REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1964.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, on the recommendation of the President of the Senate and the Speaker of the House of Representatives, hereby make the following Regulations under the Public Service Act 1922-1964.

Amendments of the Public Service (Parliamentary Officers) Regulations.

Sunday duty.

1. Regulation 65b of the Public Service (Parliamentary Officers) Regulations is amended—

(a) by omitting sub-regulations (2.) and (3.) and inserting in their stead the following sub-regulations:—

“(2.) Subject to sub-regulation (4.) of this regulation, where the whole or part of the duty performed by an officer on a Sunday is in excess of his normal hours of duty per week, the officer is, by virtue of this sub-regulation, entitled to be paid, in respect of the duty so performed in excess of his normal hours of duty per week, at a rate per hour equal to—

(a) in the case of a male officer in receipt of salary at the rate of £1419 per annum or less or in the case of a female officer in receipt of salary at the rate of £1265 per annum or less—twice the officer’s hourly rate of salary; or

(b) in any other case—

(i) twice the rate that would be the officer’s hourly rate of salary if the officer, being a male officer, were in receipt of salary at the rate of £1419 per annum or, being a female officer, were in receipt of salary at the rate of £1265 per annum; or

(ii) the sum of the officer’s hourly rate of salary and one-half the rate that would be the officer’s hourly rate of salary if the officer, being a male officer, were in receipt of salary at the rate of £1419 per annum or, being a female officer, were in receipt of salary at the rate of £1265 per annum,

whichever is the greater.

“(3.) Where an officer perfoms duty on a Sunday and the whole or part of that duty when aggregated with the duty performed by the officer during the six days immediately preceding that Sunday does not exceed that officer’s normal hours of duty per week, the officer is, by virtue of this sub-regulation, entitled to be paid, in respect of that duty or so much of that duty as, when so aggregated, does not exceed the officer’s normal hours of duty per week, at a rate per hour equal to—

(a) in the case of a male officer in receipt of salary at the rate of £1419 per annum or less or in the case of a female officer in receipt of salary at the rate of £1265 per annum or less—the officer’s hourly rate of salary; or

(b) in any other case—the rate that would be the officer’s hourly rate of salary if the officer, being a male officer, were in receipt of salary at the rate of £1419 per annum or, being a female officer, were in receipt of salary at the rate of £1265 per annum.

“(3a.) Payment by virtue of the last preceding sub-regulation in respect of duty performed by an officer is in addition to, and not in substitution for, payment at the officer’s ordinary rate of pay in respect of the duty.”;

(b) by omitting from sub-regulation (4.) the words “one-half the rate of hourly pay” and inserting in their stead the words “the rate per hour at which payment would be made by virtue of sub-regulation (3.) of this regulation if the duty had not been in excess of his normal hours of duty per week”;

(c) by omitting sub-regulation (6.); and

(d) by omitting sub-regulation (7.) and inserting in its stead the following sub-regulation:—

“(7.) Except with the approval of the Parliamentary Head, an officer in receipt of salary at a rate exceeding £2594 per annum, in the case of a male officer, or £2440 per annum, in the case of a female officer, is not entitled to any payment by virtue of a sub-regulation of this regulation, or to be granted a day off duty by virtue of sub-regulation (4.) of this regulation, in respect of duty performed on a Sunday.”.

The Schedule.

2. The Schedule to the Public Service (Parliamentary Officers) Regulations is repealed and the following Schedule inserted in its stead:—
