Public Lotteries Act 1996

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Lotteries Act 1996.

Explanatory note
The object of this Regulation is to amend the Public Lotteries Regulation 2007 so as to change the wording of:

(a) player information brochures, and
(b) gambling information and warning notices, and
(c) counselling signage, and
(d) gambling helpline information in advertising of public lotteries.

This Regulation is made under the Public Lotteries Act 1996, including sections 83 (the general regulation-making power) and 83A.

1      Name of Regulation

This Regulation is the Public Lotteries Amendment (Gambling-related
Notices and Player Information) Regulation 2009.

2      Commencement

This Regulation commences on 1 June 2009 and is required to be published on the NSW legislation website.

Regulation 2007

[1]      Clause 3 Definitions

Insert in alphabetical order in clause 3 (1):

Authority means the Casino, Liquor and Gaming Control Authority constituted under the Casino, Liquor and Gaming Control Authority Act 2007.

[2]      Clause 9 Approval of English and other community language player information brochures

Omit “G-line (NSW) helpline telephone” from clause 9 (1) (b).
Insert instead “Gambling Help line phone”.

[3]      Clause 9 (2), (3), (5) and (6)

Omit “Minister” wherever occurring. Insert instead “Authority”.

[4]      Clause 9 (3) and (5)

Omit “Arabic, Chinese, Croatian, Greek, Italian, Korean, Macedonian,
Maltese, Serbian, Spanish, Turkish and Vietnamese” wherever occurring.

Insert instead “Arabic, Chinese, Korean, Turkish and Vietnamese”.

[5]      Clause 10 Provision of player information brochures

Omit “Minister” wherever occurring from clause 10 (1) (a) and (2) (a).
Insert instead “Authority”.

[6]      Clause 10 (3) and (4)

Insert after clause 10 (2):

(3) The brochures must be in a form approved by the Authority and be obtained from the NSW Office of Liquor, Gaming and Racing.
(4) Despite subclauses (1) and (2), a brochure that complied with this clause, as in force immediately before 1 June 2009, may continue to be used until the end of the period of 12 months from that date or until the date the brochure is replaced, whichever happens first.

[7]      Clause 11 Provision of player information brochures in community languages

Insert after clause 11 (2):

(3) The brochures must be in a form approved by the Authority and be obtained from the NSW Office of Liquor, Gaming and Racing.
(4) Despite subclause (2), a brochure that complied with this clause, as in force immediately before 1 June 2009, may continue to be used until the end of the period of 12 months from that date or until the date the brochure is replaced, whichever happens first.

[8]      Clause 12 Gambling information and warnings

Omit clause 12 (1). Insert instead:

(1) A licensee must ensure that each printed entry form (however described) and ticket in a public lottery conducted by the licensee contains the following:

Maximum penalty: 50 penalty units.

Omit the paragraph. Insert instead:

(b) the following:

[10]      Clause 12 (5)

Insert after clause 12 (4):

(5) Despite subclauses (1) and (3), a printed entry form or written material that complied with this clause, as in force immediately before 1 June 2009, may continue to be used until the end of the period of 12 months from that date or until the date the entry form or written material is replaced, whichever happens first.

[11]      Clause 13 Counselling signage—notice to be displayed

Omit clause 13 (3). Insert instead:

(3) The notice must contain the following:

[12]      Clause 13 (4) and (5)

Omit the subclauses. Insert instead:

(4) The notice must be in a form approved by the Authority and be
obtained from the NSW Office of Liquor, Gaming and Racing.
(5) Despite subclauses (1) and (2), a notice that complied with this clause, as in force immediately before 1 June 2009, may continue to be used until the end of the period of 12 months from that date or until the date the notice is replaced, whichever happens first.

[13]      Clause 14 Advertising of public lotteries

Omit “Is gambling a problem for you? CALL G-line (NSW) counselling service 1800 633 635” from clause 14 (3).

Insert instead:

[14]      Clause 14 (3A)

Insert after clause 14 (3):

(3A) Despite subclause (3), a licensee or agent of a licensee who, before 1 June 2010, publishes or causes to be published any public lottery advertising that complied with this clause, as in force immediately before 1 June 2009, is not guilty of an offence under that subclause.
