996 Public Service (Board's Powers and Functions) Act 1987, No. 71 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short Title . This Act may be cited as the Public Service (Board's Powers and Functions) Act 1987. 2. Interpretation . In this Act- "the Act" means the Public Service Act 1922-1978; "the Board" means the Public Service Board provided for by the Act; "the Director" means the person for the time being holding the office, Director, Office of Public Service Personnel Management. 3. Powers and authorities vested in Director. All the powers and authorities conferred on the Board or the Chairman of the Board by the Act are by this Act conferred on and may be exercised by the Director. 4. Discharge of functions by Director . Where the Act provides that anything shall be done by or on the recommendation of the Board or shall depend upon the approval or determination of the Board that thing may be done by, or on the recommendation of the Director or, as the case may be, shall depend upon the approval or determination of the Director. 5. Construction of Public Service Act. The Act shall be read and construed subject to this Act and with the modification prescribed by this section, namely- (a) every reference in the Act to the Board or to the Chairman of the Board shall be construed as a reference to the Director, except in sections 5, 6F, 8, 8A, 9, 10A and 43; (b) section 23 (7) shall be construed as if the words "where the promotion is to an office in respect of which the maximum salary of the classification thereof does not exceed the maximum salary of the classification designated with the symbol I-5 as referred to in subsection (1) (a)" did not appear therein. 6. Assignment of powers etc. The powers and authorities conferred on the Director by this Act include the power of assignment of powers, functions and duties conferred on the Board by section 11 of the Actto the intent that the Director may assign any of the Board's powers and authorities conferred by this Act on him and may assign any of the Board's functions that by this Act are permitted to be discharged by him.
Public Service (Board's Powers and Functions) Act 1987, No. 71 997 Section 11 of the Act shall apply in respect of every such assignment by the Director and in respect of the further assignment of the powers and functions so assigned.
