2 Public Hospitals (Third Party Patients) Validation of Fees and Charges No. 47, 1991 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. Short title 1. This Act may be cited as the Public Hospitals (Third Party Patients) Validation of Fees and Charges Act 1991 . Commencement 2. This Act commenced on 18 July 1991. Interpretation 3. In this Act— “Board” means a Hospitals Board that was constituted under the Hospitals Act 1936 ; “third party patient” means a third party patient within the meaning of the Public Hospitals (Fees and Charges) Regulations 1989 as amended by the Public Hospitals (Fees and Charges) (Amendment) Regulations 1991 . Validation of fees and charges 4.(1) It is declared that a Board always had the power to impose fees and charges— (a) under regulation 6(f) of the Public Hospitals (Fees and Charges) Regulations 1984 on and from 13 July 1985; and (b) under regulation 4(j) of the Public Hospitals (Fees and Charges) Regulations 1989 before the commencement of the Public Hospitals (Fees and Charges) (Amendment) Regulations 1991 ; in respect of third party patients.

3 Public Hospitals (Third Party Patients) Validation of Fees and Charges No. 47, 1991 (2) Subsection (1) applies despite— (a) regulation 5(g) of the Public Hospitals (Fees and Charges) Regulations 1984 ; and (b) the definition “third party patient” in regulation 3 of the Public Hospitals (Fees and Charges) Regulations 1989 as in force for the time being before the commencement of the Public Hospitals (Fees and Charges) (Amendment) Regulations 1991 . (3) Subsection (1) does not affect— (a) a decision of a court before the commencement of this Act in relation to the liability of a third party patient to pay the fees and charges mentioned in subsection (1); or (b) a decision of a court after that commencement in relation to such a liability if the liability was in issue before the court at that commencement.
