1      Name of Order

This Order is the Public Sector Employment and Management (Office of the Environment Protection Authority) Order 2012.

2      Commencement

This Order commences on 29 February 2012 and is required to be published on the NSW legislation website.

3      Establishment of Office of the Environment Protection Authority

The Office of the Environment Protection Authority is established as a Division of the Government Service responsible to the Minister for the Environment.

4      Transfer of staff to Office of the Environment Protection Authority

(1)

Such staff in the Office of Environment and Heritage in the Department of Premier and Cabinet who, in the opinion of the Public Service Commissioner, are employed to enable the Environment Protection Authority to exercise its functions are removed from the Department of Premier and Cabinet and added to the Office of the Environment Protection Authority.

(2)

In any document, a reference to the Department of Premier and Cabinet or the Office of Environment and Heritage of that Department is to be construed as a reference to the Office of the Environment Protection Authority if the reference is used in relation to the group of staff referred to in subclause (1).

(3) In this clause:
document means an Act or statutory instrument, or any other
instrument, or any contract or agreement.

5 Amendment of Public Sector Employment and Management Act 2002 No 43

(1) Schedule 1 Divisions of the Government Service

Insert in Division 2 of Part 1 after the matter relating to the Department of Planning and Infrastructure:

Office of the Environment *Chairperson of the Authority
Protection Authority
(2) Schedule 1, Part 3

Omit “Director-General of the Department of Premier and Cabinet” from Column 2 of the matter relating to the Environment Protection Authority Special Purpose Division. Insert instead:

Chairperson of the Environment Protection Authority
