PUBLIC SECTOR MANAGEMENT (SCHEDULE 6)

REGULATIONS 1996

Made by His Excellency the Governor in Executive Council under section 108 (1) (c) of the Act.

Citation

1. These regulations may be cited as the Public Sector Management

(Schedule 6) Regulations 1996.

Commencement

2. These regulations are taken to have come into operation on the day on

Schedule 6 to Act amended

3.  (1) Clause 1 (1) (a) of Schedule 6 to the Public Sector Management Act

1994* is amended by inserting after "Constitution Act 1889" the following —

or section 30 (1) (a) of the repealed Act

(2) Clause 2 of Schedule 6 to the Public Sector Management Act 1994* is

amended by inserting after subclause (1) the following subclause —

(1a) A person who —

(a)	after the commencement of this clause is employed as a ministerial officer or engaged under a contract for services under section 100 (1) of this Act to assist a political office holder; and
(b)	immediately before being so employed or engaged was a person referred to in clause 1,

retains the eligibility that person had immediately before the commencement of this clause to apply for an office, post or position in a department or organization.

(3) Clause 3 of Schedule 6 to the Public Sector Management Act 1994* is

amended —

(a)	by inserting after the clause designation "3." the subclause designation a(1)"; and
(b)	by inserting the following subclause —

" (2) A person referred to in clause 2 (1a) and engaged under a contract for services under section 100 (1) of this Act is not, while that person remains so engaged, eligible to apply for, or to be appointed to, any office,_ post or position in a department or organization, unless that office, post or position is advertised in a daily newspaper circulating throughout the State.
