REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1964*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1964, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations 

Parts.

1. Regulation 2 of the Public Service Regulations is amended by inserting after the words—

" Part IV.—Salaries payable to Officers of the Second Division, Third Division or Fourth Division (Regulations 104-106)."

the words—

" Part V.—Variations of Salaries of Officers of the Second, Third and Fourth Divisions (Regulation 106a).".

Interpretation.

2. Regulation 3 of the Public Service Regulations is amended by adding at the end thereof the following sub-regulation:—

" (2.) Where a reference is made in a regulation contained in Division II. or Division III. of Part II., or in Division III. of Part III., of these Regulations to—

(a) a specified rate of salary of, or payable to, a male officer; or

 (b) a specified rate of salary of, or payable to, a female officer, that regulation shall operate as if the rate so specified were increased by the amount by which the salary payable to a male officer aged twenty-one years or over or a female officer aged twenty-one years or over, as the case requires, is increased in accordance with regulation 106a of these Regulations.".

Calculation of pay for duty on a holiday.

3. Regulation 63 of the Public Service Regulations is amended by omitting sub-regulation (6.) and inserting in its stead the following sub-regulation:—

" (6.) In this regulation, " annual salary ", in relation to an officer, includes—

(a) the amount by which the salary payable to the officer is increased in accordance with regulation 106a of these Regulations; and

(b) an allowance payable to the officer in accordance with regulation 94a of these Regulations.".

Recording and payment for overtime.

4. Regulation 67 of the Public Service Regulations is amended by inserting after sub-regulation (6.) the following sub-regulation: —

" (6aa.) For the purposes of the last preceding sub-regulation, " annual salary ", in relation to an officer, includes the amount by which the salary payable to the officer is increased in accordance with regulation 106a of these Regulations.".

Allowance to married minors.

5. Regulation 87b of the Public Service Regulations is amended—

(a) by omitting from sub-regulation (1.) the words " a salary " and inserting in their stead the words " an actual salary ";

(b) by omitting from that sub-regulation the words " rate of salary " (wherever occurring) and inserting in their stead the words " rate of actual salary ";

(c) by omitting from that sub-regulation the words, " Grade 1,"; and

(d) by inserting after sub-regulation (1.) the following sub-regulation:—

" (1a.) For the purposes of the last preceding sub-regulation, " actual salary ", in relation to an officer, includes—

(a) the amount by which the salary payable to the officer is increased in accordance with regulation 106a of these Regulations; and

(b) an allowance payable to the officer in accordance with regulation 94a of these Regulations.".

6. After regulation 106 of the Public Service Regulations the following Part is inserted:—

" Part v.—Variations of Salaries of Officers of the Second,

Third and Fourth Divisions.

Variation of salaries.

" 106a.—(1.) The rate of annual salary payable to an officer included in a class of officers specified in the first column of the table in this sub-regulation shall, subject to this regulation, be increased by the amount per annum specified in the second column of that table opposite to the description of that class of officer.

" (2.) The last preceding sub-regulation does not apply to or in relation to—

(a) an officer of the First Division; or

(b) an officer who occupies an office specified in Group 1 in the Fourth Schedule to these Regulations.

" (3.) The salary payable to an officer who has not attained the age of twenty-one years shall be increased as if that officer had attained that age if—

(a) he occupies an office for which rates of salary payable to an officer under twenty-one years of age are prescribed, but, having complied with a condition specified by the Board in a determination under section 32 of the Act in respect of that office, he is paid salary at a rate higher than the rate prescribed for an officer of his age occupying that office; or

(b) he occupies an office in respect of which rates of salary payable to an officer under the age of twenty-one years occupying such an office are not prescribed.

" (4.) The salary of an officer who has not attained the age of twenty years and occupies an office of Seaman (Ordinary) shall be increased as if that officer had attained the age of twenty years.

" (5.) The rate of annual salary payable to an officer who occupies an office of Accounting Machinist (Female), Grade 1, Card Punch Operator (Female), Grade 1, or Typist (Female) shall be increased by the amount specified in the second column of the table in this sub-regulation opposite to the rate of salary payable to the officer.

" (6.) The rate of annual salary payable to an officer who occupies an office of Apprentice, Technician-in-training, Technician-in-training (Electrical) or Technician-in-training (Radio) shall be increased by the amount specified in the second column of the table in this sub-regulation opposite to the rate of salary payable to the officer.

7. Regulation 106b of the Public Service Regulations is amended—

(a) by inserting in sub-regulation (1.), after the words " the rate of salary ", the words " (including any increase in that rate in accordance with regulation 106a of these Regulations) "; and

(b) by inserting after sub-regulation (2.) the following sub-regulation:—

" (3.) Sub-regulation (1.) of regulation 106a of these Regulations docs not apply in relation to an unattached officer so as to increase further the rate of salary payable to him by virtue of sub-regulation (1.) of this regulation.".

Second Schedule.

8. The Second Schedule to the Public Service Regulations is amended by omitting item 14 and inserting in its stead the following item:—

" 14 Observer, Commonwealth Bureau of Meteorology, Department of the Interior.........

1. He shall, while in charge of a non-electronic observing station, be paid an allowance at an annual rate equal to the difference between his rate of annual salary (including any increase in that rate in accordance with regulation 106a of these Regulations) and the rate of $3,279.00.

 

2. He shall, while in charge of an electronic observing station, be paid an allowance at an annual rate equal to the difference between his rate of annual salary (including any increase in that rate in accordance with regulation 106a of these Regulations) and the rate of $3,449.00.

Fifth Schedule.

9. The Fifth Schedule to the Public Service Regulations is amended by inserting in sub-paragraph (b) of paragraph 1 of Part 2, after the word " salary ", the words " (including the amount by which the salary payable to an officer is increased in accordance with regulation 106a. of these regulations".
