REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1957.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1957, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations. 

Officers called as witnesses.

1. Regulation 45 of the Public Service Regulations is amended—

(a) by omitting sub-regulation (2.) and inserting in its stead the following sub-regulations:—

"(2.) An officer who is required to attend, whether as a result of having been served with a subpoena or otherwise, to give evidence—

(a) on behalf of the Commonwealth or an authority established by or under a law of the Commonwealth or a law of a Territory of the Commonwealth in a judicial proceeding;

(b) on behalf of the Crown or an informant or complainant, being an officer of the Commonwealth acting in the course of his duties, in a prosecution for an offence against a law of the Commonwealth or a law in force in a Territory of the Commonwealth;

(c) before a Royal Commission appointed under a law of the Commonwealth or a person conducting an inquiry under a law of the Commonwealth or a law in force in a Territory of the Commonwealth;

(d) at the instance of a person or authority exercising arbitral functions by virtue of a law of the Commonwealth or a law in force in a Territory of the Commonwealth; or

(e) on behalf of the Commonwealth or an authority established by or under a law of the Commonwealth or a law of a Territory of the Commonwealth before a person or authority exercising arbitral functions by virtue of a law of the Commonwealth or a law in force in a Territory of the Commonwealth,

shall be granted leave of absence with pay during such period as is necessary to enable the officer to attend in accordance with the requirement and, if it is necessary for the officer to travel for the purpose of so attending, the officer shall, for the purposes of the payment of travelling allowances and expenses, be entitled to the payment of travelling allowances and expenses on the same basis as if the officer had travelled in the course of his duties.

"(2a.) An officer who, by reason of attending to give evidence in any of the circumstances referred to in the last preceding sub-regulation, receives payment, other than payment of travelling allowances and expenses by reason of the operation of that sub-regulation, of witnesses expenses shall pay the amount received to the Commonwealth.''

(b) by omitting from sub-regulation (3.) the words "into the Consolidated Revenue" and inserting in their stead the words "to the Commonwealth";

(c) by inserting after sub-regulation (3.) the following sub-regulation:—

"(3a.) An amount payable to the Commonwealth in accordance with sub-regulation (2a.) or (3.) of this regulation may be sued for and recovered in a Court of competent jurisdiction as a debt due and payable to the Commonwealth."; and

(d) by adding at the end thereof the following sub-regulation;—

"(5.) In this regulation, 'officer' includes a temporary employee.".

Officers summoned as jurors.

2. Regulation 45a of the Public Service Regulations is amended—

(a) by omitting from sub-regulation (2.) the words, "less any amount received by the officer as compensation for such attendance"; and

(b) by inserting, after sub-regulation (2.), the following sub-regulations:—

"(2a.) An officer summoned to attend as a juror shall pay to the Commonwealth any amounts received by him as fees for so attending.

"(2b.) An amount payable to the Commonwealth in accordance with the last preceding sub-regulation may be sued for and recovered in a court of competent jurisdiction as a debt due and payable to the Commonwealth.".

Leave of absence for service with International Organizations.

3. Regulation 61a of the Public Service Regulations is amended by inserting, after the words—

"International Trade Organization;",

the words—

"International Wheat Council;".

"Salary" for purposes of furlough.

4. Regulation 62 of the Public Service Regulations is amended—

(a) by omitting paragraph (j); and

(b) by adding at the end thereof the following sub-regulations:—

"(2.) For the purposes of sections 73 and 74 of the Act, 'salary' also includes the allowance payable to an officer in respect of the performance of the duties of an office having a higher classification than his own if the officer has performed, or would, but for his absence on authorized leave, have performed those duties for a continuous period of not less than one year immediately preceding the date on which he commences leave of absence under section 73 of the Act, the date of his retirement from the Service or the date of his death, whichever is applicable.

"(3.) Where an officer has, for a continuous period of not less than one year immediately preceding the date on which he commences leave of absence under section 73 of the Act, the date of his retirement from the Service or the date of his death, whichever is applicable, performed, or would, but for his absence on authorized leave, have performed the duties of more than one office each of which has a higher classification than his own for successive periods which are continuous one with the other, the officer shall, for the purposes of the last preceding sub-regulation, be deemed to have performed the duties of whichever of the offices having a higher classification than his own has the lowest classification for a continuous period of not less than one year.".

Recording and payment of overtime.

5. Regulation 67 of the Public Service Regulations is amended—

(a) by omitting sub-regulation (6e.);

(b) by omitting sub-regulations (10.) and (10a.) and inserting in their stead the following sub-regulations:—

"(10.) Where an officer performs overtime duty after the time at which his normal hours of duty end on one day and before the time at which his normal hours of duty are to commence on the next succeeding day for a period which results in the officer not being off duty between those times for a continuous period of not less than eight hours, the officer is, unless directed by the Chief Officer to report for duty at an earlier time, entitled to absent himself from duty, without loss of salary, until he has, from the time when he ceased to perform overtime duty, been off duty for a continuous period of eight hours.

"(10a.) For the purposes of the last preceding sub-regulation—

(a) 'normal hours of duty' means the hours of attendance of the officer determined by the Chief Officer, on the authority of the Board, in accordance with regulation 9 of these Regulations; and

(b) an officer shall be deemed to be on duty whilst travelling from his place of residence to his place of employment for the purpose of performing overtime duty and in returning to his place of residence after ceasing to perform overtime duty.

"(10b.) Sub-regulation (10.) of this regulation does not apply to an officer who is required to work overtime in pursuance of sub-regulation (8.) or (14.) of this regulation."; and

(c) by adding at the end thereof the following sub-regulation:—

"(15.) In this regulation, 'officer' includes a temporary employee.".

Rates of travelling allowances.

6. Regulation 75a of the Public Service Regulations is amended by omitting from sub-regulation (2.) the words "Two pounds fifteen shillings" and inserting in their stead the words "Three pounds six shillings".

Miscellaneous allowances.

7. Regulation 89a of the Public Service Regulations is amended by omitting from sub-regulation (2.) the figure and letter "4d." and inserting in their stead the word "Sevenpence".

Reimbursement of fares of Meat Inspectors.

8. Regulation 91 of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) the words "Department of Commerce and Agriculture" and inserting in their stead the words "Department of Primary Industry"; and

(b) by omitting from paragraph (b) the words "three shillings" and "thirteen shillings" and inserting in their stead the words "Seven shillings" and "One pound ten shillings", respectively.

Salaries payable to officers of the Second or Third Division.

9. Regulation 104 of the Public Service Regulations is amended—

(a) by omitting from paragraph (g) of sub-regulation (9.) the word "or"; and

(b) by inserting after paragraph (h) of sub-regulation (9.) the following paragraphs:—

"(i) Trainee Engineer; or

(j) Supervisor-in-training (Mail)".

Salaries of officers of the Fourth Division.

10. Regulation 106 of the Public Service Regulations is amended by omitting sub-regulations (8.), (9.) and (10.) and inserting in their stead the following sub-regulations:—

"(8.) The scale of rates of annual salary payable to an officer who occupies an office of Typist (Female), Accounting Machinist (Female), Grade 1, or Card Punch Operator (Female), Grade 1, is £308–£358–£407–£455–£503–£532–£556–£574–£594–£614.

"(9.) The minimum rate of annual salary payable to an officer who occupies an office specified in the last preceding sub-regulation is the rate of annual salary specified in the second column of the table in this sub-regulation opposite to the age of the officer.

" (10.) Notwithstanding anything contained in the last preceding sub-regulation, the Board may determine that an officer who occupies an office specified in sub-regulation (8.) of this regulation shall be paid a rate of salary ascertained by reference to the period of service of the officer in accordance with the following table if the rate so ascertained would result in the payment of a higher rate of salary than that applicable under the last preceding sub-regulation.

"(10a.) For the purpose of the last preceding sub-regulation, ' service' means—

(a) in the case of an officer occupying an office of Typist (Female) or Accounting Machinist (Female), Grade 1—-proved experience, either within or without the Commonwealth Service, as a typist or accounting machinist or proved experience in both of those occupations; or

(b) in the case of an officer who occupies an office of Card Punch Operator (Female), Grade 1—proved experience either within or without the Commonwealth Service as a card punch operator, typist, or accounting machinist or proved experience in more than one of those occupations.".

Notification of provisional promotions.

11. Regulation 109 of the Public Service Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (c) of sub-regulation (1.) the words "Department of Trade and Customs" and inserting in their stead the words "Department of Customs and Excise"; and

(b) by inserting in sub-paragraph (ii) of paragraph (c) of sub-regulation (1.), after the words "Postmaster-General's Department", the words "or the Department of Civil Aviation".

Constitution of Promotions Appeal Committees.

12. Regulation 109d of the Public Service Regulations is amended by omitting from the table in sub-regulation (1c.) the words—

" Line Inspector, Postmaster-General's Department

Overseer, Mail Branch, Postmaster-General's Department

Amalgamated Postal Workers' Union of Australia".

Appeals in relation to the Northern Territory and other Territories and places outside Australia.

13. Regulation 109e of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words "Department of Trade and Customs" and inserting in their stead the words "Department of Customs and Excise";

(b) by inserting in paragraph (b) of sub-regulation (1.), after the words "Postmaster-General's Department", the words "or the Department of Civil Aviation";

(c) by omitting from paragraph (a) of sub-regulation (2.) the words "Department of Trade and Customs" and inserting in their stead the words "Department of Customs and Excise"; and

(d) by inserting in paragraph (b) of sub-regulation (2.), after the words "Postmaster-General's Department", the words "or the Department of Civil Aviation".

14. Regulations 110a and 110b of the Public Service Regulations are repealed and the following regulation inserted in their stead:—

Sectional seniority.

"110a.—(1.) This regulation applies notwithstanding anything contained in the last preceding regulation.

"(2.) Subject to this regulation, the relative seniority of officers of the Fourth Division who have qualified for promotion to, or occupy, an office specified in the First Column of the Table in this sub-regulation shall, for the purposes of promotion under section 50 of the Act or of temporary transfer under regulation 116 of these Regulations to an office specified

in the Second Column of that Table opposite to that office, be determined by the respective dates on which the officers qualified for promotion to the office specified in the First Column of the Table.

"(3.) Subject to this regulation, the relative seniority of officers of the Fourth Division who occupy an office specified in the First Column of the Table in this sub-regulation shall, for the purposes of promotion under section 50 of the Act or of temporary transfer under regulation 116 of these Regulations to an office specified in the Second Column of that Table opposite to that office, be determined by the respective dates on which the officers were first appointed, advanced, transferred or promoted to the office which they occupy.

" (4.) Where two or more officers in the Postmaster-General's Department qualified for promotion to the office of Senior Technician on the same date, the relative seniority of those officers shall be determined by the respective dates of their advancement, appointment, transfer or promotion to the office of Technician.

"(5.) Where two or more officers in the Postmaster-General's Department qualified for promotion to the office of Senior Technician on the same date, and were advanced or appointed to the office of Technician on the same date, the relative seniority of those officers shall be determined by their relative seniority immediately before the date upon which they qualified for promotion to the office of Senior Technician.

"(6.) Where two or more officers in the Department of Civil Aviation qualified for promotion to the office of Senior Technician (Radio) on the same date, the relative seniority of those officers shall be determined by the respective dates of their advancement, appointment, transfer or promotion to the office of Technician.

"(7.) Where two or more officers in the Department of Civil Aviation qualified for promotion to the office of Senior Technician (Radio) on the same date, and were advanced or appointed to the office of Technician on the same date, the relative seniority of those officers shall be determined by their relative seniority immediately before the date upon which they qualified for promotion to the office of Senior Technician (Radio).

"(8.) Where two or more officers in the Postmaster-General's Department were appointed, advanced, transferred or promoted to an office of Technician (Instrument Maker), Technician (Mail), Technician (Telecommunications), Technician (Toolmaker) or Technician (Tradesman) on the same date, the relative seniority of those officers shall be determined by the respective dates of their appointments to the Commonwealth Service.

"(9.) Where two or more officers in the Department of Civil Aviation were appointed, advanced, transferred or promoted to an office of Technician (Radio) on the same date, the relative seniority of those officers shall be determined by the respective dates of their appointments to the Commonwealth Service.

"(10.) For the purposes of sub-regulations (8.) and (9.) of this regulation, where two or more officers were appointed to the Commonwealth Service on the same date, their relative seniority shall be determined by the Board.

"(11.) Where an officer of a Department, other than the Postmaster-General's Department or the Department of Civil Aviation, has passed an examination which—

(a) qualifies him for promotion to an office specified in the First Column of the Table in sub-regulation (2.) of this regulation; or

(b) qualifies him for appointment, transfer, or promotion to an office specified in the First Column of the Table in sub-regulation (3.) of this regulation,

the relative seniority of that officer in relation to other officers who hold those qualifications shall be as determined by the Board.

"(12.) Nothing contained in this regulation shall vary the relative seniority as at the thirtieth day of June, 1946, of officers of the Fourth Division in the Postmaster-General's Department who were promoted to offices of Senior Technician before the first day of July, 1924.".

Application of certain determinations to "State Employees".

15. After regulation 112 of the Public Service Regulations the following regulation is inserted:—

"112a.—(I.) Where the Board has, in a determination made in pursuance of section 53 of the Act, determined that an officer shall not be transferred or promoted to a specified office or an office included in a specified class of offices unless he has passed a specified examination or he possesses other specified qualifications, the conditions under which a State employee, as defined by section 81l of the Act, who would, if the law or practice of the State in relation to similar offices in the State service applied, have been eligible for appointment or promotion to that office, may be appointed or promoted to that office are—

(a) the passing of the examination or the possession of the other qualifications; and

(b) the conditions specified by the Board in the determination.

"(2.) Where the Board has, in a determination made in pursuance of section 32 of the Act, determined—

(a) that an officer occupying a specified office shall, upon compliance with such conditions as are specified, be paid salary at such rate as is specified, being salary at a rate not exceeding the maximum salary of that office; and

(b) that an officer shall not be paid salary at a rate exceeding such rate as is specified unless he has complied with such conditions as arc specified,

the conditions under which a State employee, as defined by section 81l of the Act, who would, if the law or practice of the State in relation to similar offices in the State service applied, have been eligible for advancement in that office, may be advanced in that office are the conditions specified by the Board in the determination.".

Federal Territories.

16. Regulation 141v of the Public Service Regulations is amended by omitting the words "For the purpose of this Part," and inserting in their stead the words "For the purposes of section 55 of the Act,".

17. The First Schedule to the Public Service Regulations is amended—

Second Schedule.

18. The Second Schedule to the Public Service Regulations is amended—

(a) by inserting, after item 26, the following item:—

"26a. Accounting Machinist (Female), Grade 1.

1. She shall be paid an allowance at the rate of £60 per annum on passing a test determined by the Board for this purpose.";

(b) by omitting item 30 and the particulars shown opposite thereto, and inserting in its stead the following items:—

"30. Stenographer (Female), Grade 1.

1. She shall be paid an allowance at the rate specified in the second column of the table in this paragraph opposite to the speed in words per minute equal to the highest rate at which she has satisfied the Board as to her efficiency at writing shorthand and correctly transcribing that shorthand.

(c) her rate of salary docs not exceed £614 per annum.

Fourth Schedule.

19. The Fourth Schedule to the Public Service Regulations is amended by omitting the words—
