AN ACT to amend section fifty-six of the Public

Service Act, 1904-1973.

[Assented to 16th May, 1975.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Public 23rlattlieon.

Section 56

amended.

2. Section 56 of the principal Act is amended

(a)

by deleting the words "up to a maximum of twelve months" in lines two and three of paragraph (a) of subsection (4);

(b)

by repealing and re-enacting subsection (4a) as follows

(4a) Where by the operation of the provisions of this section as in force at any time prior to the date of the coming into operation of the Public Service Act Amendment Act, 1975 any period of service of a person did not count as continuous service by reason of that person having, at any relevant time, accrued his maximum entitlement under this section as so in force, the Board may, if the person was still serving as an officer on the first day of January, nineteen hundred and seventy-five, determine that the period of service shall nevertheless be treated as a continuous period of service for the purpose of conferring on that person additional benefits under this section. ;

(c)

by deleting the passage "; and so that no payment that exceeds the equivalent of twelve months' salary shall be paid under the regulations" appearing at the end of subsection (6); and

(d)

by adding immediately before the word "any" in line one of paragraph (e) of subsection (7) the passage "subject to subsection (4a) of this section,".
