AN ACT to amend section fifty-two of the Public

Service Act, 1904-1970.

[Assented to 26th May, 1972.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

1. (1) This Act may be cited as the Public

2. Section 52 of the principal Act is amended by

adding after subsection (3), the following subsec-

tion

(3a) Notwithstanding the provisions of sub-

section (3) of this section

(a)

the annual leave of absence for recreation of an officer may, when the convenience of the Department is served thereby, be allowed to accumu- late in excess of three years' entitle- ment if the Permanent Head so recommends and the Minister so approves; and

(b)

where, in respect of the year nineteen hundred and seventy-one or any pre- ceding year, an officer was unable to accumulate annual leave of absence for recreation in excess of three years' entitlement by reason of the provisions of subsection (3) of this section, and thereby forfeited the whole or part of the annual leave of absence for recreation to which he became entitled for that year but failed to take in order to serve the convenience of the Department, the Minister may, on the recommendation of the Permanent Head, approve the restoration to the credit of the officer of the annual leave of absence for recreation so forfeited,

but the provisions of paragraph (b) of this subsection may be applied only to a person who continued to be an officer after the thirty-first day of December, nineteen hundred and seventy-one. .
