No. XXXV.

An Act to authorize the immediate execution of

certain Public Works of a permanent charac­

ter by means of Loans secured upon the General Revenues of the Colony. [2nd

December, 1854.]
WHEREAS it is expedient to enable the Government to proceed forthwith to the execution of certain Public Works the expenses whereof cannot conveniently be defrayed out of the Current Revenues

of the year or years in which the same may be executed And whereas by reason of such works being of a permanent character it is deemed

expedient to provide the requisite funds for executing the same by means of Loans upon the security of the General Revenues of the Colony Be it therefore enacted by His Excellency the Governor of New South Wales with the advice and consent of the Legislative Council thereof as follows :—

1. For the purpose of executing the Public Works hereinafter
mentioned there shall and may be issued out of the Public Treasury
of the Colony at such times to such persons and in such proportions

as the Governor shall by any warrant or order in writing signed by him from time to time order and direct any sum or sums of money not exceeding one hundred and seventy-eight thousand seven hundred and fifty pounds that is to say—for the execution of the Works

of Defence at Middle Harbour and the South Head recommended

in the Resolution passed by the Legislative Council on the seventh day of October one thousand eight hundred and fifty-three a further sum not exceeding thirty thousand pounds—for the erection of a Light­ house at Cape Moreton a further sum not exceeding three thousand two hundred and fifty pounds—for the erection of the portion of the Abattoir at Glebe Island which was recommended in the Resolution passed by the Legislative Council on the twenty-fifth day of September one thousand eight hundred and fifty a further sum not exceeding twenty thousand pounds—for the erection of a New General Post Office

a sum not exceeding forty thousand pounds—for the erection of a New
Government Printing Office a sum not exceeding six thousand pounds—
for the erection of a Colonial Store a further sum not exceeding three

thousand pounds—for the erection of a Signal-house at Newcastle a sum not exceeding six hundred pounds—for the erection of a New Water Police Office at Sydney a further sum not exceeding six thousand pounds—for the erection of a New Water Police Watch- house at Sydney a sum not exceeding four thousand pounds—for the erection of Mounted Patrol Barracks and Stables at Sydney a further sum not exceeding six thousand pounds—for the erection of a Police; Station at the southern end of Sydney a sum not exceeding five thousand pounds—for the erection of a Watch-house at Balmain a further sum not exceeding seven hundred and fifty pounds—for the erection of a Watch-house on the North Shore a further sum not exceed­ ing four hundred pounds—for the erection of a Watch-house at Darling- hurst a further sum not exceeding one thousand three hundred and

fifty pounds—for the erection of a Watch-house at Newtown a further

sum not exceeding three hundred pounds—for the erection of a Police Station at Newcastle a sum not exceeding four thousand pounds—for the erection of a Court House at Camden a sum not exceeding two thousand pounds—for the erection of a Court and Watch-house at Queanbeyan with

outbuildings

outbuildings a further sum not exceeding one thousand two hundred pounds—for the erection of a Court House at Ipswich a sum not exceeding three thousand five hundred pounds—for the erection of a Watch-house at Ipswich a sum not exceeding one thousand six hundred pounds—for the construction of a Public Wharf at the end of Erskine-street in Sydney a sum not exceeding one thousand five hundred pounds—for the construction of a Dam at the North Rocks Parramatta a further sum not exceeding five thousand pounds-—for the construction of a Bridge at Menangle Ford a further sum not exceeding two thousand pounds—for the construction of a Bridge over the Macquarie River at Bathurst a further sum not exceeding seven thousand pounds—for the construction of a Bridge over the Belubula Rivulet at Carcoar a further sum not exceeding two thousand three hundred pounds—for the construction of a Bridge over the Bargo River a farther sum not exceeding four thousand pounds—for the construc­ tion of a Bridge over Paddy's River a further sum not exceeding three thousand pounds—for the construction of a Bridge at Gunning a sum not exceeding four thousand pounds—for the construction of a Bridge at Queanbeyan a further sum not exceeding seven thousand pounds—

for the construction of a Bridge over the Yugiong Creek a sum not

exceeding four thousand pounds.

2. The Treasurer of the Colony shall issue such sum and sums

of money as shall be so ordered and directed to be issued and shall

debit the same to a separate account to be called " The Permanent
Public Works' Account " and the said Treasurer shall in his accounts

from time to time be allowed credit for any sum or sums of money paid by him in pursuance of such warrant or order in writing as aforesaid and the receipt or receipts of the respective persons to whom the same shall be so paid shall be a full and valid discharge to the said Treasurer in passing his said accounts for any such sum or sums as shall be therein mentioned.

3. In order to provide the requisite funds for defraying the cost

of the said Public Works it shall be lawful for the Governor from time

to time to raise by the sale of Debentures secured upon the General Revenue of the Colony and bearing interest at a rate not exceeding five per centum per annum to be charged on the said Revenue such sum or sums of money not exceeding in the whole the said sum of one hundred and seventy-eight thousand seven hundred and fifty pounds as he shall from time to time deem requisite and such sum or sums

when so borrowed shall be paid to the said Treasurer and shall be by

him placed to the credit of the said " Permanent Public Works'

Account" and shall be applied accordingly and the interest upon all such moneys so borrowed shall be paid by the said Treasurer out of the said General Revenue at such times and in such sums as the Governor shall by warrants or orders in writing signed by him from time to time order and direct.

4. The Accounts of the sums expended on the said Public Works and of the sums borrowed for the purposes thereof shall be annually laid before the Legislative Council of the Colony and shall be examinable in the same manner as if the sums so expended and the sums so raised had formed part of the Current Annual Expenditure and Revenue of the Colony.
