1953. No. 94.

REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1953.*

WHEREAS it is provided by sub-section (2.) of section thirty of the Public Service Act 1922-1953 that officers of the Second, Third and Fourth Divisions shall be paid salaries at such rates, or in accordance with such scales of rates, as are prescribed:

And whereas it is provided by sub-section (3.) of that section that the regulations may, notwithstanding the classification of offices, provide for the variation of rates of salary according to variations in the cost of living:

And whereas the regulations in force immediately before the commencement of the following regulations make provision—

(a)for the rates at which, or the scale of rates in accordance with which, salaries of officers of the Second. Third and Fourth Divisions shall be paid; and

(b) for variations of rates of salaries, being variations according to variations in the cost of living, in the manner specified in the following regulations:

And whereas it is desirable that—

(a)those rates and those scales of rates be varied in accordance with the following regulations; and

(b) the variations of rates of salary according to variations in the cost of living should continue to have effect until other provision for variations of rates of salary according to variations in the cost of living is made:

Now therefore I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, on the recommendation of the President of the Senate and the Speaker of the House of Representatives, hereby make the following Regulations under the Public Service Act 1922-1953.

Amendments of the Public service (Parliamentary Officers) Regulations.

1. Parts IV. and V. of the Public Service (Parliamentary Officers) Regulations are repealed and the following Parts inserted in their stead:—

“Part IV.—Salaries.

Salaries of officers of the Second Division.

“71. For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates of annual salary payable to an officer of the Second Division is that scale of the rates specified in the table in this sub-regulation which is applicable to the office occupied by the officer by virtue of its classification.

“72.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the scale of rates of annual salary payable to an officer of the Third Division is, subject to this regulation, that scale of the rates specified in Table A or Table B in this sub-regulation which is applicable to the office occupied by the officer by virtue of its classification.

“(2.) The rate of annual salary payable to a male officer who is of an age specified in the first column of the table in this sub-regulation and occupies an office in the Third Division the minimum of the scale of rates of annual salary of which is less than £524 is the rate of annual salary specified in the second column of that table opposite to the age of the officer.

“ (4.) “(5.) “(6.) The maximum of the scale of annual salary payable to an officer who occupies an office in the Third Division shall not be less than £620 in the case of a male officer or less than £515 in the case of a female officer.

“(7.) Where a female officer occupies an office in respect of which the scale of rates of annual salary applicable to that office by virtue of its classification is a scale of rates specified in Table A in sub-regulation (1.) of this regulation, the rates payable to the female officer in respect of that office shall each be £105 less than the rates so specified.

Salaries of officers of the Fourth Division.

“73.—(1.) For the purpose of sub-section (2.) of section 30 of the Act—

(a) the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office specified in the second column. of Part I. of the Schedule to these Regulations is the scale of rates of annual salary specified in the third column of that Part opposite to the designation of that office; and

(b) the annual rate of salary payable to an officer of the Fourth Division who occupies an office specified in the first column of Part II. of the Schedule to these Regulations is, subject to this regulation, the rate specified in the second column of that Part opposite to the designation of that office.

“(2.) Where a female officer occupies an office specified in the second column of Part I. of the Schedule to these Regulations, being an office opposite to the designation of which a scale of rates of annual salary is specified in the third column of that Part opposite to the designation of that office, the rates payable to the female officer in respect of that office, are each £105 less than the rates so specified.

“Part V.—Variations of Salary according to variations in the Cost of Living—Officers of the Second, Third and Fourth Divisions.

“75.— (1.) The rate of salary payable to an officer included in a class of officers specified in the first column of the table in this sub-regulation shall be increased, by reason of variations in the cost of living, by the amount per annum specified in the second column of that table opposite to the description of that class of officers.

“(2.) Notwithstanding anything contained in the last preceding sub-regulation, the salary payable to an officer who has not attained the age of twenty-one years shall be increased as if that officer had attained that age if—

(a) he occupies an office for which the rate of salary payable to an officer under twenty-one years of age is prescribed, but, having complied with a condition of advancement determined by the Parliamentary Head in pursuance of section 32 of the Act in respect of that office, he is paid the rate payable to an officer who has attained the age of twenty-one years prescribed for that office; or

(b) he occupies an office in respect of which a rate of salary payable to an officer according to age is not prescribed.

“(3.) For the purposes of this regulation, ‘officer’ means an officer of the Second, Third or Fourth Division.”.

The Schedule.

2. The Schedule to the Public Service (Parliamentary Officers) Regulations is repealed and the following Schedule inserted in its stead:—
