagement under which he was serving on the third day of January, 1951,

is granted leave of absence to enable him to engage, under that appointment, engagement or re-engagement, in a service specified in paragraphs (c) or (d) of sub-regulation (1.) of regulation 51 of these Regulations, the officer or employee shall be paid, during the period for which he would have been eligible for the grant of leave under regulation 51A of these Regulations as in force immediately before the commencement of this regulation, pay in accordance with that regulation.

“(4.) For the purposes of sub-regulations (1.) and (2.) of this regulation, 'salary' includes an allowance specified in paragraphs (c), (d), (e), (f), (g), (h), (i), (k), (l) or (m) of regulation 62 of these Regulations and, subject to the next succeeding sub-regulation, an allowance payable under regulation 87 of these Regulations.

“(5.) An allowance payable under regulation 87 shall not be included as salary for the purposes of sub-regulations (1.) and (2.) of this regulation, unless—

(a) the allowance has been paid for not less than one month before the date on which the officer or employee is granted leave under section 72 of the Act; and

(b) the officer would have been paid the allowance if he had not been granted the leave of absence.".

Recording and payment of overtime.

4.—(1.) Regulation 67 of the Public Service Regulations is amended by omitting from sub-regulation (14.) the words "four shillings and sixpence" and inserting in their stead the words "Twelve shillings and sixpence".

Meal allowances.

5.—(1.) Regulation 68 of the Public Service Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in their stead the following sub-regulation :—

“(1.) Subject to this regulation, an officer or employee who—

(a) is required, after the completion of his ordinary hours of duty for the day, to perform duty after a break for a meal which occurs after that completion and is not entitled to payment for that break;

(b) is required, after the completion of his ordinary hours of duty for the day, to perform extra duties which involve his attendance without a break up to the completion of, or after, the meal period which occurs next after that completion;

(c) is required to perform extra duty after two o'clock in the afternoon on Saturday (or the day normally allowed to him as the weekly half-holiday) after a meal break and is not entitled to payment for that meal break; or

(d) is required to perform duty on a Sunday or public holiday (in addition to his normal weekly hours of duty) extending beyond a meal break and is not entitled to payment for that meal break, shall be paid a meal allowance of Seven shillings."; and

(b) by omitting sub-regulation (4.) and inserting in its stead the following sub-regulation:

“(4.) For the purposes of paragraph (b) of sub-regulation (1.) of this regulation, 'meal period' means—

(a) the period between the hours of 7 a.m. and 9 a.m.;

(b) the period between the hours of 12 noon and 2 p.m.;

(c) the period between the hours of 6 p.m. and 7 p.m.; and

(d) the period between the hours of 12 midnight and 2 a.m.".

(2.) This regulation shall be deemed to have come into operation on the sixteenth day of April, 1953.

Railway travelling.

6.—(1.) Regulation 83 of the Public Service Regulations is amended by omitting from sub-regulation (2.) the figure "5'' and inserting in its stead the figures "10".

(2.) This regulation shall be deemed to have conic into operation on the seventeenth day of January, 1953.

Higher duties.

7. Regulation 87 of the Public Service Regulations is amended—

(a) by omitting from paragraph (e) of sub-regulation (10.) the word and figures "or 51"; and

(b) by inserting after paragraph (e) of that sub-regulation the following paragraph:—

"(ea) leave granted under section 72 of the Act;".

8. After regulation 95C of the Public Service Regulations the following regulation is inserted:—

Bonus for telegraphy instructions.

"95D. The Chief Officer or an officer authorized in writing for the purposes of this regulation by the Chief Officer may, subject to such conditions as the Board determines, grant to an officer of the Postmaster-General's Department who has successfully trained another officer of the Department in morse telegraphy a bonus of an amount not exceeding Fifteen pounds.".

Repeal of regulation 95DA.

9. Regulation 95DA of the Public Service Regulations is repealed.

Promotion on the basis of senior efficient officer available.

10.—(1.) Regulation 109G of the Public Service Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) The following offices arc prescribed offices for the purposes of sub-section (3A.) of section 50 of the Act:—

Recreation leave for temporary employees.

11.Regulation 137 of the Public Service Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations :—

“(1.) Leave of absence for recreation granted under sub-section (8.) of section 82 of the Act shall not exceed in any year—

(a) in the case of a temporary employee other than a temporary employee referred to in either of the next two succeeding paragraphs—eighteen days, exclusive of Sundays and holidays;

(b) in the case of temporary employees employed at lighthouses—twenty-four days exclusive of Sundays and holidays; and

(c) in the case of temporary employees employed as Firemen in the Canberra Fire Brigade—twenty-eight days inclusive of Sundays but exclusive of holidays.

"(1A.) Where an employee has, during the period of twelve months immediately preceding the date as from which he is granted leave of absence for recreation, been absent from duty for more than fifty-one working days, the period of leave of absence for recreation which may be granted to the employee shall, subject to this regulation, be reduced by one-twelfth of the period of leave of absence to which the employee is entitled under sub-regulation (1.) of this regulation for each twenty-six working days (other than the first twenty-six working days) on which the employee has been absent from duty during that period.

“(1B.) Where an employee has, during the period of twelve months immediately preceding the date as from which he is granted leave of absence for recreation, been absent with leave granted under—

(a) section 72 of the Act;

(b) regulation 138 of these Regulations;

(c) the order for a common rule made by the Public Service Arbitrator on the twenty-fourth day of September, 1925, and known as Determination No. 24 of 1925, or that order as varied from time to time;

(d) the order for a common rule made by the Public Service Arbitrator on the fifth day of September, 1951, and known as Determination No. 119 of 1951, or that order as varied from time to time; or

(e) a determination or order made by the Public Service Arbitrator providing for the grant of leave of absence to an employee for the purpose of—

(i) attending as a witness in any proceedings or matter;

(ii) attending as a witness in proceedings under the Public Service Arbitration Act 1920-1952;

(iii) preparing evidence for submission in proceedings under the Public Service Arbitration Act 1920-1952; or

(iv) attending at an examination held in pursuance of the Act, the period for which the officer was so absent from duty shall not be taken into account for the purposes of the last preceding sub-regulation.".

12. The First Schedule to the Public Service Regulations is amended—

(a) by omitting designation numbers 496, 497, 603, 616, 645, 646 and 651 and the particulars opposite to those numbers;

Second Schedule

13. The Second Schedule is amended by omitting item number 29 and inserting in its stead the following item:—

"29 Typist (Female), Grade 1

1. An officer who has not attained the age of 21 years and who satisfies the Board as to her efficiency at writing shorthand at the rate of 100 words per minute and correctly transcribing that short hand shall be paid an allowance at the rate of £36 per annum.

2. An officer shall be paid an allowance at the rate of £24 per annum if—

(a) she has not satisfied the Board as to her efficiency at writing shorthand at the rate of not less than 100 words per minute;

(b) she has passed a test conducted by or on behalf of the Board in typing at the rate of 60 words per minute and in typing letters and documents with due regard to punctuation and form; and

(c) her rate of standard salary does not exceed £431 per annum.

3. She shall be paid an allowance at such rate as is determined from time to time by the Board for any period during which she is employed on taking or transcribing notes of evidence in courts of law, or on duties which in the opinion of the Board are of like character.".
