An Act to amend the Public Roads Act 1902 in relation to the Minister’s powers of delegation and by way of statute law revision. [Assented to, 13th April, 1982.]

Public Roads {Delegations) Amendment.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—-

Short title,

1.          This Act may be cited as the “Public Roads (Delegations)

Amendment Act, 1982”.

Principal Act.

2. The Public Roads Act 1902 is referred to in this Act as

the Principal Act.

Amendment of Act No. 95, 1902.

3.          The Principal Act is amended in the manner set forth in

Schedule 1.

Savings.

4. (1) A reference in any other Act, or in any regulation, by-law or other statutory instrument or in any other document whether of the same or of a different kind, to the “Public Roads Act 1902” shall be read and construed as a reference to the “Public Roads Act, 1902,” or, if that reference is not appropriate, to the “Public Roads Act, 1902”.

(2) A delegation—

(a)

made under section 6a of the Principal Act; and

(b)

in force immediately before the date of assent to this Act,

shall be deemed to be a delegation made under section 6a of the

Principal Act as in force after the date of assent to this Act.

SCHEDULE 1.

(Sec. 3.)

Amendments to the Principal Act.

(1) Section 1—

Omit the section, insert instead : —

Short title.

1, This Act may be cited as the “Public Roads Act,

1902”.

(2) (a) Section 6a (1 )—

Omit “prescribed office the exercise or performance of such”, insert instead “office under the Minister’s ad­ ministration the exercise or performance”.

(b) Section 6a (1 )—

Omit “as may be prescribed in relation to the holder of that office”.

(c) Section 6a (2) —

Omit “a prescribed”, insert instead “an”.

(d) Section 6a (3) —

Omit “prescribed”.

(e) Section 6a (4), (5) —

Omit the subsections.

(f) Section 6a (7)-—

Omit the subsection.
