Public Sector Management Act 1994

Public Sector Management (Redeployment and

Redundancy) Amendment Regulations 2002

Made by the Governor in Executive Council.

1.             Citation

These regulations may be cited as the Public Sector
Management (Redeployment and Redundancy) Amendment
Regulations 2002.

2.             The regulations amended

The amendments in these regulations are to the Public Sector
Management (Redeployment and Redundancy)
Regulations 1994*.

3.             Regulation 4A amended

Regulation 4A(4) is amended by deleting “regulation 6.” and inserting instead —

“ regulation 6, 15 or 16. ”.

4.             Regulation 20 amended

(1) Regulation 20(1) is amended by deleting “subregulations (2)
and (3),” and inserting instead —
“ subregulations (2), (2a) and (3), ”.

(2) Regulation 20(2) is amended by deleting “The” and inserting
instead —
“ Subject to subregulation (2a), the ”.
(3) After regulation 20(2) the following subregulations are
inserted —

(2a) Subregulations (1) and (2) apply to a severance
payment made to an employee who accepts, within the
relevant period, an offer of voluntary severance as if —

(a)

the reference in subregulation (1) to “2 weeks’ pay” were a reference to “3 weeks’ pay”; and

(b)

the reference in subregulation (2) to “46 weeks’ pay” were a reference to “52 weeks’ pay”.

(2b) In subregulation (2a) —
“relevant period” means the period from, and

including, the day on which the Public Sector
Management (Redeployment and Redundancy)
Amendment Regulations 2002 come into operation

to, and including, 30 June 2002.

”.
