I, Professor Marie Bashir AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of Chapter 4 of the Public Sector Employment and Management Act 2002, make the following Order.

1 Name of Order
This Order is the Public Sector Employment and Management
(Lands) Order 2004.
2 Transfer of certain staff from DIPNR to Department of Lands
The groups of staff in the Department of Infrastructure, Planning and Natural Resources who, in the opinion of the Director-General of the Premier’s Department, are principally involved in the administration of:
(a) the Tweed River Entrance Sand Bypassing Project, or (b) the River Entrance Management Program, or (c) the Waterways Program, are removed from the Department of Infrastructure, Planning and
Natural Resources and added to the Department of Lands.
3 Construction of certain references to Minister for Natural Resources
(1) A reference to the Minister for Natural Resources in any contract, agreement or other instrument concerning:
(a) the Tweed River Entrance Sand Bypassing Project, or (b) the River Entrance Management Program, or (c) the Waterways Program, is to be construed as including a reference to the Minister for Lands.

Without limiting subclause (1), a reference in any Act or statutory instrument, or in any other instrument, or in any contract or agreement, to the Minister for Natural Resources is to be construed as including a reference to the Minister for Lands if the reference is used in or in relation to the Tweed River Entrance Sand Bypassing Act 1995.
