The Parliament of Victoria enacts as follows:

1Purpose

The purpose of this Act is to provide the mechanism for the deduction of union fees by employers from payments to employees in the public sector.

2Commencement

This Act comes into operation on a day to be proclaimed.

3Definition

In this Act—

public sector employer means—

(a)the Crown; or

(b)an authority within the meaning of section 104 of the Public Administration Act 2004.

4Deduction of union fees from salary

(1)A public sector employer may, in accordance with the Victorian Workers'Wages Protection Act 2007 and with the approval in writing of the Minister, deduct from an employee's pay an amount in respect of fees payable by the employee to a trade union or other association of employees of which the employee is a member.

(2)A public sector employer must not make a payment on behalf of an employee to a trade union or other association of employees of which the employee is a member except in accordance with the Victorian Workers' Wages Protection Act 2007 and with the approval in writing of the Minister.

(3)Any agreement made before the commencement of this section authorising, or purporting to authorise, a public sector employer to make deductions of a kind referred to in subsection (1) from payments to employees or to supply names or other information about employees to trade unions or any other associations of employees ceases, on that commencement, to have any further effect.
