REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1968.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1968, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations 

1. Regulation 106 of the Public Service Regulations is repealed and the following regulation inserted in its stead:—

Salaries payable to officers of the Fourth Division.

“ 106.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office the designation of which is specified or described in Part I. or Part II. of the First Schedule to these Regulations is, subject to this regulation, the rate of annual salary or the scale of rates of annual salary specified in the second column of that Part opposite to the designation of the office occupied by the officer.

“ (2.) The rate of annual salary, or each of the rates in a scale of rates of annual salary, applicable to an office specified or described in Part I. of the First Schedule to these Regulations shall, in relation to a female officer occupying that office, be deemed to be $402.00 less than the rate applicable in relation to a male officer occupying that office.

“ (3.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary payable to an officer who has not attained the age of twenty-one years and who occupies an office in the Fourth Division the designation of which is specified in the second column in Part III. of the First Schedule

to these Regulations is, subject to the succeeding sub-regulations of this regulation, whichever of the rates specified in the fourth column of that Part opposite to the age of the officer, that is applicable to the officer.

“ (4.) The Board may determine that an officer occupying an office of Accounting Machinist (Female) Grade 1, Card Punch Operator (Female) Grade 1 or Typist (Female) shall be paid a rate of salary ascertained by reference to the period of service of the officer in accordance with the table in this sub-regulation if the rate so ascertained would result in the payment of a higher rate of salary than that otherwise applicable to her under Part II. or Part III. of the First Schedule to these Regulations.

“ (5.) For the purpose of the last preceding sub-regulation, ‘ service ’ means—

(а) in the case of an officer occupying an office of Accounting Machinist (Female), Grade 1, or Typist (Female)—experience, either within or outside the Commonwealth Service, as an accounting machinist or typist or experience in both of those occupations; or

(b) in the case of an officer occupying an office of Card Punch Operator (Female), Grade 1—experience, either within or outside the Commonwealth Service, as an accounting machinist, card punch operator or typist, or experience in more than one of those occupations.

“ (6.) The Board may determine that each officer who occupies an office of Apprentice (not being an officer who is indentured to serve as apprentice for a period of four years), Technician-in-training, Technician-in-training (Electrical), or Technician-in-training (Radio) shall be paid a rate of salary ascertained by reference to the period of his service in that office in accordance with the table in this sub-regulation if the rate so ascertained would result in the payment of a higher rate of salary than that otherwise applicable to him under Part I. or Part III. of the First Schedule to these Regulations.

“ (7.) Where the Board has made a determination under the last preceding sub-regulation in relation to officers who occupy offices of Apprentice, the rate of annual salary payable to an officer who occupies an office of Apprentice and is indentured to serve as an apprentice for a period of four years is the rate of salary specified in the table in this sub-regulation opposite to the period of service of the officer in that office.

“ (8.) Where an officer who is indentured to serve as an apprentice for a period of four years is entitled to credit a period towards the term of his apprenticeship, the officer shall, for the purpose of the last preceding sub-regulation, be deemed to have served in the office of Apprentice for that additional period.

“ (9.) Where—

(a) an officer occupies an office or performs the duties of an office the designation of which is specified in the second column of the Second Schedule to these Regulations; or

(b) an employee is employed in an office the designation of which is specified in the second column of the Second Schedule to these Regulations,

and the officer or employee has the qualifications, or satisfies the requirements relating to an allowance or allowances, referred to in the third column of that Schedule opposite to the designation of the office, he shall be paid an allowance or allowances in respect of those qualifications or conditions in accordance with the provisions specified, or referred to, in the third column of that Schedule opposite to the designation of the office.

 

“ (10.) A determination by the Board under sub-regulation (4.) or (6.) of this regulation has effect notwithstanding anything contained in sub-regulations (1.), (2.) and (3.) of this regulation.

“ (11.) Where an officer—

(a) occupies one of the following offices in the Fourth Division:—

(i) Drafting Assistant, Grade 1;

(ii) Junior Observer;

(iii) Medical Laboratory Technologist-in-training;

(iv) Postal Clerk;

(v) Radiographer-in-training;

(vi) Technical Assistant, Grade 1;

(vii) Telegraphist;

(viii) Trainee Technical Officer (Medical Laboratory); or

(ix) Computing Assistant (Female);

(b) has not attained the age of twenty-one years;

(c) possess qualifications that, in the opinion of the Board, arc of a standard not less than the standard of the qualifications required for transfer from the Fourth Division to the Third Division; and

(d) receives salary under these Regulations at a rate per annum less than the rate specified in the table in this sub-regulation that is applicable in relation to the officer,

the officer may be paid an allowance at the rate per annum equal to the difference between the rate of annual salary payable to him under these Regulations and the rate so specified.
