An Act to amend the Public Service Aet, 1979, so as to abolish the barrier between higher and lower grades and to provide for temporary appoint­ ments to Special Division positions. [Assented to, 12th April, 1983.]

Public Service (Amendment).

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1.          This Act may be cited as the “Public Service (Amendment) Act,

1983”.

Commencement.

2. (1) Except as provided by subsection (2), this Act shall commence on the date of assent to this Act.

(2) Section 3, in its application to Schedule 1 (2), and Schedule 1 (2) shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

Amendment of Act No. 89, 1979.

3.          The Public Service Act, 1979, is amended in the manner set forth in

Schedule 1.

Transitional provision.

4.          Procedures, not completed before the commencement of Schedule 1

(2), for the fiUing of a vacancy in a position in the PubUc Service may be completed after that commencement as though sections 73 and 74 of the Public Service Act, 1979, were still in force, but only if—

(a)	the vacancy had been advertised in accordance with section 71 of that Act; or
(b)	a recommendation in respect of the filling of the vacancy had been made in accordance with that Act.

(Sec. 3.)

Amendments to the Public Service Act, 1979.

(1) Section 49 (2 )—

Omit the subsection, insert instead:—

(2) A temporary appointment may be made under subsection (1) (a) to a position which is vacant or the holder of which is suspended, sick or absent.

(2) Sections 73, 74—

Omit the sections.
