Regulations under the Public Health Ordinance 1928'

I, RALPH JAMES D U N N E T HUNT, the Minister of State for Health, hereby make the following Regulations under the Public Health Ord­ inance 1928.

PUBLIC HEALTH (PENALTIES) REGULATIONS

1. These Regulations may be cited as the Public Health (Penalties) Regulations.

2. Regulation 21 of the Public Health (Barbers ' Shops) Regulations is amended by omitting all words after "Pena l ty : " and substituting—

"$250 and, where the offence is a continuing offence, an amount, not exceeding $400, calculated at the rate of $20 for every day dur­ ing which the offence continues.' ' .

3 . Regula t ion 18 of the Publ ic Heal th (Board ing-houses)

Regulations is amended by omitting all words after "pena l ty" (first occurring) and substituting "not exceeding—

(b) in any other case—$500.".

(a)

in the case of a continuing offence—the aggregate of $250 and an amount, not exceeding $400, calculated at the rate of $20 for every day during which the offence continues; and

(b) in any other case—$250.".

4. Regulation 104 of the Public Health (Dairy) Regulations is amended by omitting all words after " p e n a l t y " (first occurring) and substituting "not exceeding—

(a)

in the case of a continuing offence—the aggregate of $500 and an amount, not exceeding $1,000, calculated at the rate of $50 for every day during which the offence continues; and

5. Regulation 22 of the Public Health (Eating Houses) Regulations is amended by omitting all words after the word "pena l ty" (first occur­ ring) and substituting "not exceeding—

(a)

in the case of a continuing offence—the aggregate of $500 and an amount, not exceeding $1,000, calculated at the rate of $50 for every day during which the offence continues; and

(b) in any other case—$500.".

6. Regulation 35 of the Public Health (General Sanitation) Regulations is amended by omitting all words after "pena l ty" (first oc­ curring) and substituting "not exceeding—

(a)

in the case of a continuing offence—the aggregate of $250 and an amount, not exceeding $400, calculated at the rate of $20 for every day during which the offence continues; and

(b) in any other case—$250.".

7. Regulation 23 of the Public Health (Infectious and Notifiable Diseases) Regulations is amended by omitting all words after "convic­ t ion ," and substituting "is punishable by a fine not exceeding—

(a ) in the case of a continuing offence—the aggregate of $500 and an amount, not exceeding $1,000, calculated at the rate of $50 for every day during which the offence continues; and
(b) in any other case —$500.".

8. Regulation 13 of the Public Health (Laundries, Dry Cleaning Establishments and Dye Works) Regulations is amended by omitting all words after "Pena l ty : " and substituting "$250 and, where the offence is a continuing offence, an amount not exceeding $400, calculated at the rate of $20 for every day during which the offence continues.".

9. Regulation 1 of the Public Health (Meat) Regulations 1931 is

amended by omitting " 1931" .

10. Regulation 7 of the Public Health (Medical and Dental Inspection of School Children) Regulations is amended by omitting all words after "offence" (first occurring) and substituting "and punish­ able, on conviction, by a fine not exceeding—

(a)

in the case of a continuing offence—the aggregate of $250 and an amount, not exceeding $400, calculated at the rate of $20 for every day during which the offence continues; and

(b) in any other case—$250.".
11. Regulation 10 of the Public Health (Piggeries) Regulations is

amended by omitting all words after " p e n a l t y " (first occurring) and

substituting "no t exceeding—

(a)

in the case of a continuing offence—the aggregate of $250 and an amount, not exceeding $400, calculated at the rate of $20 for every day during which the offence continues; and

(b) in any other case—$250.".

12. Regulation 22 of the Public Health (Private Hospitals) Regulations is amended by omitting all words after "pena l ty" (first oc­ curring) and substituting "not exceeding—

(a)

in the case of a continuing offence—the aggregate of $250 and an amount, not exceeding $400, calculated at the rate of $20 for every day during which the offence continues; and

(b) in any other case—$250.".

13. Regulation 107 of the Public Health (Sale of Food and Drugs) Regulations is amended by omitting all words after the word "pena l ty" (first occurring) and substituting "not exceeding—

(a) in the case of a continuing offence—the aggregate of $500 and an amount, not exceeding $1,000, calculated at the rate of $50 for every day during which the offence continues; and
(b) in any other case -$500 . " .

14. The regulations specified in the Schedule are amended as set out in that Schedule.
