I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of Part 3A of the Public Sector Management Act 1988, make the following Order.

1 Name of Order

This Order is the Public Sector Management (Surveyor-General’ s

Department) Order 1997

2 Commencement

This Order commences on 2 January 1998.

3 Establishment of new department

The Surveyor-General’s Department is established as a department of the Public Service.

4 Amendment of Schedule 1 (Departments)

Schedule 1 to the Public Sector Management Act I988 is amended by inserting in alphabetical order of departments the following matter:

5 Transfer of branch to new department

The Land Information Centre is removed from the Department of Land and Water Conservation and added to the Surveyor-General’s Department.

6 Responsible Minister: section 55C

The Minister for Regional Development is to be the Minister responsible for the Surveyor-General’s Department.

7 Construction of certain references

(1) In this clause, document means any Act or statutory instrument,
or any other instrument, or any contract or agreement.

1997

In any document, a reference to the Minister for Land and Water Conservation is to be construed as a reference to the Minister for Regional Development if the reference is used in or in relation to legislation administered by the latter Minister.

In any document, a reference to the Department of Land and Water Conservation is to be construed as a reference to the Surveyor-General’s Department if the reference is used in or in relation to legislation administered by the Minister for Regional Development.

Surveyor-General in section 2 of the Survey Co-ordination Act The reference to the Department of Lands in the definition of
1949 is to be construed as a reference to the Surveyor-General’s
Department.
