REGULATIONS UNDER THE PUBLIC SERVICE ACT

1922-1955.*

WHEREAS by sub-section (3.) of section four of the Salaries Adjustment Act 1955 it is provided that regulations may be made under the Public Service Act 1922-1955 for purposes of or in relation to a reclassification referred to in sub-section (1.) of that section of officers to which the latter Act applies and that regulations so made shall be deemed to have come into operation on the twenty-third day of December, 1954:.

Now therefore I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, on the recommendation of the President of the Senate and the Speaker of the House of Representatives, hereby make, by virtue of the Salaries Adjustment Act 1955, the following Regulations under the Public Service Act 1922-1955.

Amendments of the Public Service (Parliamentary Officers) Regulations.

Parts.

1. Regulation 3 of the Public Service (Parliamentary Officers Regulations is amended by omitting the words—

"Part V.—Variation of Salary—Officers of Second, Third and Fourth Divisions.".

Basis of calculation of allowances.

2. Regulation 56 of the Public Service (Parliamentary Officers) Regulations is amended by omitting sub-regulation (1.).

3.—(1.) Regulation 57 of the Public Service (Parliamentary Officers) Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(2.) Regulation 57 of the Public Service (Parliamentary Officers) Regulations is amended by omitting from sub-regulation (2.) the words "Two pounds" and inserting in their stead the words "Two pounds fifteen shillings".

Fares.

4. Regulation 64 of the Public Service (Parliamentary Officers) Regulations' is amended by omitting the figures"£656" and inserting in their stead the figures"£928".

Recording and payment of overtime.

5. Regulation 65 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulation (5.) and inserting in its stead the following sub-regulation:—

"(5.) The minimum rate of overtime payment shall be Two shillings per hour and the maximum rate of overtime payment shall be ascertained by calculating—

(a) in the case of a male officer— the rate payable to an officer in receipt of a salary of £1,142 per annum; and

(b) in the case of a female officer— the rate payable to an officer in receipt of a salary of £988 per annum.";

(b) by omitting sub-regulation (8.) and inserting in its stead the following sub-regulation:—

"(8.) Except with the approval of the Parliamentary Head, an officer—

(a) in receipt of a salary at a rate exceeding—

(i) in the case of a male officer— £1,814 per annum; or

(ii) in the case of a female officer— £1,660 per annum; and

(b) the occupant of the office of Housekeeper, shall not be entitled to payment for overtime."; and

(c) by omitting sub-regulation (9.).

Sunday duty.

6. Regulation 65b of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulations (6.) and (7.) and inserting in their stead the following sub-regulations:—

"(6.) The maximum hourly rate of pay of an officer for the purposes of this regulation shall be the rate calculated—

(a) in the case of a male officer— on a salary of £1,142 per annum; and

(b) in the case of a female officer— on a salary of £988 per annum.

"(7.) Except with the approval of the Board, an officer in receipt of a salary exceeding—

(a) in the case of a male officer— £1,814 per annum; or

(b) in the case of a female officer— £1,660 per annum,

shall not be entitled to payment for duty performed on a Sunday."; and

(b) by omitting sub-regulation (10.).

Calculations of pay for duty on a holiday.

7. Regulation 65c of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (4.) the words "an actual salary that is the current equivalent of a standard salary of £812 per annum" and inserting in their stead the word s"a salary of £1,142 per annum";

(b) by omitting from paragraph (b) the words"an actual salary that is the current equivalent of a standard salary of £707 per annum" and inserting in their stead the words"a salary of £988 per annum.";

(c) by omitting sub-regulation (5.) and inserting in its stead the following sub-regulation:—

"(5.) The payment of an amount, or the granting of a period off duty, to a male officer whose salary exceeds £1,814 per annum or a female officer whose annual salary exceeds £1,660 per annum in consequence of his or her attendance and services during a holiday or half-holiday observed under section 76 of the Act shall be subject to the approval of the Parliamentary Head."; and

(d) by omitting sub-regulation (6.).

Higher duties.

8. Regulation 66 of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

"(3.) Where an officer performs, for a period of less than a week, the duties of a higher office, being an office in respect of which the salary, or the maximum salary, payable to the occupant of the office exceeds—

(a) in the case of a male officer— £1,058 per annum; or

(b) in the case of a female officer— £904 per annum,

then, unless the Parliamentary Head in special circumstances otherwise determines, the officer shall not be paid an allowance for the performance of those duties for that period, and that period shall not be included in any period of service for the purposes of this regulation.";

(b) by omitting sub-regulation (17.) and inserting in its stead the following sub-regulation:—

"(17.) Where an officer temporarily performs the duties of a higher office, being an office in respect of which the salary, or the maximum salary, including allowances in the nature of salary, payable to the occupant of the office is not less than—

(a) in the case of a male officer— £1,730 per annum; or

(b) in the case of a female officer— £1,576 per annum,

the preceding provisions of this regulation do not apply, but the officer may be paid in respect of the performance of those duties an allowance of such amount, and subject to such conditions, as the Parliamentary Head determines."; and

(c) by omitting sub-regulation (20.).

9. Parts IV. and V. of the Public Service (Parliamentary Officers) Regulations are repealed and the following Part is inserted in their stead:—

Part IV.—Salaries.

Salaries payable to officers of the Second and Third Divisions.

"71.— (1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to a male officer who occupies an office in the Second Division or the Third Division is, subject to this regulation, that rate or scale of rates specified in the table in this sub-regulation which is applicable to that office by virtue of its classification.

"(2.)"Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is a rate of annual salary applicable to that office by virtue of its classification, the rate of annual salary payable to the female officer in respect of that office is £154 less than the rate so specified.

"(3.) Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is applicable to that office by virtue of its classification a scale of rates specified in the table in sub-regulation (1.) of this regulation, the rates of annual salary payable to the female officer in respect of that office are each £154 less than the rates so specified.

"(4.) The rate of annual salary payable to a male officer who is of an age specified in the first column of the table in this sub-regulation and occupies an office in the Third Division the minimum of the scale of rates of annual salary of which is less than £722 is the rate of annual salary specified in the second column of that table opposite to the age of the officer.

"(5.) "(8.) The minimum rate of annual salary payable to an officer appointed under section 36a of the Act, or appointed to an office in the Third Division who is a graduate of an Australian University or a University approved by the Board for the purpose of this sub-regulation is—

(a) in the case of a male officer who has not attained the age of twenty-one years—£616;

(b) in the case of a female officer who has not attained the age of twenty-one years—£505;

(c) in the case of a male officer who has attained the age of twenty-one years—£848; and

(d) in the case of a female officer who has attained the age of twenty-one years—£694.

Salaries of officers of the Fourth Division.

"72.—(1.) For the purposes of sub-section (2.) of section 30 of the Act—

(a) the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office specified in the second column of Part I. of the Schedule to these Regulations is, subject to this regulation, the scale of rates of annual salary specified in the third column of that Part opposite to the designation of the office occupied by the officer; and

(b) the annual rate of salary payable to an officer of the Fourth Division who occupies an office specified in Part II. of the Schedule to these Regulations is, subject to this regulation, the rate specified in the second column of that Part opposite to the designation of that office.

"(2.) Where an annual rate of salary according to age is specified in the third column of Part I. of the Schedule to these Regulations opposite to the designation of an office specified in the second column of that Part, the annual salary payable to an officer who occupies such an office and is of an age specified in that column is the rate specified in that column for that age.

"(3.) Where a female officer occupies an office specified in Part I. of the Schedule to these Regulations, being an office opposite to the designation of which a scale of rates of annual salary is specified in the third column of that Part, the rates payable to the female officer in respect of that office are £154 less than the rates so specified.".

10. The Schedule to the Public Service (Parliamentary Officers) Regulations is repealed and the following Schedule inserted in its stead:—
