and Services) Amendment Regulation

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Sector Management Act 1988.

Explanatory note
The objects of this Regulation are:

(a) to require the Minister for Public Works and Services, the State Contracts Control Board, any delegate of the Board, Department heads and other bodies or persons to have regard to the NSW Government’s procurement policy and code of practice, and
(b) to change the composition of the State Contracts Control Board, by removing one of its ex-officio members.

This Regulation is made under the Public Sector Management Act 1988, in particular section 102 (2) (l), which provides for the making of regulations providing for the acquisition of stores, equipment, materials and services for the Public Service.

1      Name of Regulation

This Regulation is the Public Sector Management (Goods and
Services) Amendment Regulation 1999.

2 Amendment of Public Sector Management (Goods and Services) Regulation 1995

The Public Sector Management (Goods and Services) Regulation

1995 is amended as set out in Schedule 1.

(Clause 2)

[1]      Clause 4A

Insert after clause 4:

4A Application of Government policies and codes of practice

(1) In this clause:

NSW Government’s procurement policies and codes of practice means the policies and codes of practice adopted by the Government of New South Wales from time to time with respect to the procurement of goods and services for the Government of New South Wales.

(2) The Minister, the Board, the Board's delegates, Department Heads and other bodies or persons must, in the exercise of functions under this Regulation, have regard to the NSW Government’s procurement policies and codes of practice.
(3) Any agreement entered into under clause 17, between the Board and a public sector agency not within the Public Service, may make provision for the application of the provisions of the NSW Government’s procurement policies and codes of practice to matters arising under the agreement.

(4) This clause does not authorise any act or omission that contravenes a requirement of this Regulation.
