REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1960.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1960, hereby makes, subject to the approval of the Governor-General, the following Regulations.

AMENDMENTS OF THE PUBLIC SERVICE REGULATIONS. 

Parts.

1. Regulation 2 of the Public Service Regulations is amended by inserting after the words—

“Division IV.—District Allowances (Regulations 101-103).”

the words—

“Division V.—Woomera Allowance (Regulation 103A).”.

Meal allowance

2. Regulation 68 of the Public Service Regulations is amended by omitting from sub-regulation (1.) the words “Nine shillings” and inserting in their stead the words “Ten shillings”.

Rates of travelling allowances.

3. Regulation 75A of the Public Service Regulations is amended—

(a) by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

Allowances to officers performing relieving duties or working within defined districts.

4. Regulation 76 of the Public Service Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

5. Regulations 77 and 77A of the Public Service Regulations are repealed and the following regulation is inserted in their stead:—

Allowance payable where meals or lodging provided.

“77. Where, during a period in respect of which travelling allowance would, but for this regulation, be payable to an officer or employee under regulation 75A of these Regulations—

(a) the officer or employee is provided, at the expense of the Commonwealth—

(i) with both meals and lodging;

 (ii) with meals only, not being meals provided while he is travelling on a journey; or

(iii) with lodging only,

the officer or employee shall not be paid travelling allowance under regulation 75A of these Regulations in respect of that period but shall be paid—

(iv) an amount equal to the amount (if any) expended by the officer or employee on meals or lodging during that period or, if the Board is satisfied that the amount so expended is not reasonable in the circumstances, such amount as the Board considers reasonable; and

 (v) such amount in respect of incidental expenses incurred by the officer or employee during that period as the Board determines; or

(b) the officer or employee is travelling on a journey extending overnight and the fare paid in respect of the journey includes payment both for his meals during the journey and for sleeping accommodation provided for him during the journey, the officer or employee shall not be paid travelling allowance under regulation 75A of these Regulations in respect of that period but shall be paid such amount in respect of incidental expenses incurred by him during that period as the Board determines.”.

Camping and lodging allowance.

6. Regulation 89 of the Public Service Regulations is amended—

(a) by omitting from sub-regulation (3.) the words “Six pounds fifteen shillings” and inserting in their stead the words “Seven pounds eight shillings”;

(b) by omitting from paragraph (a) of sub-regulation (5.) the words “Eleven pounds” and inserting in their stead the words “Twelve pounds”; and

(c) by omitting from paragraph (b) of sub-regulation (5.) the words “Eleven pounds” and “Six pounds fifteen shillings” and inserting in their stead the words “Twelve pounds” and “Seven pounds eight shillings”, respectively.

Bicycle allowances.

7. Regulation 92 of the Public Service Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “a rate not exceeding” and inserting in their stead the words “the rate of”;

(b) by inserting after sub-regulation (1.) the following sub-regulation:—

“(1AA.) Where an officer or employee to whom an allowance is not payable under the last preceding sub-regulation uses, with the approval of the Chief Officer, his bicycle for official purposes, the officer or employee shall be paid an allowance of Two shillings and sixpence for each day on which he uses his bicycle or, if the officer or employee

so uses his bicycle on four or more working days in a week, an allowance of Ten shillings in respect of the use of his bicycle in that week.”;

(c) by omitting from sub-regulation (1.) the words “an allowance at the rate prescribed by the last preceding sub-regulation” and inserting in their stead the words “the allowance payable to an officer or employee under whichever of the last two preceding sub-regulations is applicable in relation to the officer or employee”; and

(d) by omitting sub-regulation (3.).

Rates and conditions of district allowances.

8. Regulation 101 of the Public Service Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “the rates” and inserting in their stead the words “the annual rates”;

(b) by inserting in paragraph (b) of sub-regulation (3.), after the words “district allowance”, the words “or an allowance under regulation 103A of these Regulations”; and

(c) by omitting sub-regulation (4.) and inserting in its stead the following sub-regulation:—

“(4.) An officer who is under the age of eighteen years and is unmarried shall be paid district allowance under this regulation at one-half of the rate applicable under sub-regulation (1.) of this regulation.”.

9. After regulation 103 of the Public Service Regulations the following Division is inserted:—

Division V.Woomera Allowance.

Rates and conditions of Woomera allowance.

“103A.—(1.) An allowance—

(a) in the case of a married officer or employee—at the rate of One hundred and forty pounds per annum; and

(b) in the case of an unmarried officer or employee—at the rate of Eighty pounds per annum,

is payable to an officer or employee who is stationed at, and resides in, the village of Woomera.

“(2.) An allowance at the rate of Four pounds nineteen shillings per week is payable to an officer or employee who is stationed at, and resides in, the village of Maralinga.

“(3.) An allowance at the rate of Seven pounds six shillings and sixpence per week is payable to an officer or employee who is stationed at, and resides in, an established camp in the Woomera Rocket Range Area.

“(4.) An allowance at the rate of Eleven pounds eight shillings per week is payable to an officer or employee who is stationed in the Woomera Rocket Range Area as a regular member of a camping party camping elsewhere than at an established camp.

“(5.) If a married officer or employee maintains his family, he shall be granted the allowance prescribed by this regulation as payable to a married officer or employee whether or not his family resides with him in the locality in respect of which that allowance is payable.

“(6.) For the purpose of this regulation—

(a) an officer or employee who—

(i) is a widower or a widow supporting dependent children under the age of eighteen years or supporting dependent children who are certified by a duly qualified medical practitioner to be permanent invalids; or

(ii) is maintaining a home or supporting dependent children in circumstances which, in the opinion of the Board, justify his being deemed a married officer or employee,

shall be deemed to be a married officer or employee, as the case may be; and

(b) a married female officer or employee, not being an officer or employee who is deemed to be a married officer or employee under the last preceding paragraph, and a married officer or employee whose wife is employed by the Commonwealth and is receiving district allowance under regulation 101 of these Regulations or an allowance under this regulation, shall be deemed to be an unmarried officer or employee, as the case may be.

“(7.) An officer or employee who is under the age of eighteen years and is unmarried shall be paid allowance under this regulation at one-half of the rate applicable under the preceding provisions of this regulation.

“(8.) An allowance is not payable under regulation 75A of these Regulations in respect of any travelling in the Woomera Rocket Range Area by an officer or employee who is in receipt of an allowance under sub-regulation (2.), (3.) or (4.) of this regulation.

“(9.) An allowance is not payable under regulation 76, 89 or 96 of these Regulations to an officer or employee who is in receipt of an allowance under sub-regulation (2.), (3.) or (4.) of this regulation.

“(10.) An allowance is not payable under regulation 101 of these Regulations to an officer or employee to whom an allowance is payable under this regulation.”.

Salaries of Lecturers.

10. An officer who, for the whole or part of the period commencing on the thirteenth day of July, 1961, and ending on the twenty-seventh day of February, 1963, occupied an office of Lecturer and was paid salary at a rate not exceeding £2,350 per annum shall, in respect of the whole or part, as the case may be, of that period be paid an increase in salary at the rate of £31 per annum.
