AN ACT to amend the Public Service Arbitration

Act, 1966-1970.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Public Service Short title and citation.

Arbitration Act Amendment Act, 1975.

(2) In this Act the Public Service Arbitration Act, Reprinted as rapproved for

1966-1970 is referred to as the principal Act.	Ilth March,

(3) The principal Act as amended by this Act may be cited as the Public Service Arbitration Act, 1966-1975.

Section 23A

amended. 2. Section 23A of the principal Act is amended

(a)	by adding after the section number "23A." the subsection designation "(1)"; and
(b)	by adding at the end thereof the following subsections

(2) Subject to subsection (3) of this section, the Arbitrator is empowered to

determine any application made by a party to an agreement to vary or rescind any provision of the agreement and may for that purpose make an order varying or rescinding any provision of an agreement.

(3) The provisions of this Act relating to the power or jurisdiction of the Arbitrator to vary an award, and the provisions of this Act relating to things or conditions which are required to be done or fulfilled before the Arbitrator may vary an award and, in particular, the provisions of subsections (2) and (3) of section twenty-seven of this Act relating to the times at which awards may be altered and applications made therefor shall, except to the extent other- wise provided for in the agreement or any variation thereof, apply to and in relation to any amendment, or application there- for, of an agreement pursuant to sub- section (2) of this section. .

Section 27

amended. 3. Subsection (2) of section 27 of the principal

Act is amended

(a)	by adding after the words "date of" in line two of paragraph (c) the words "commen- cement of the operation of"; and
(b)	by adding after the words "date of" in line four of paragraph (c) the words "commencement of the operation of".
