AN ACT to amend the Public Service Appeal Board

Act, 1920.

[Assented to 9th December, 1932.]

this present Parliament assembled, and by the authority of

the same, as follows:—

1.    This Act may be cited as the Public Service Appeal Short title.

Board Act Amendment Act, 1932.

2.    (1.) Subsection (2) of section two of the Public Ser- Amendment or

vice Appeal Board Act, 1920 (hereinafter called the principal Act) is hereby amended by striking out "and (3)" and in- serting "(3) and (4)" in lieu thereof.

(2.) There is hereby added to section two of the prin-

cipal Act a subsection, as follows :—

(3.) In this Act "Railways Department" means the department employed in connection with the Government Railways, but does not include any persons who are offi- cers and servants of that department by virtue only of section nineteen of the Government Tramways Act, 1912, and/or the Government Electric Works, Act, 1915.

3.    Subsection (2) of section three of the principal Act is Amendment of

(1) by striking out the word "is," in the second line of paragraph (a), and inserting in lieu thereof the words "and the Railways Department are";

(ii) by inserting after paragraph (b) a new paragraph,

as follows :—

(bb) If the matter to be dealt with by the Boarl is a question arising or pending in the Railways Department and referred to the Board under sub- section (4) of section six, then the Board shall consist of a Judge of the Supreme Court, who shall be chairman, one member to be appointed by the Governor and one member elected in the prescribed manner and for the prescribed term by those per- sons who are for the time being members of one or more of the following unions or organisations, and employed exclusively by the Railway Depart- ment, that is to say:

The West Australian Railway Officers' Union;

The West Australian Amalgamated Society of

Railway Employees' Union of Workers;

The West Australian Loco. Engine-drivers, Fire- men, and Cleaners' Industrial Union of Workers;

The Amalgamated Engineering Union;

The Australasian Society of Engineers;

The Federated Moulders' (Metal) Union;

The Federated Society of Boilermakers and

Structural Iron and Steel Workers.

Amendment of

4. Subsection (4) of section six of the principal Act is

hereby amended by the addition of a paragraph, as follows:

For the purposes of this subsection the Railways De- partment shall be deemed to be a department of the pub- lic service, and the word "person" shall include any person employed in the said department, whether lie be a salaried officer or paid by wages.
