REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922–1955.*

WHEREAS by sub-section (3.) of section three of the Salaries Adjustment Act 1956 it is provided that regulations may be made under the Public Service Act 1922-1955 for purposes of or in relation to a reclassification referred to in sub-section (1.) of that section of offices to which the latter Act applies and that regulations so made shall be deemed to have come into operation on the tenth day of January, 1956:

Now therefore the Public Service Board, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1955 and by virtue of the Salaries Adjustment Act 1956, hereby makes, subject to the approval of the Governor-General, the following Regulations.

AMENDMENTS OF THE PUBLIC SERVICE REGULATIONS. 

Calculation of pay for duty on a holiday.

1. Regulation 63 of the Public Service Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (b) of sub-regulation (4.) the figures “£1,142” and inserting in their stead the figures “£1,173”:

Recording and payment of overtime.

2. Regulation 67 of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (6B.) the figures “£1,142” and inserting in their stead the figures “£1,173”;

(b) by omitting from paragraph (b) of sub-regulation (6B.) the figures “£988” and inserting in their stead the figures “£1,019”;

(c) by omitting from paragraph (a) of sub-regulation (6D.) the figures “£1,814” and inserting in their stead the figures “£1,943”;

(d) by omitting from paragraph (b) of sub-regulation (6D.) the figures “£1,660” and inserting in their stead the figures “£1,789”;

Travelling time.

3.Regulation 69 of the Public Service Regulations is amended by omitting the words “rate exceeding £1,142 per annum or a female officer who is in receipt of a salary not exceeding £988” and inserting in their stead the words “rate not exceeding £1,173 per annum or a female officer who is in receipt of a salary at a rate not exceeding £1,019”.

Sunday duty.

4. Regulation 70 of the Public Service Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (d) of sub-regulation (5.) the figures “£1,814” and inserting in their stead the figures “£1,943”;

(b) by omitting from sub-paragraph (ii) of that paragraph the figures “£1,660” and inserting in their stead the figures “£1,789”;

(c) by omitting from paragraph (a) of sub-regulation (5A.) the figures “£1,142” and inserting in their stead the figures “£1,173”; and

(d) by omitting from paragraph (b) of that sub-regulation the figures “£988” and inserting in their stead the figures “£1,019”.

5. Regulation 75A of the Public Service Regulations is amended by omitting the table in sub-section (1.) and inserting in its stead the following table:—

7.Regulation 84 of the Public Service Regulations is amended by omitting the figures “£928” and inserting in their stead the figures “£938”.

Higher duties.

8. Regulation 87 of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (3.) the figures “£1,038” and inserting in their stead the figures “£1,083”;

(b) by omitting from paragraph (b) of that sub-regulation the figures “£904” and inserting in their stead the figures “£929”;

(c) by omitting from paragraph (a) of sub-regulation (17.) the figures “£1,730” and inserting in their stead the figures “£1,833”; and

(d) by omitting from paragraph (b) of that sub-regulation the figures “£1,576” and inserting in their stead the figures “£1,679”.

Partial reimbursement of faros of certain officers.

9. Regulation 98AA of the Public Service Regulations is amended by omitting from paragraph (b) of sub-regulation (1.) the figures “£780” and inserting in their stead the figures “£749”.

Allowance— Sunday or holiday duty.

10. Regulation 99 of the Public Service Regulations is amended—

(a) by omitting the figures “£1,814” and inserting in their stead the figures “£1,943”; and

(b) by omitting the figures “£1,660” and inserting in their stead the figures “£1,789”.

11. Parts IV. and V. of the Public Service Regulations are repealed and the following Parts inserted in their stead:—

Salaries payable to officers of the Second of Third Division.

“104.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to a male officer who occupies an office in the Second Division or the Third Division is, subject to this regulation, that rate or scale of rates specified in Table A or Table B in this sub-regulation which is applicable to that office by virtue of its classification.

“(2.) Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is a rate of annual salary applicable to that office by virtue of its classification, the rate of annual salary payable to the female officer in respect of that office is £154 less than the rate so specified.

“(3.) Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is applicable to that office by virtue of its classification a scale of rates specified in Table A or Table B in sub-regulation (1.) of this regulation, the rates of annual salary payable to the female officer in respect of that office are each £154 less than the rates so specified.

“(4.) The rate of annual salary payable to a male officer who is of an age specified in the first column of the table in this sub-regulation and occupies an office in the Third Division the minimum of the scale of rates of annual salary of which is less than £723 is the rate of annual salary specified in the second column of that table opposite to the age of the officer.

“(8.) The minimum rate of annual salary payable to an officer appointed under section 36A of the Act, or appointed to an office in the Third Division who is eligible for admission to a degree at an Australian University or a University approved by the Board for the purpose of this sub-regulation, is—

(a) in the case of a male officer who has not attained the age of twenty-one years—£616;

(b) in the case of a female officer who has not attained the age of twenty-one years—£505;

(c) in the case of a male officer who has attained the age of twenty-one years—£858; and

(d) in the case of a female officer who has attained the age of twenty-one years—£704.

“(9.) The rate of annual salary or the scale of rates of annual salary payable to an officer of the Third Division who occupies an office of—

(a) Postal Clerk;

(b) Telegraphist;

(c) Communications Officer;

(d) Senior Communications Officer, Grade 1;

(e) Senior Communications Officer, Grade 2;

(f) Senior Communications Officer, Grade 3;

(g) Senior Communications Officer, Grade 4; or

(h) Senior Communications Officer, Grade 5,

is the annual salary, or the scale of rates of annual salary, as the case may be, specified for that office in Part I. or Part II. of the First Schedule to these Regulations.

Allowance in addition to salary.

“105.—(1.) An officer who is engaged, at such offices as the Board determines, on the regular exchange of duties with the Supervisor in charge of the evening staff for one day in three, or one week in three, shall, with the approval of the Chief Officer, be paid an allowance to increase his salary—

(a) if relieving a Supervisor (Telegraphs), Grade 1—to the minimum salary of a Supervisor (Telegraphs), Grade 1; or

(b) if relieving a Supervisor (Telegraphs), Grade 2—to the salary of a Supervisor (Telegraphs), Grade 1, who has been granted one increment over the minimum salary of a Supervisor (Telegraphs), Grade 1.

“(2.) Where the officer next in seniority to the Postmaster or the Supervisor, as the case may be, at a station to which this sub-regulation applies, is in receipt of salary, including any allowance payable under sub-regulation (5.) of this regulation, less than the equivalent of the maximum salary of the office of Telegraphist in the Fourth Division plus an amount equal to the last increment payable within the scale of rates of annual salary of a Fourth Division Telegraphist, the Chief Officer may, upon satisfactory evidence of competency to attend to repeaters in the absence of the Postmaster or the Supervisor in charge, grant an allowance to that officer at the rate of £30 per annum.

“(3.) The stations to which the last preceding sub-regulation applies are—

Mount Surprise, Queensland; Alice Springs, Northern Territory ; and Mullewa and Marble Bar, Western Australia.

“(4.) A telegraphist who has passed the examination for promotion to an office of Senior Telegraphist may, with the approval of the Chief Officer, be paid an allowance at the rate of £12 per annum until he is promoted to a higher office.

“(5.) A telegraphist in the Third Division upon passing an examination approved by the Board for the purpose of this sub-regulation shall be paid an allowance at the rate of £30 per annum in addition to the rate of salary payable to him under these Regulations.

“(6.) A telegraphist in the Third Division shall be paid an allowance at the rate of £30 per annum when restored for picturegram duty.

PART V.—SALARIES PAYABLE TO OFFICERS OF THE FOURTH DIVISION.

Salaries of officers of the Fourth Division.

“106.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office the designation of which is specified in the second column of Part I. or Part II. of the First Schedule to these Regulations is, subject to this regulation, the rate of annual salary or the scale of rates of annual salary specified in the fifth column of that Part opposite to the designation of the office occupied by the officer.

“(2.) Where an annual rate of salary according to age is specified in the fifth column of Part I. or Part I. of the First Schedule to these Regulations opposite to the designation of an office specified in the second column of that Part, the annual salary payable to an officer who occupies such an office and is of an age specified in the fifth column of that Part is the rate specified in that column for that age.

“(3.) Where a female officer occupies an office the designation of which is specified in Part I. of the First Schedule to these Regulations, being an office opposite to the designation of which an annual rate of salary (not being an annual rate of salary according to age) is specified in the fifth column of that Part, the annual rate of salary payable to the female officer in respect of that office is £154 less than the rate so specified.

“(4.) Where a female officer occupies an office the designation of which is specified in Part I. of the First Schedule to these Regulations, being an office opposite to the designation of which a scale of rates of annual salary is specified in the fifth column of that Part, the rates payable to the female officer in respect of that office are, subject to sub-regulation (5.) of this regulation, each £154 less than the rates so specified.

“(5.) Where a female officer who is of an age specified in the second column of the table in this sub-regulation occupies an office, being an office the designation of which is specified in Part I. of the First Schedule to these Regulations, the designation of which is specified in the first column of that table, the annual rate of salary payable to the female officer is the rate specified in the third column of that table opposite to the age of the female officer.

“(8.) The rate of annual salary payable to an officer who occupies an office of Typist (Female) is the rate of salary ascertained in relation to the officer in accordance with Part III. of the First Schedule to these Regulations by virtue of—

(a) the qualifications of the officer; and

(b) the period of service of the officer or the age of the officer, whichever results in the higher rate of salary.

“(9.) The rate of annual salary payable to an officer who occupies an office of Accounting Machinist (Female) Grade 1 is the rate of salary ascertained in relation to the officer in accordance with Part IV. of the First Schedule to these Regulations by virtue of—

(a) the qualifications of the officer; and

(b) the period of service of the officer or the age of the officer, whichever results in the higher rate of salary.

“(10.) For the purposes of either of the last two preceding sub-regulations—

(a) an officer who occupies, on the day immediately preceding the date on which she attains the age of twenty-one years, an office of Typist (Female) or Accounting Machinist (Female) Grade 1 shall be deemed to have completed not less than four years’ service on that date and not less than five, six, seven and eight years’ service on the dates on which she attains the ages of twenty-two, twenty-three, twenty-four and twenty-five years, respectively;

(b) an officer who has attained the age of twenty-one years before she is appointed, promoted or transferred to the office of Typist (Female) shall, on appointment, promotion or transfer be deemed to have completed not less than four years’ service and five, six, seven and eight years’ service on the first, second, third and fourth anniversaries, respectively, of her appointment, promotion or transfer; and

(c) ‘service’ means—

 (i) service in one or more of the positions of Typist (Female), Grade 1, Typist (Female) or Accounting Machinist Grade 1; and

(ii) proved typing and accounting machining experience or proved typing or proved accounting machining experience either within or without the Commonwealth Service.

“(11.) Where a Department or a section of a Department is not specified in the third or fourth columns of Part I. and Part II. of the First Schedule to these Regulations opposite to the designation of an office, the rate of annual salary or the scale of rates of annual salary payable to an officer occupying an office of that designation in a Department or section of a Department is the rate or scale of rates specified in the fifth column of that Part opposite to that designation.

“(12.) Where—

(a) an officer occupies an office specified in the first column of the Second Schedule to these Regulations; or

(b) an employee is employed in an office specified in the first column of the Second Schedule to these Regulations,

and the officer or employee has the qualifications, or complies with the conditions relating to an allowance, specified in the second column of that Schedule opposite to the designation of the office, he shall be paid an allowance at the rate specified in that column in respect of those qualifications or conditions.”.

Maximum salary for purposes of certain appeals.

12. Regulation 109H of the Public Service Regulations is repealed and the following regulation inserted in its stead:—

“109H. The maximum rate of salary for the purpose of sub-section (8B.) of section 50 of the Act is—

(a) in the case of an office in the Third Division or an office specified in Part I. of the First Schedule to those Regulations—a salary at the rate of £1,173 per annum; and

(b) in the case of an office specified in Part II. of that Schedule a salary at the rate of £1,019 per annum.”.

Conditions of transfer from Fourth Division to Third Division.

13.Regulation 112 of the Public Service Regulations is amended by omitting from sub-regulation (2.) the figures “£890” and inserting in their stead the figures “£903”.

Phonogram Operator (Female)..........................................................................

1. She shall be paid an allowance at the rate of £20 per annum on evidence to the satisfaction of the Board of ability to accept by telephone, in fifteen minutes, ten typical telegrams, averaging an equivalent of six message units per telegram, and to record such telegrams by typewriter in the standard manner laid down by the Chief Officer.

Stenographer (Female)..........................................................................

1. She shall be paid an allowance at such rate as is determined from time to time by the Board for any period during which she is employed on taking or transcribing notes of evidence in courts of law, or on duties which in the opinion of the Board are of like character.

Supervisor (Female), Telephone Branch, Postmaster-General’s Department

1. She may be paid an allowance at the rate of £30 per annum while in charge of a country telephone exchange.

Typist (Female)..........................................................................

1. She shall be paid an allowance at the rate of £24 per annum if—

(a) she has not satisfied the Board as to her efficiency at writing shorthand at the rate of not less than 100 words per minute;

(b) she has passed a test conducted by or on behalf of the Board in typing at the rate of 60 words per minute and in typing letters and documents with due regard to punctuation and form; and

(c) her rate of salary does not exceed £614 per annum.

2. She shall be paid an allowance at such rate as is determined by the Board for any period during which she is employed on taking or transcribing notes of evidence in courts of law, or on duties which in the opinion of the Board are of like character.

1. She shall be paid an allowance at such rate as is determined by the Board for any period during which she is employed on taking or transcribing notes of evidence in courts of law, or on duties which in the opinion of the Board are of like character.
