AN ORDINANCE

To amend the Public Health (Prohibited Drugs) Ordinance 1957.

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administra­ tion) Act 1910.

PUBLIC HEALTH (PROHIBITED DRUGS) (AMENDMENT)

ORDINANCE 1977

1. This Ordinance may be cited as the Public Health (Prohibited
Drugs) (Amendment) Ordinance 1977.*
2. Section 6 of the Public Health (Prohibited Drugs) Ordinance

1957f is amended by omitting the word "Director-General" and sub­
stituting the word " Commissioner ".

3. After section 6 of the Public Health (Prohibited Drugs) Ordin­ ance 1957 the following section is inserted:—

" 6 A . (1) The Commissioner may, by instrument in writing, auth­ orize a person who is engaged in scientific or medical research to have in his possession a specified prohibited drug for the purposes of research.

Authorised by the ACT Parliamentary Counsel—also accessible at

" ( 2 ) An authority under sub-section (1) is subject to such conditions and restrictions (if any) as are specified in the authority.
" ( 3 ) A person to whom an authority under sub-section (1) has been granted shall comply with such conditions and restrictions as are specified in the authority for the purpose of sub-section (2 ) .

Penalty: $500.
" ( 4 ) While an authority granted under sub-section (1) remains

in force, the person to whom the authority was granted does not commit an offence against sub-section 4 (1) by reason only of preparing, having in his possession or using a prohibited drug specified in the authority.".
