278 Public Officers' Retirements Act 1988, No. 33 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. Short Title . This Act may be cited as the Public Officers' Retirements Act 1988. 2. Interpretation . In this Act, except where a contrary intention appears- "officer" means a member of the Police Force of the State of Queensland within the meaning of the Police Act 1937-1987 and a contributor to the State Service Superannuation Fund under the State Service Superannuation Act 1972-1988 whose superannuation benefits are funded to any extent from the Consolidated Revenue Fund; "retirement" includes resignation of an officer upon or after his attaining an age at which he may retire or elect to retire. 3. Effective date of retirements . Notwithstanding the provisions of any other Act or law, a notice of retirement from an office held by an officer furnished by the officer at any time subsequent to 1 March 1988 shall not take effect as a retirement of its own force and, it is declared, never has so taken effect and the retirement thereby notified shall not be effective until it has been approved by the Governor in Council. This section does not apply to a notice of retirement or the retirement of an officer whose superannuation benefits have been or are being paid to him or at his direction before the passing of this Act. 4. Suspended officer cannot retire . Where an officer is suspended from duty because of conduct that suggests that- (a) he has been corrupt in the discharge of the duties of any office held by him; or (b) he has improperly used any office held by him or has knowingly neglected to discharge the duties of any office held by him, in either case for the purpose of gain, it is not competent to the officer to retire from the office held by him. 5. Requirement for compulsory retirement suspended . While, pursuant to this Act, a retirement from office notified by an officer in his notice of retirement is not effective or it is not competent to an officer to retire from office, a provision of any Act or law that requires the holder of an office to retire upon attainment of a particular age or for any other reason does not apply to that officer. 6. Retirement deemed to be effective in a particular case. If the death of an officer occurs while, pursuant to this Act, a retirement from office notified by him in a notice of retirement is not effective it shall be deemed for the purpose of establishing his entitlement to
Public Officers' Retirements Act 1988, No. 33 279 superannuation benefits that his retirement from office became effective immediately before his death. 7. Cessation of Act. This Act shall cease to be of any further force or effect on and from 31 December 1988.
