REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1972.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, and on the recommendation of the President of the Senate and the Speaker of the House of Representatives, hereby make the following Regulations under the Public Service Act 1922-1972.

Amendments of the Public Service (Parliamentary Officers) Regulations

Interpretation.

1. Regulation 4 of the Public Service (Parliamentary Officers) Regulations is amended by omitting sub-regulation (2.).

Hours of duty—Officers other than certain Officers of the Parliamentary Library, certain Officers of the Joint House Department and a certain Officer of the House of Representatives.

2. Regulation 8 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting from paragraph (b) of sub-regulation (1.) the words “attendant or typist” and inserting in their stead the words “Senior Research Officer, Administrative Officer, Clerical Assistant, Grade 4, Steno-secretary, Grade 1, or Typist”; and

(b) by omitting from paragraph (d) of sub-regulation (1.) the word “typist” and inserting in its stead the words “Steno-secretary, Grade 1, or Typist”.

Hours of duty—certain Officers of the Parliamentary Library, certain Officers of the Joint House Department and a certain Officer of the House of Representatives.

3. Regulation 8a of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting from paragraph (b) of sub-regulation (1.) the words “attendant or typist” and inserting in their stead the words “Senior Research Officer, Administrative Officer, Clerical Assistant, Grade 4, Steno-secretary, Grade 1, or Typist”; and

(b) by omitting from paragraph (c) of sub-regulation (1.) the word “typist” and inserting in its stead the words “Steno-secretary, Grade 1, or Typist”.

Hours of duty— other Officers of the Fourth Division.

4. Regulation 8b of the Public Service (Parliamentary Officers) Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) In this regulation, ‘officer’ means an officer who occupies an office of—

(a) Deputy Housekeeper;

(b) Tradesman, Second Class;

(c) Attendant, Grade 1;

(d) Attendant, Grade 3;

(e) Cleaner;

(f) Painter;

(g) Maintenance Officer;

(h) Senior Carpenter;

(i) Carpenter;

(j) Nightwatchman;

(k) Foreman Gardener; or

(l) Gardener.”.

Meal allowance.

5. Regulation 55 of the Public Service (Parliamentary Officers) Regulations is amended by omitting from sub-regulation (1.) the figures “$1.45” and inserting in their stead the figures “$1.80”.

Rates of travelling allowance.

6. Regulation 57 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

“(1.) Subject to these Regulations, the rate at which travelling allowance is payable to an officer or employee is—

(a) if salary is payable to the officer or employee at a rate that is not less than Fourteen thousand three hundred and seventy-five dollars per year—

(i) in respect of residence in a capital city—Twenty-five dollars per day; or

(ii) in any other case—Seventeen dollars per day; and

(b) if salary is payable to the officer or employee at a rate that is less than Fourteen thousand three hundred and seventy-five dollars per year—

(i) in respect of residence in a capital city—Seventeen dollars sixty-five cents per day; or

(ii) in any other case—Thirteen dollars five cents per day.

“(1a.) For the purposes of the last preceding sub-regulation—

(a) if salary is payable to an officer or employee in accordance with a scale of rates per year, salary shall be deemed to be payable to the officer or employee at the maximum rate in that scale; and

(b) if an officer is in receipt of an allowance payable in pursuance of regulation 66 of these Regulations, salary shall be deemed to be payable to the officer at the rate per year ascertained by adding the rate per year at which salary is, or is to be deemed to be, payable to him and the rate per year at which that allowance is payable to him.”;

 

(b) by omitting from sub-regulation (2.) the words “last preceding sub-regulation” and inserting in their stead the words “last two preceding sub-regulations”; and

(c) by omitting from sub-regulation (2.) the figures “$21.00” and inserting in their stead the figures “$25.00”.

Class of travelling accommodation to be provided.

7. Regulation 64 of the Public Service (Parliamentary Officers) Regulations is amended by omitting from sub-regulation (1.) the figures “$2,614.00” and inserting in their stead the figures “$3,103.00”.

Overtime.

8. Regulation 65 of the Public Service (Parliamentary Officers) Regulations is amended—

(a)by omitting sub-regulation (5.) and inserting in its stead the following sub-regulation:—

“(5.) The maximum rate at which overtime is payable is the rate at which overtime is payable to an officer who is in receipt of salary at the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office.”; and

(b) by omitting paragraph (a) of sub-regulation (8.) and inserting in its stead the following paragraph:—

“(a) in receipt of salary at a rate exceeding the rate specified in the third column of the table in sub-regulation (2.) of Regulation 71 of these Regulations in relation to a Class 8 office; or”.

Saturday duty by certain Officers of the Fourth Division.

9. Regulation 65aa of the Public Service (Parliamentary Officers) Regulations is amended by omitting sub-regulation (5.) and inserting in its stead the following sub-regulation:—

“(5.) Notwithstanding anything contained in the preceding sub-regulations of this regulation, the hourly rate at which an amount is payable under sub-regulation (2.) of this regulation shall not exceed the rate ascertained in accordance with that sub-regulation for an officer who is in receipt of salary at the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office.”.

Sunday duty.

10. Regulation 65b of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting paragraphs (a) and (b) of sub-regulation (2.) and inserting in their stead the following paragraphs:—

“(a) in the case of an officer who is in receipt of salary at a rate not exceeding the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office—twice the officer’s hourly rate of salary; or

(b) in any other case—

(i) twice the rate that would be the officer’s hourly rate of salary if the officer were in receipt of salary at the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office; or

 

(ii) the sum of the officer’s hourly rate of salary and one- half the rate that would be his hourly rate of salary if he were in receipt of salary at the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office,

whichever is the greater.”;

(b) by omitting paragraphs (a) and (b) of sub-regulation (3.) and inserting in their stead the following sub-paragraphs:—

“(a) in the case of an officer in receipt of salary at a rate not exceeding the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office—the officer’s hourly rate of salary; or

(b) in any other case—the rate that would be the officer’s hourly rate of salary if the officer were in receipt of salary at the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office.”;

(c) by omitting from sub-regulation (7.) the words “at a rate exceeding $6,533.00 per annum, in the case of a male officer, or $6,131.00 per annum, in the case of a female officer,” and inserting in their stead the words “at a rate exceeding the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 8 office”.

Payment for duty on a holiday.

11. Regulation 65c of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting from sub-regulation (2.) the words “by the hourly rate of salary of the officer” and inserting in their stead the words “by an amount equal to one and one-half times the hourly rate of salary of the officer”;

(b) by omitting from sub-regulation (3.) the words “by twice” and inserting in their stead the words “by an amount equal to two and one-half times”;

(c) by omitting sub-regulation (8.) and inserting in its stead the following sub-regulation:—

“(8.) Notwithstanding anything contained in the preceding sub-regulations of this regulation, the hourly rate of salary of an officer for the purpose of this regulation shall not exceed the rate ascertained in accordance with sub-regulation (5.) of this regulation for an officer who is in receipt of salary at the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 4 office.”; and

(d) by omitting from sub-regulation (9.) the words and figures “to a male officer whose salary exceeds $6,533.00 per annum or a female officer whose salary exceeds $6,131.00 per annum in consequence of his or her” and inserting in their stead the words “to an officer who is in receipt of salary at a rate in excess of the rate specified in the third column of the table in sub-regulation (2.) of regulation 71 of these Regulations in relation to a Class 8 office in consequence of his”.

Higher duties allowance.

12. Regulation 66 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting from sub-regulation (3.) all words and figures before the word “then” and inserting in their stead the words “Where an officer performs, for a period of less than one week, the duties of a higher officer, being an office the rate, or maximum rate, of salary for which exceeds the rate specified in the third column of the table in sub-regulation (2.) of these Regulations in relation to a Class 2/3 office,”;

(b) by omitting sub-regulation (12.) and inserting the following sub-regulation in its stead:—

“(12.) The date from which an increment in an allowance is payable to an officer under this regulation is not affected by an alteration in the classification of the higher office the duties of which are performed by the officer, being an alteration in relation to which a notice is published in the Gazette under sub-section (4.) or (5.) of section 29 of the Act.”; and

(c) by omitting sub-regulations (18.), (21.) and (22.).

Partial reimbursement of fares of certain Officers.

13. Regulation 70d of the Public Service (Parliamentary Officers) Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulations:—

“(1.) The next succeeding sub-regulation applies to—

(a) an unmarried officer who has attained the age of twenty-one years; or

(b) an unmarried officer who is under the age of twenty-one years and is not in receipt of salary at a rate prescribed as payable to an officer under that age.

“(1a.) Where an officer to whom this sub-regulation applies—

(a) is stationed in Canberra;

(b) is in receipt of a salary at a rate not exceeding—

(i) in the case of a male officer—the rate of annual salary specified (in the second column) in the table in sub-regulation (4.) of regulation 71 of these Regulations in relation to a male officer whose age is twenty years; or

(ii) in the case of a female officer—$3,676.00 per annum;

and

(c) travels, while on recreation leave, from Canberra to the home of his parent or guardian,

the officer shall be reimbursed the amount (if any) by which the fare of the officer to and from the locality in which the home of his parent or guardian is situated exceeds $15.00.”.

Salaries payable to Officers of Second and Third Divisions.

14. Regulation 71 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulations (1.), (2.), (3.), (4.), (5.), (6.) and (7.) and inserting in their stead the following sub-regulations:—

“(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate per year at which salary is payable to an officer who occupies an office in the Second Division is the rate specified in the second column of the following table that is appropriate to the office having regard to its classification:—

“(2.) “(3.) For the purposes of sub-section (2.) of section 30 of the Act, the rate per year at which annual salary, or the scale of rates per year in accordance with which annual salary, is payable to an officer who occupies an office in the Third Division specified in the second column of the First Schedule to these Regulations is the rate or scale of rates specified in the third column of that Schedule in relation to that office.

“(4.) For the purposes of sub-section (2.) of section 30 of the Act, the minimum rate per year at which salary is payable to an officer who occupies an office in the Third Division of Clerk or Library Officer-in-training is whichever of the rates specified in the second or third column of the following table in relation to the age of the officer in the first column is applicable to the officer:—

15. Regulation 72 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulations (1.), (2.). (3.) and (4.) and inserting in their stead the following sub-regulations:—

“(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate per year at which salary, or the scale of rates per year in accordance with which salary, is payable to an officer who occupies an office in the Fourth Division specified in the second column of the Second Schedule to these Regulations is, subject to the succeeding sub-regulations of this regulation, the rate or scale of rates specified in the third column of that Schedule in relation to that office in the second column

“(2.) The scale of rates per year in accordance with which salary is payable to an officer who occupies an office of Typist, Grade 1, is $1,517-51,706-$1,991-$2,304-$2,588-$2,844-$2,924-$3,005-$3,086.

“(3.) The minimum rate per year at which salary is payable to an officer who occupies an office specified in the last preceding sub-regulation is the rate specified in the second column of the following table opposite the age of the officer in the first column.

“(7.) Where an officer occupies an office of Typist, she shall be paid an allowance—

(a) at the rate of $119.00 per annum if—

(i) she is not entitled to an allowance in accordance with the next succeeding paragraph;

(ii) she has passed a test conducted on behalf of the Parliamentary Head in typing at the rate of fifty words per minute and in typing letters and documents with due regard to punctuation and form; and

(iii) the rate per year at which salary is payable to her does not exceed the rate specified in the second column in the table in sub-regulation (5.) of this regulation in relation to an officer whose period of service is eight years or more; or

(b) at the rate specified in the second column in the following table opposite to the highest speed in words per minute specified in the first column of that table at which she has passed a test conducted by or on behalf of the Parliamentary Head in writing shorthand and correctly transcribing that shorthand:—

“(8.) Where an officer—

(a) occupies an office of Clerical Assistant, Grade 1, in the Fourth Division;

(b) is of an age specified in the first column of the table in this sub-regulation; and

 

(c) has passed in—

(i) English and three other subjects at a standard not less than that known as Ordinary level at an examination conducted by, or on behalf of, the Department of Education of the State of New South Wales at the end of three years of secondary education in that State and held in a particular year or at two examinations so conducted and held in two successive years; or

(ii) English and three other subjects at an equivalent standard and at an examination equivalent to that examination held in a particular year or at two examinations equivalent to that examination held in two successive years,

the rate at which salary is payable to the officer is whichever of the rates specified in the second column of the following table in relation to the age of the officer in the first column is applicable to the officer.

“(9.) For the purposes of sub-paragraph (ii) of paragraph (c) of the last preceding sub-regulation, a pass in English Expression or English Literature at a standard in an examination referred to in that sub-paragraph shall be deemed to be a pass in English at such a standard and in such an examination.

“(10.) Where an officer—

(а) occupies an office of Clerical Assistant, Grade 1, in the Fourth Division;

(b) is of an age specified in the first column of the table in this sub-regulation; and

(c) does not possess the qualifications referred to in paragraph (c) of sub-regulation (8.) of this regulation,

the rate at which salary is payable to the officer is whichever of the rates specified in the second column of the following table in relation to the age of the officer in the first column is applicable to the officer.
